Due Diligence Notice of Intent to Accept a Best Value Offer

September 14, 2016

Assistant Secretary of Operational Services 1 Ashburton Place Boston, MA 02108

The Massachusetts Gaming Commission (MGC) would like to obtain permission to post a Notice of Intent to Accept a Best Value Offer from Jack Rabbit Design (JRD) for consulting services relative to website development and maintenance.

Background

In August 2012, the MGC procured the services of consultants, (Bid number S132964-V00000) to assist with website development and maintenance to include several related marketing initiatives. As a result of such procurement, the MGC selected Jack Rabbit Designs to conduct those services. Under the contract, JRD developed an external and internal website for MGC, and also assisted MGC with brand development. Currently JRD provides periodic ad-hoc technical expertise on issues that are unable to be resolved internally by MGC staff.

At this time, MGC largely handles the administration of the websites, general function monitoring and required updating with in-house expertise. However, the MGC anticipates that some additional and occasional technical assistance and web development may be required during a period of one year, in order to operate and maintain optimum efficiency and functionality.

Jack Rabbit Designs

Jack Rabbit Designs created MassGaming.com in 2013 and has since been assisting the Commission with necessary maintenance and other web development needs. As the website’s original developers, JRD staff has an essential and unique familiarity with the programming and other particulars of the site. As a result, JRD staff is able to respond to issues in a timely and cost-efficient manner. The website is a key function in the Commission’s day-to-day operations. A website malfunction is detrimental to the Commission’s service to the public. JRD understands MGC’s sense of urgency about MassGaming.com’s functionality and is able to deliver high-quality and expedient support services.

The Commission anticipates that such services will be required for at least the following year with an option to renew for 2 years.

The following is an estimation of the annual web development and maintenance services. This is an estimate only, and can be greater or lesser depending on circumstances that take place during the year.

Total Services: $25,000 at a rate of $175 per hour.

DETERMINATION OF OTHER INTERESTED BIDDERS

The intent of this Due Diligence Notice of Intent to Accept a Best Value Offer is to determine if there are any other interested bidders qualified and willing to provide a comparable or better offer of goods and services at rates better than or equal to those offered by the Service Provider. If there are any such interested bidders, they must provide evidence of their qualifications and willingness to provide a comparable or better offer by submitting a hard copy of their offer to the following address by 5:00 PM (prevailing Eastern Time) not later than fourteen (14) calendar days after the date of posting (i.e., by 5:00 PM on October 5, 2016): Massachusetts Gaming Commission, Attention: Elaine Driscoll, Director of Communications, the Massachusetts Gaming Commission, 101 Federal Street, 12th Floor, Boston, MA 02110 and an electronic copy by emailing the same to elaine.driscoll@state.ma.us. MGC will review all such submissions and determine whether they will either (i) withdraw the notice and not accept the Service Provider’s services or (ii) accept the offer from the Service Provider or (iii) accept an offer from any other offer or offering a comparable or better offer in their response or (iv) conduct a procurement that is fair, open and competitive for those services.
