DEPARTMENT OF THE TREASURY
LIMITED-SOURCES JUSTIFICATION
This acquisition is conducted under the authority of the Multiple Award Schedule Program (see FAR 8.401)

1. Identification of the agency and the contracting activity:
The requiring activity is the Chemical Safety Board (CSB) Office of Investigation and the contracting activity is Bureau of the Fiscal Service.
2.a Nature and/or description of the action being approved:
The purpose of this limited-sources justification is to obtain approval to award a task order with Atlas Engineering Inc. to provide structural engineering services to monitor the hazards within the damaged areas of the facility by entering alongside CSB investigators to assist in conducting continual observations. The need date for these items is 15 September 2020 and the period of performance shall be for three months.

The objective of this task order is to obtain the services of a structural engineering firm to monitor the hazards within the damaged areas of the facility by entering with CSB investigators and provide support and consultation in continual observations.

3.c IGCE/Estimated dollar value:
The IGCE is $30,000 over a performance period of 3 months.
4.a Identification of the authority being used (Check the appropriate box that applies).
FAR 8.405-6(a)(1)(i)(A) – An urgent and compelling need exists, and following the procedures would result in unacceptable delays.
FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
FAR 8.405-6(a)(1)(i)(C) – In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order or BPA provided that the original order or BPA was placed in accordance with FSS procedures in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

This acquisition is conducted under the authority of the Multiple Award Schedule Program (see FAR 8.401)

The urgency of this requirement is derived from the need to complete the work immediately so that other government Agencies can enter the site to accomplish their Agency’s mission. The CSB has a responsibility to conduct accident investigations; formulate corrective or preventive recommendations based on investigation findings and advocate for their implementation; issue reports containing the conclusions, findings, and recommendations arising from accident investigations; and conducting studies on chemical hazards, however those tasks cannot be complete with out the knowledge of the proposed contractor’s determination that the site is safe for entry and no structural hazards exist. The proposed contractor has extensive knowledge assessing structural hazards of buildings that have suffered damage from fire and natural disasters. Completion of the tasks under this task order will assist in preventing the stoppage of all work at the facility.
5. A determination by the ordering activity Contracting Officer that the order or BPA represents the best value consistent with FAR 8.404(d):
In accordance with the government’s estimate, the program office finds that the price represents the best value in accordance with previous task orders and the vendor’s GSA schedule pricing.
6. A description of the market research conducted among schedule holders and the results or a statement why market research was not conducted:
The government’s pricing is derived from past performance. Due to the contractor’s unique qualifications and the urgency of the proposed requirement, additional market research was not conducted; however the government will see competition of these services in subsequent acquisitions where the need is not urgent and compelling.

Previously, the government utilized the services of the proposed contractor under task order 95315819F00001 for structural engineering services related to the AB Specialty Silicones incident.

8. A statement of the actions, if any, the Requiring Activity and Contracting Activity may take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for the supplies and services is made:
The program office will consider competing the requirement where an urgent and compelling need is not required.
