Bid Bond Preparation Instructions

This document is a Bid Bond Preparation Instructions template issued by the State of West Virginia, Department of Administration, Purchasing Section, for use in the Transitional Living Facility HVAC Replacement project. The instructions provide detailed guidance on the required format, content, and execution of bid bonds that must accompany proposals submitted in response to this solicitation. The bid bond serves as a guarantee that the bidder will enter into a contract if selected and will furnish all required bonds and insurance as specified in the bid documents.

The bid bond must be executed by both the Principal (the bidding contractor) and a Surety (a corporation licensed in West Virginia to transact surety insurance). The minimum acceptable bid bond amount is five percent of the total bid amount, which may be stated either as a percentage or a specific dollar figure. The bond must be properly sealed and signed by authorized representatives—specifically the President, Vice President, or Duly Authorized Agent of the Principal entity, and the Attorney-in-Fact of the Surety. A dated Power of Attorney with Surety seal must accompany the bid bond. The Surety's liability is limited to the penal amount of the bond and shall not be impaired by any extension of time granted by the State for bid acceptance. Failure to provide a properly executed bid bond in accordance with these instructions may result in bid rejection or disqualification.
