CHISD is a government body subject to the Texas Public Information Act (TPIA). Proposer acknowledges that CHISD is subject to the TPIA. As such, upon receipt of a request under the TPIA, CHISD is required to comply with the requirements of the TPIA. For purposes of the TPIA, "public information" is defined as information that is written, produced, collected, assembled, or maintained under a law or ordinance or in connection with the transaction of official business: by CHISD; or for CHISD and CHISD

A. owns the information; or B. has a right of access to the information; or C. spends or contributes public money for the purpose of writing, producing collecting, assembling, or maintaining the information; or by an individual officer or employee of CHISD in the officer's or employee's official capacity and the information pertains to official business of CHISD.

Proposer is expected to fully cooperate with CHISD in responding to public information requests. This includes, but is not limited to, providing CHISD with requested documentation. The District will presume all submissions are public unless the Proposer identifies all trade secret/proprietary/etc. information on a separate sheet and on each affected page. Proposer acknowledges that it has the responsibility to brief the Attorney General's Office on why the documents identified as confidential and/or proprietary fall within an exception to public disclosure. Responses submitted to CHISD as a result of this solicitation are subject to release as public information after contracts are executed or the procurement is terminated. The requirements of Subchapter J, Chapter 553, Texas Government Code, may apply to this solicitation and the Contractor agrees that the contract can be terminated if the Contractor knowingly or intentionally fails to comply with a requirement of that subchapter.
