About this file

This is a Brand Name/Sole Source Justification under $350K for PID N63394-26-SIMACQ-BD3-0048 issued by the Naval Surface Warfare Center Port Hueneme Division (NSWC PHD) Code 105. The procurement requires 24/7 alarm monitoring and support services for the Virginia Beach Detachment (VBD) electronic security system (ESS), including maintenance and upkeep of ESS hardware components, intrusion detection system (IDS) monitoring with quarterly testing, annual software license updates, and helpdesk support. The required services must maintain compliance with the VBD excepted network Authority to Operate (ATO; eMASS 11098) and DoD Manual 5200.01 Volume 3 and OPNAVINST 5530.14E.

The justification identifies Johnson Controls Inc (JCI)/Security Systems as the sole source based on two primary rationales: compatibility with existing systems and proprietary limitations. The current VBD ESS infrastructure operates on Software House CCURE 9000 software and associated hardware owned exclusively by JCI, which is the only system authorized under the VBD ATO. Additionally, the VBD IDS is configured to communicate only with JCI monitoring stations, with redundant capability through JCI's Mountain West monitoring station. Market research conducted through GSA, AbilityOne, UNICOR, and Software House confirmed JCI's exclusive ownership of the required software and hardware (APL #10159). Utilizing an alternative source would result in approximately two years of delay (6-12 months for vendor identification and 11-12 months for new ATO authorization) and substantial costs exceeding $500,000 in equipment replacement, labor, and duplicate service maintenance. The justification was certified by Technical Lead Marvin G. Abuan, Legal Counsel Julianne Surane, and Contracting Officer Arthur Wynn on May 22, 2026.

Brand Name/Sole Source Justification under $350K

PID Number: N63394-26-SIMACQ-BD3-0048 Department: Code 105 Company Name/Brand: Johnson Controls Inc (JCI)/Security Systems

Description of Product, Supplies or Services required to meet the agency’s needs:

NSWC PHD requires the procurement of 24/7 alarm monitoring and support services for upkeep of electronic security system (ESS) hardware components, intrusion detection monitoring and quarterly testing, and annual software license updates to remain compliant with Naval Surface Warfare Center (NSWC) Port Hueneme Division (PHD) Virginia Beach Detachment (VBD) Authority to Operate (ATO); eMASS 11098, and a helpdesk capability that can respond to the

VBD ESS.

Identification of Justification Rationale:

☒ The Material or service must be compatible with aspects (Form, Fit, and Function) with existing systems presently installed.

☒ A patent, copyright, proprietary data, or licensing agreement limits competition.

☐ These are “direct replacement(s)” parts/components for existing equipment.

☐ Urgency.

Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 3204(a)(1). FAR 6.302-1; Only one responsible source and no other supplies or services will satisfy agency requirements, IAW FAR 6.303-2(b)(4).

Identification of the Justification Rationale Explained:

The requirement is for sustained and uninterrupted ESS services for VBD buildings and secure spaces, which is mandated by DoD Manual 5200.01, Volume 3, and OPNAVINST 5530.14E.

Contractor must be able to provide maintenance, sustainment, and IDS monitoring with redundancy to the VBD ESS ACS software; Software House CCURE 9000, and its associated hardware, which is currently covered under the VBD excepted network Authority to Operate (ATO); eMASS 11098. Contractor must also provide 24/7 monitoring services and provide monitoring continuity if the primary monitoring station goes down.

The current ACS infrastructure that makes up the VBD ESS incorporates Software House CCURE 9000 and is covered under ATO; eMASS 11098. Specifically, the Software House CCURE 9000 and the associated hardware is necessary to ensure effective operation and interface of the ACS infrastructure. Since JCI holds proprietary rights to the Software House CCareE 9000 software and associated hardware and since the ACS infrastructure, based on

ATO; eMASS 11098, can only be supported by the Software House CCURE 9000 software, JCI is the only source that can meet NSWC PHD VBD’s needs.

Additionally, VBD ESS’s Intrusion detection system (IDS) is also configured to communicate only with JCI monitoring stations that monitor alarm activity. In the event of sudden interruptions to the primary JCI monitoring station located in the Midwest, JCI has the ability to establish continuity with another monitoring station that is located in the Mountain West subregion. Due to the proprietary nature of JCI’s software and hardware configuration within the IDS as well as JCI’s software and hardware form, fit, and function to facilitate this type of monitoring, no other monitoring stations can communicate with VBD ESS’s IDS and, thus, meet NSWC PHD VBD’s needs.

Specific Characteristics of the Item or Service required that Limit the Availability to a Sole Source or Brand Name:

Utilizing a different source than JCI would result in an unreasonable delay of approximately 2 years. This estimate is based off previous marketing research efforts and historical knowledge that stems from current ACS/IDS infrastructure. First, it would take approximately 6 months to one year to complete market research to identify a new vendor capable of installing and servicing current technology ACS/IDS that is compatible with our physical infrastructure and network. If a new capable source is successfully identified, it will take an additional 11 – 12 months to modify or create a whole new ATO to authorize the identified source to support the ACS and IDS and to connect to the excepted network. Due to the requirement to sustain security over classified and sensitive information, the customer cannot afford to have any delays for this effort since any delay will jeopardize the security of such information.

Additionally, utilizing a different source than JCI would result in a substantial duplication of cost of over $500k that is not expected to be recovered during competition. This estimate is based on the requirement to procure new equipment, labor for replacing the hardware and software, and the need to maintain duplicate services during the new vendor transition.

Market Research Conducted:

Market research was conducted utilizing GSA, AbilityOne, UNICOR, and Software House.

Software house is listed as a Johnson Controls brand name on their website. GSA also returned with a successful query result for JCI showing that they are the only vendor that owns Software House CCURE 9000 software and the associated hardware that interfaces with the software (Approved Products List (APL) #10159). As further described in FAR 16.505(4)(i), no additional marketing research was conducted due to other vendors’ inability to provide service support to VBD ESS as per the VBD ATO; eMASS 11098, and interface with JCI IDS monitoring stations

Statement of Actions, if any to Remove Barriers to Competition in the Future:

For the reasons set forth in this sole source justification, Code E30 has no plans at this time to complete future contracts for the types of supplies/services covered by this document. If another potential source emerges, Code E30 will assess whether competition for future requirements is feasible.
