About this file

This is a bid document for the City of Westminster, Colorado, soliciting a Construction Manager at Risk (CMAR) for the Big Dry Creek 54-inch Interceptor Rehabilitation Analysis and Design Project. The project involves rehabilitation analysis and design services for a 54-inch interceptor pipeline owned and operated by the City. Prospective contractors must submit proposals demonstrating qualifications in construction management, water infrastructure projects, and design coordination. The City will evaluate proposals based on contractor experience, project approach, team qualifications, and proposed pricing. Key submission requirements include a detailed project management plan, evidence of similar project experience, financial statements demonstrating contractor stability, and proof of applicable licenses and insurance. The solicitation establishes specific response deadlines and evaluation criteria for contractor selection, with the selected CMAR expected to manage design development, cost estimating, and constructability review throughout the analysis and design phase prior to construction.

The contract structure is contingent upon successful proposal evaluation and City approval, with compensation to be determined based on the scope of services and project requirements. The funding for this project is provided through the City of Westminster's capital improvement budget and utility revenues. Contractors must demonstrate financial capacity and bonding ability to support the project through design completion. The CMAR will work collaboratively with the City's engineering team and project stakeholders to ensure the rehabilitation design meets all regulatory standards, budget constraints, and schedule requirements. Contract terms include provisions for project scheduling, milestone deliverables, and potential adjustments based on final scope definition during the analysis and design phase.

The City of Westminster, hereinafter referred to as the City, is inviting qualified construction contractors to submit proposals for a Construction Manager at Risk (CMAR) for the Big Dry Creek 54-inch Interceptor Rehabilitation Analysis and Design Project. This RFP outlines the scope of work, requirements, and conditions for proposing. The successful Proposer, hereinafter referred to as the Contractor, will enter into a contract with the City for the completion of the work outlined herein.

A.2 PROJECT DESCRIPTION

The project includes the rehabilitation of the final segment of the Big Dry Creek Interceptor Sewer (BDCIS), a 54-inch diameter pipeline along with a new diversion structure. The selected CMAR will assist the City of Westminster and its Consultant from 30% to final design phases. Rehabilitation includes cured-in-place pipe (CIPP) to deliver a sustainable and cost-effective result.

The CMAR will be required to provide Phase 1 Preconstruction Services that include constructability and phasing reviews, schedule and cost model development, risk identification and mitigation, and procurement planning. Deliverables for Phase 1 will include participation in workshops and design meetings, development of a Guaranteed Maximum Price (GMP) proposal, and preparation of project management plans such as safety, quality, and environmental management.

If awarded, the CMAR will then perform Phase 2 Construction Services, which will encompass bidding and procurement of subcontractors, execution of construction and commissioning activities, and implementation of the project management plans developed in Phase 1. Throughout both phases, the contractor will be responsible for transparent cost estimating, documenting decisions, and coordinating closely with City staff and the design team to maintain operational continuity at the facilities.

Location: 128th and N. Pecos to BDC WWTF Estimated Duration: Phase 1: 6 to 8 months, Phase 2: 6 to 9 months

A.3 TERM:

Please include an anticipated project duration for the work remaining with your submittal.

All payments and obligations under any resulting contract are subject to annual appropriation of funds by the Westminster City Council for each fiscal year. If the City Council does not appropriate funds for any fiscal year during the term, the contract will terminate as of the end of the last fiscal year for which funds were appropriated.

If the CMAR proposed revisions to the Draft CMAR Contract in Exhibit A: Sample CMAR Agreement with General Conditions. All indirect pricing provided by the Proposer shall be treated as a de fact that the Owner can accept as is, which would result in its incorporation into the GMP Proposal and its acceptance by the City it would become a binding contract between the CMAR Firm without further negotiations or revision.

E. Please be advised that the Owner is not interested in proposed fees or rates that provide excessive discounts from the CMAR Firm’s anticipated actual costs for the construction phase services. If Owner determines, at its sole discretion that the fees and rates included in a Proposal are unacceptably below industry norms or that a Proposer’s fees and rates are substantially or unacceptably below other Proposers, the Owner may, at its sole discretion either declare that Proposal to be non-responsive or seek additional detailed information from that Proposer concerning the cost basis for its Work Breakdown Proposal, prior to rendering a decision on the Proposal’s responsiveness.

XIII. Qualifications

Each responsive Proposal will be reviewed to determine whether it meets the Requirements outlined in this RFP. At its sole discretion, the selection committee may waive any failure to satisfy such requirements and may request clarification or additional information to address any questions that may arise in this regard.

Any Proposal that does not satisfy all of the Requirements may be rejected.

XIV. Interviews

The City, at its sole discretion, will determine how many firms to invite for interviews. If deemed beneficial by the evaluation committee, the highest scoring Proposers will be provided the opportunity to present their project approach during formal interviews. Interviews are intended to allow the Proposers to further explain their written Proposal.

In the event that any gratuities or kickbacks are offered or tendered to any City of Westminster employee, the proposal shall be disqualified and shall not be reinstated.
