About this file
This document contains Bid Bond Preparation Instructions for the West Virginia Department of Administration's Purchasing Section, establishing requirements for bid bonds submitted in response to state contract opportunities. The instructions provide a standardized template and detailed guidelines for preparing bid bonds, including specific fields to be completed by bidders and their sureties. The related contract opportunity involves a shower remodel to a seamless wall system project. Key requirements include that bidders must identify their business entity name, location, and surety information; specify the scope of work; and execute the bond with appropriate signatures and seals from authorized representatives of both the principal bidder and the surety company.
Bid bond amounts must equal a minimum of 5% of the total bid amount, stated either as a percentage or a specific dollar figure. The surety executing the bond must be licensed in West Virginia to transact surety insurance and must affix its corporate seal to the document. Additionally, a dated Power of Attorney with the surety's seal affixed must accompany the bid bond submission. The surety's liability under the bond is capped at the stated penal amount, and the surety waives notice of any extensions of time for bid acceptance. The bond becomes null and void if the bid is rejected or if the bid is accepted and the principal enters into a contract, furnishes required bonds and insurance, and performs all agreement obligations as outlined in the bid proposal.
