JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)
In accordance with FAR Subpart 6.302-1 entitled “Only one responsible source and no other supplies or services will satisfy agency requirements” the following information is herein documented regarding the non-competitive justification of the below-stated acquisition:
(1) Procuring activity is the IBB Office of Contracts. This document is a “Justification for Other than Full and Open Competition (JOFOC)”.
(2) The action being approved herein is a non-competitive acquisition of Tealium Tag Manager Software as a Service(SAAS) services for managing BBG entity (VOA, RFERL, MBN, OCB, RFA) javascript tags on digital properties including websites and mobile applications and technical support for implementation and updates.
(3) The description of the service is as described above in item (2). The cost of this acquisition is $96,000/year.
(4) The BBG is citing one statute for this non-competitive procurement, FAR Subpart 6.302-1, 41 U.S.C.253(c)(1) which permits other than full and open competition for this acquisition, and it is herein cited as follows: “When the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for”.
(5) The nature of the proposed acquisition requires use of the above-cited authority because the provider, Tealium, is the only source for the current tag management services for managing and loading web analytics (and other) tags on BBG digital properties. The requirements for these services are integral to the BBG’s ability to measure and correctly attribute consumption of and engagement with BBG digital properties. Project is currently an incomplete project, and is required for the completion of rollout of the BBG’s enterprise web analytics tool, particularly mobile application tracking and onsite event tracking. Maintaining continuity with Tealium’s services is critical for releasing and transitioning to the new, agency-wide web analytics tool. Additionally, Tealium’s services are the primary support for digital measurement of agency-wide strategic performance on digital platforms, and broker imperative information for day-to-day editorial decision-making. While other vendors may be able to provide similar technical services as Tealium, attempting to transition to a new vendor during the transition from fragmented digital analytics to an enterprise solution for digital platform metrics would present significant risk to the BBG at a higher cost to the agency. It is extremely important that the BBG continue these services throughout the initial rollout of the web analytics tool, with the option to exercise future years of service and support.
(6) The IBB Contracting Officer for this acquisition has determined that the cost to the Government for the above-stated acquisition will be fair and reasonable. This determination is based on prices paid for similar services using GCI’s GSA Schedule rates.
(7) Tealium is one of many services that provide software as a service, web-based tag manager software. Based on the responses to the original solicitation for this project, Tealium is the only vendor that provides comparable services for the available budget of $96,000.00. Transition to a new tag manager would introduce significant risk to the BBG’s digital analytics requirements and would result in additional costs to the BBG that are not funded under the existing budget and would further delay the release of the dependent web analytics tool.
(8) Other than the information already stated above in this JOFOC, The BBG’s CFO Office and IBB’s Office of Contracts do not know of any other facts that are pertinent to supporting the use of other than full and open competition for this acquisition.
(9) The following vendors submitted proposals to the original solicitation for Tag Management Tool:
· Diane will add the contractor’s information
(10) Should subsequent acquisition of the supplies/services required by this acquisition be necessary, IBB’s Office of Engineering & Technical Services and/or IBB’s Office of Contracts will conduct additional market research to try and identify additional firms that can provide the required supplies/services, and thus establish competition for such subsequent acquisition.
(11) We certify that this justification for other than full and open competition for the above-stated acquisition is accurate and complete to the best of our knowledge and belief:
