Sole Source Justification for NG 911 Intrado Viper Service Federal contract opportunity
Solicitation number
HC101920QA010
Issued by
Defense Information Systems Agency

About this file

This document is a sole source justification for NG 911 Intrado Viper Service requirements at Joint Base Pearl Harbor-Hickam in Hawaii. The Defense Information Systems Agency requires 10MB ethernet private diverse routing circuits from Hawaiian Telcom as the incumbent provider. Hawaiian Telcom is the only telecommunications provider authorized by the Public Utilities Commission to provide NG 911 services on Oahu due to existing infrastructure and emergency agency interfaces. The sole source reaward contract to Hawaiian Telcom is valued at an unknown amount and was awarded on September 21, 2020 under solicitation HC101920QA010. The sole source justification cites potential disruption to critical emergency response services as the reason for limiting competition, as transitioning to an alternative provider could compromise public safety.

(3) Discussion regarding cause of the sole source situation. This service was previously acquired from Hawaiian Telcom Inc. Full and open competition would not be feasible even if additional acquisition time was provided as other companies would not have PUC authorization to provide NG 911.

(4) Impact.

Disruption to NG 911 services would be a severe threat to the safety of our military bases. NG 911 provides the warfighter, the DOD families, and military communities contact to first responders and emergency managers. Award to Hawaiian Telcom, the incumbent, would not require transition challenges that could compromise public safety 911 functions. Any lapse in critical NG 911 services could result in unnecessary loss of life and property. Other telecom providers cannot provide these services, as Hawaiian Telcom is the only provider on the Island of Oahu with PUC authorized NG 911 public safety agency interfaces

6. BETA.SAM.GOV ANNOUNCEMENT/POTENTIAL SOURCES: This requirement will be synopsized in the beta.SAM.gov in accordance with Federal Acquisition Regulation, Subpart 5.2., as a sole source requirement to the Hawaiian Telcom. Responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency.

7. DETERMINATION OF FAIR AND REASONABLE COST:

Hawaiian Telcom’s tariff prices are regulated by the PUC and the Federal Communications Commission that have the effect of law. A determination of fair and reasonable cost will be based on PUC rate confirmation, comparison to the Independent Government Cost Estimate, and comparison with Hawaiian Telcom’s competitive prices in past procurements.

8. MARKET RESEARCH: Limited market research was conducted because Hawaiian Telcom Inc. is the contractor mandated by the PUC commission to provide this service. Hawaiian Telcom possesses specific design knowledge and operation of the existing 911 PSAP system.

Although other competitive large business local exchange carriers have existing I/Q/O circuit awards with DITCO-Pacific in Hawaii, they will not be able to provide this service. We will continue to monitor the market and if circumstances change, we will conduct full and open competition. This market research information is not more than 12 months old.

9. ANY OTHER SUPPORTING FACTS: None

10. LISTING OF INTERESTED SOURCES: None. When market research was conducted, no sources expressed interest in this requirement. As stated in Para. 6 above, a synopsis will be published prior to issuance of solicitation or contract award.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

(a) Procurement History.
