BUILD AMERICA BUY AMERICA
Buy America requirements have been modified by the passage of the Build America Buy America Act (BABA) as part of the Infrastructure Investment and Jobs Act (IIJA) in November 2021. The new requirements will apply to all steel and iron products, and construction materials supplied and permanently incorporated into a federal-aid project regardless of the funding source used to purchase the product and regardless of how the products were procured (i.e., agency furnished materials, materials added by change order, etc.). On May 14, 2022, a
180-day temporary waiver of the new Buy America requirements was granted for the addition of construction materials, extending the effective date to November 10, 2022. Once the temporary waiver expires on November
9, 2022, the Buy America requirements will be extended to construction materials in addition to the current steel and iron products.
All projects authorized on or after November 10, 2022, must comply with the new Buy America requirements.

Should the contract be awarded, the contractor, sub-recipient or subcontractor shall not discriminate on the basis of color, race, creed, national origin, religion, sex, age, sexual preferences, or physical or mental disability in the performance of the contract.
10. GENERAL CONDITIONS OF INVITATION TO BID
10.1 Job Site and Document Examination
Examine the job site and bid documents. Notify the Department of apparent errors and patent ambiguities in the plans, specifications, and Bid Item List. Failure to do so may result in rejection of a bid or rescission of an award.
Bid submission is your acknowledgment that you have examined the job site and bid documents and are satisfied with:
A. General and local conditions to be encountered
B. Character, quality, and scope of work to be performed
C. Quantities of materials to be furnished
D. Character, quality, and quantity of surface and subsurface materials or obstacles
E. Requirements of the contract
10.2 Bid Ineligibility
No employee of the County shall be eligible to submit a proposal for, nor to subcontract for any portion of, nor to supply any materials for any contract administered by the County.
A firm that has provided architectural or engineering services to the Department for this contract before bid submittal for this contract is prohibited from any of the following:
A. Submitting a bid
B. Subcontracting for a part of the work
C. Supplying materials
10.3 Rejection of Bids
Proposals may be rejected if they have been transferred to another bidder, or if they show any alteration of form, additions not called for, conditional bids, incomplete bids, erasures, or irregularities of any kind.
When proposals are signed by an agent, other than the officer or officers of a corporation authorized to sign contracts on its behalf or a member of a partnership, a "Power of Attorney" must be on file with the County prior to opening bids or shall be submitted with the proposal; otherwise, the proposal may be rejected as irregular and non-responsive.
10.4 Submittal Failure History
The County considers a bidder’s past failure to submit documents required after bid opening in determining a bidder’s responsibility.
10.5 Bid Withdrawal
An authorized agent may withdraw a bid before the bid opening date and time by submitting a written bid withdrawal request at the location where the bid was submitted. Withdrawing a bid does not prevent you from submitting a new bid.
After the bid opening time, a bidder cannot withdraw a bid.
10.6 Bid Relief
Attention is directed to the provisions of Public Contract Code Sections 5100 to 5110, inclusive, concerning relief of bidders and in particular to the requirement therein, that if the bidder claims a mistake was made in the bid presented, the bidder shall give the County written notice within 5 days after the opening of the bids of the alleged mistake, specifying in the notice in detail how the mistake occurred.
10.7 Disqualification of Bidders
More than one proposal from an individual, firm, partnership, corporation, or combination thereof under the same or different names will not be considered. Reasonable grounds for believing that any individual, firm, partnership, corporation or combination thereof is interested in more than one proposal for the work contemplated may cause the rejection of all proposals in which that individual, firm, partnership, corporation or combination thereof is interested. If there is reason for believing that collusion exists among the bidders, any or all proposals may be rejected. Proposals in which the prices obviously are unbalanced may be rejected.
10.8 Previous Disqualification, Removal or Other Prevention of Bidding
Pursuant to Section 10162 of the Public Contract Code, the bidder shall complete, under penalty of perjury, the questionnaire in the Bid Book relating to previous disqualification, removal or other prevention of bidding of the bidder, or officers or employees of the bidder because of violation of law or a safety regulation.
A bid may be rejected on the basis of a bidder, any officer of the bidder, or any employee of the bidder who has a proprietary interest in the bidder, having been disqualified, removed, or otherwise prevented from bidding on, or completing a federal, state or local project because of a violation of law or a safety regulation.
Communication of any kind by a firm with any County Board of Supervisors member for influencing selection before a contract is formally awarded will result in automatic disqualification.
10.9 Compliance with Order of the National Labor Relations Board
Pursuant to Public Contract Code Section 10232, the Contractor shall swear by a statement, under penalty of perjury, that no more than one final, unappealable finding of contempt of court by a
Federal court has been issued against the Contractor within the immediately preceding two-year period because of the Contractor's failure to comply with an order of a Federal court which orders the Contractor to comply with an order of the National Labor Relations Board. For purposes of
Section 10232, a finding of contempt does not include any finding which has been vacated, dismissed, or otherwise removed by the court because the Contractor has complied with the order which was the basis for the finding. The County may rescind any contract in which the Contractor falsely swears to the truth of the statement required by Section 10232.
The statement required by Public Contract Code Section 10232 is included in the Bid Book.
10.10 Ineligibility to Contract
Public Contract Code Section 10285.1 provides as follows:
Any state agency may suspend, for a period of up to three years from the date of conviction, any person from bidding upon, or being awarded, a public works or services contract with the agency under this part or from being a subcontractor at any tier upon the contract, if that person, or any partner, member, officer, director, responsible managing officer, or responsible managing employee thereof, has been convicted by a court of competent jurisdiction of any charge of fraud, bribery, collusion, conspiracy, or any other act in violation of any state or federal antitrust law in connection with the bidding upon, award of, or performance of any public works contract, as defined in Section
1101, with any public entity, as defined in Section 1100, including, for the purposes of this article, the Regents of the University of California or the Trustees of the California State University. A state agency may determine the eligibility of any person to enter into a contract under this article by requiring the person to submit a statement under penalty of perjury declaring that neither the person nor any subcontractor to be engaged by the person has been convicted of any of the offenses referred to in this section within the preceding three years.
The bidder must complete the Public Contract Code Section 10285.1 Statement included in the Bid
Book.
10.11 Public Record
Bids are public upon opening; after being opened, tabulations shall be completed within seven days
(Public Contract Code Section 10305).
10.12 Bidder’s Securities
The County keeps the securities of the 1st, 2nd, and 3rd low bidders until the contract has been executed. The other bidders’ securities, other than bidders’ bonds, are returned upon determination of the 1st, 2nd, and 3rd low bidders, and their bidders’ bonds are of no further effect (Public Contract
Code Section 10184).
10.13 Bid Rigging
The U.S. Department of Transportation (DOT) provides a toll-free hotline to report bid rigging activities. Use the hotline to report bid rigging, bidder collusion, and other fraudulent activities. The hotline number is (800) 424-9071. The service is available 24 hours 7 days a week and is confidential and anonymous.
