The requirements of the mandatory responsibility criteria section apply to all subcontractors regardless of tier.

E. REQUESTS FOR MODIFICATION OF SUPPLEMENTAL RESPONSIBILITY CRITERIA

During the bidding period, but not later than August 12, 2026, a potential bidder may request that the Owner modify the Supplemental Bidder Responsibility Criteria. Any such request must be in writing and submitted to the email address in Section 1.03.

The Owner shall evaluate any such requests, and if a decision is made by the Owner in its sole discretion to modify the criteria, such modification shall be communicated to all bidders and plan holders via the issuance of an addendum to the bidding documents. If the Owner determines not to modify the supplemental criteria, the Owner shall notify the requesting bidder of its decision in writing.

1.06 POSTPONEMENT OF OPENING

The Owner reserves the right to postpone the date and time for receiving and/or opening of bids at any time prior to the date and time established in the Advertisement for Bids. Postponement notices shall be issued to contractors in the form of addenda.

1.07 CONSIDERATION OF BIDS

A. BIDDING PREFERENCE

In accordance with RCW 39.04.380, a reciprocal bid preference is enforced for resident contractors. If a bid is received from a contractor who is:

1. A nonresident contractor (that is, at the time of bidding on a public works project, does not have a physical office located in the State of Washington); and

2. From a state that provides a percentage bid preference to its resident contractors bidding on public works contracts in that state

Then, a comparable percentage disadvantage will be applied to the Total Bid of that nonresident contractor. The state of residence for a Nonresident contractor is the state in which the contractor is incorporated or, if not a corporation, the state where the contractor’s business entity was formed. All nonresident contractors will be evaluated for out-of-state bidder preference. If the state of the nonresident contractor provides an in-state contractor preference, a comparable percentage disadvantage will be applied to their bid prior to determining the lowest responsive, responsible bidder.

If a nonresident contractor is still the lowest responsive, responsible bidder after the nonresident disadvantage total is applied, then they will be awarded a contract in the amount of their original bid (not including the disadvantage percentage amount).

B. REJECTION OF BIDS

1. Irregular Bids

The Owner reserves the right to reject Bids which are incomplete, obscure, or irregular as determined by Owner. The Owner also reserves the right to waive any immaterial irregularities in any bid. If an uploaded document cannot be opened or is unreadable, Owner will make a reasonable effort to contact the bidder to access the submitted information. The bid may be considered nonresponsive at Owner's discretion.

2. Collusion

If the Owner has reason to believe that collusion exists among Contractors and subcontractors, the Owner will reject the Bids of the known participants in such collusion and may, at its option, require that all contractors certify under penalty of perjury that no collusion has occurred or exists. The Owner also, at its option, may reject all Bids received.

C. IDENTICAL BID TOTALS: If two or more lowest responsive Bid totals are exactly equal, then the tie-breaker will be determined by a drawing at the Bid opening as described in the current

July 2026

WSDOT Standard Specification 1-03.1(1). If an authorized representative from a Bidder is not present, a representative of the Owner shall draw for the bidder.

D. WITHDRAWAL OF BIDS: Prior to award of the contract, a contractor may withdraw its Bid providing it can establish to the Owner's satisfaction that a mistake was made in preparing the Bid. A contractor desiring to withdraw shall give written notice to the Owner no later than 5:00 p.m. on the first business day after bid opening or the request will not be considered. The notice shall specify in detail how the mistake occurred, and how the mistake made the Bid materially different than it was intended to be. Withdrawal will not be permitted for mistakes resulting from errors in judgment or carelessness in inspecting the site of the work or in reading the Project Manual. Owner will review the information and issue a determination on whether to allow withdrawal of the Bid.

1.08 RETURN / RELEASE OF BID GUARANTIES

Within ten working days after the Bids are opened, the Owner will issue checks for deposited certified or cashier’s checks or provide a statement releasing the bidder from the obligations and liabilities of the Bid Guaranty Bonds for those bids which are not to be considered further in making the award.

All other Bid guaranties will be held until the contract has been fully executed; after which, they will be returned or released, as applicable, to the respective contractors whose Bids they accompanied.

1.09 AWARD OF CONTRACT

The LOTT Clean Water Alliance Board of Directors is expected to take action on the contract on September 9, 2026. Award of the contract will be to the responsible Bidder with the lowest responsive bid as approved by the Board unless the Board rejects all bids. The Owner reserves the right to refuse a Bid if the Contractor does not meet the qualifications described.

Following Board action, acceptance of a Bid will be evidenced by a notice of award of contract in writing, delivered in person, by certified mail, or by e-mail with Delivery Receipt requested to the Contractor whose Bid is accepted and to the address specified on the Bid Proposal. No other act of the Owner shall constitute acceptance of a Bid. The award of contract shall obligate the Contractor, whose Bid is accepted, to furnish performance and payment bonds and evidences of insurance, and to execute the agreement set forth in the Project Manual.

1.10 EXECUTION OF CONTRACT

The contract Agreement as provided shall be executed by the successful Contractor and returned with the performance and payment bonds and evidences of insurance, within ten working days after receiving written notice of the award of the contract. After execution by the Owner, one copy of the agreement shall be returned to the Contractor.

1.12 INFORMATION REQUESTS

From time to time, it may be necessary for those individuals or agencies routinely involved in this bid process, such as bidders, plan centers, contractors, or subcontractors, to request information from Owner in electronic, paper, or other format, throughout the bid process. Owner will assume any such request is not made under the Washington Public Records Act (Act) unless the requester makes reasonably clear it is a request under the Act, WAC 44-14-04002. Owner may treat any information request as a public records request at its discretion. If Owner determines a request is made under the Act, the request will be referred to Owner’s Public Records Officer and may be reviewed by Owner’s legal counsel. Individuals or agencies understand and agree with this provision as it relates to all information requests that may be made in connection with the bid process for this project. The bid process is defined as being from bid advertisement date until a contract is entered into for the project.
