17. JUSTIFICATION (ADD PAGES IF NEEDED)
A. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR
THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED.
BEP has an extensive computer network and enterprise architecture which includes Cisco Smartnet products. The Cisco Smartnet works to safeguard BEP’s network system. Cisco Smartnet gives IT technicians access to online troubleshooting tools, hardware replacement options, and online access to operating system updates. Cisco Smartnet delivers dependable, quick access to replace critical parts of the BEP network. BEP has warranties, licenses and contracts in place for maintenance and repair of its Cisco products.
B. DESCRIBE THE EFFORTS TAKEN TO ENSURE OFFERS WERE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR
WILL BE PUBLISHED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION
UNDER 5.202 APPLIES.
Market research found hundreds of small business authorized resellers of Cisco products, so no RFI or sources sought notice was published to FBO. A FAR subpart 12.6 combined synopsis/solicitation will be posted to FBO with this brand name justification and competition is expected.
C. DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR
AND REASONABLE.
Determination that the anticipated cost to the Government will be fair and reasonable will be based on comparison of proposed prices received in response to the solicitation.
D. DESCRIBE THE MARKET RESEARCH THAT WAS CONDUCTED AND THE RESULTS OF
THAT SURVEY. IF ACTIONS WERE TAKEN BY PROCUREMENT PERSONNEL TO SATISFY
THIS REQUIREMENT SUCH AS A GPE SOURCES SOUGHT SYNOPSIS, PLEASE SPECIFY.
The catalogs of the mandatory government sources listed in 8.002 do not include the required products. A keyword search for “cisco” on the Dynamic Small Business System found over 800 small business records. It is reasonable to conclude that there are even more small business capable of providing the required Cisco products who did not include “cisco” in their business description.
E. DESCRIBE ANY OTHER FACTS TO SUPPORT THE JOFOC.
Documents that support the JOFOC include: specifications list, Acquisition Plan, IGCE, Market Research.
F. LIST SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE
ACQUISITION.
No sources have expressed an interest in this acquisition.
G. LIST THE ACTIONS THE BUREAU WILL TAKE TO REMOVE OR OVERCOME ANY BARRIERS
TO PROMOTE THE COMPETITION ON ANY SUBSEQUENT ACQUISITIONS FOR SIMILAR
SUPPLIES OR SERVICES.
The BEP anticipates future brand name requirements for Cisco products will remain widely available and competed among resellers in the commercial marketplace.
H. STATEMENT THAT REQUIREMENT DOES NOT RESULT FROM A LACK OF PLANNING OR
THE EXPIRATION OF FUNDS.
The required products will meet BEP’s on-going efforts to update its IT infrastructure and increase capacity. The requirement does not result from a lack of planning or the expiration of funds, as the infrastructure update is a multiple year effort and BEP operates with no-year funding.
