About this file

This Bid/Proposal Bond Form is required by the Ontario International Airport Authority (OIAA), a joint powers authority between the City of Ontario and San Bernardino County, California, for the Construction Manager at Risk (CMAR) Terminal Restroom Modernization and Other Improvements Project. The bond serves as a security instrument to ensure bidder performance and contract execution. Proposers must submit either a bid/proposal bond equal to 10 percent of the aggregate bid amount or provide a certified or cashier's check in lieu of the bond. The bond obligates the principal and surety jointly and severally to the OIAA for liquidated damages equal to 10 percent of the aggregate amount bid if the principal fails or neglects to enter into a contract and execute required bonds within 30 days after contract award. All signatures on the bond must be notarized and corporate seals must be affixed; the attorney-in-fact must attach a power of attorney from the surety.

The bond form establishes the contractual security mechanism for a program with an estimated value of $25–$30 million during the initial three-year term and up to $50 million over a potential five-year contract term (initial three years plus two optional one-year extensions). Proposers must demonstrate a valid California Class A or B contractor's license, Department of Industrial Relations registration, and surety confirmation of bonding capacity up to $50 million. Award is contingent upon execution of draft contract terms and provision of performance and payment bonds totaling 100 percent of annual contract amounts. Proposers must also acquire a City of Ontario business license and complete Security ID (SIDA) badge enrollment. The program includes both federally funded projects (Terminal Restroom Modernization Project) subject to Davis-Bacon Act prevailing wage standards and Buy American preferences, and non-federally funded projects (Terminal Hold-Room Enhancement Project and Other Projects on an on-call basis).
