BROAD AGENCY ANNOUNCEMENT

BAA-AFRL-RVKD-2015-0002

Air Force Research Laboratory Directed Energy Directorate

FULL TEXT ANNOUNCEMENT

I. PROJECT DESCRIPTION

A. The Air Force Research Laboratory (AFRL) Directed Energy Directorate is interested in receiving proposals from all offerors for innovative and varying approaches to advance the state-of-the-art and scientific knowledge to develop a Beam Control System (BCS) in support of the SHiELD Turret Research in Aero-eFfEcts (STRAFE) project under the Self-Protect High Energy Laser Demonstrator (SHiELD) Advanced Technology Demonstration (ATD). The BCS will mitigate aero-optical and aero-mechanical effects detrimental to laser propagation in aircraft flying at and up to transonic speeds and to characterize these aero-effects at supersonic speeds. The objective of the SHiELD ATD is to develop, demonstrate, and assess a moderate-power laser system’s effectiveness against tactically relevant airborne threats. In order to achieve this objective, the Government is seeking the technology to design, build, test, and demonstrate a flight qualified laser weapon system to Technology Readiness Level (TRL) 6: a system demonstration in a relevant (in this case flight representative) environment. This demonstration will be accomplished by engaging a dynamic non-cooperative target from a maneuvering tactical platform in a transonic flight environment. In addition, the effort will include characterization of the supersonic environment, paving the way for a future TRL 6 demonstration in that regime.

B. The Government is contemplating a two phase demonstration schedule. The first phase employs the BCS to be developed in this effort, integrated with a low-power laser system in a flight capable pod. The pod developer will incorporate companion power, thermal management, integrating structure, and system control for system operation. The resultant integrated pod-based low-power system will demonstrate beam control performance in transonic flight, and characterize aero-effects for the supersonic flight regime against a provided beacon source. To reduce schedule risk, offerors are to include the cost of an option to build a second identical BCS (as the first phase BCS’ design closes) in their proposal. This second BCS may be used to troubleshoot issues offline, to explore potential adjustments or component swaps, or to quickly replace its sister BCS in contingencies. In the second phase, the BCS will be incorporated with a moderate power laser and accompanying power and thermal management subsystems, culminating in a laser system demonstration against dynamic non-cooperative targets.

C. The SHiELD ATD program is anticipating five potential procurements. STRAFE is the first of these procurements and is focused on an innovative beam control subsystem. The other four activities (which are not part of this BAA) will provide the flight-pod integration effort described above, systems engineering support, a moderate power laser source, and target/test diagnostic support. Because of these multiple procurements, STRAFE offerors should expect to work closely with other contractors to meet the objective of the SHiELD ATD.

D. A supplemental information package containing technical information for potential offerors is available. This package contains both Controlled Unclassified Information (CUI) and Secret information. Offerors must have a valid U.S.

security clearance of Secret or higher in order to receive the information package classified at the Secret level. This package will only be released to offerors who have signed the non-Disclosure Agreement and have the appropriate clearances.

All classified material must be handled in accordance with the National Industrial Security Program Operating Manual (NISPOM) (DoD 5220-22-M) and Industrial Security Regulation (DoD 5220.22-R). Instructions for requesting this information from the STRAFE Bidder’s Library is available on FedBizOpps (www.fbo.gov) under this announcement number (BAA-AFRL-RVKD-2015-0002 – STRAFE Bidder’s Library Notice).

E. In accordance with (IAW) FAR 35.002 Research and Development (R&D) contracts are directed toward objectives for which the work or methods cannot be precisely described in advance. It is difficult to judge the probabilities of success or required effort for technical approaches, some of which offer little or no early assurance of full success. Due to the R&D nature of this BAA, improvements in technology and/or theories may result in possible changes to the contractor’s technical proposal or C-SOW, whether prior to award or after technical performance has commenced. Offerors are advised that additional latitude for changing a contract may exist where the contract is for R&D, noting that the scope of such contracts is often flexible to all unanticipated changes due to lack of definitiveness of the Government’s objectives.

F. Technical Objectives

1. STRAFE Project Objectives: The objective of STRAFE is to perform the research and development activities necessary to develop and deliver an advanced BCS with size, weight and power (SWaP) appropriate for integration as part of a complete laser system (laser, power, cooling and integrating structure subsystems) into a pod-like structure for a tactical aircraft. To be successful, offerors will increase knowledge and understanding of aero-optic disturbances in a supersonic environment by collecting data over the field of regard during specific engagement scenarios and deliver a BCS capable of neutralizing threats with a moderate-power laser in forward and aft pointing geometries in the transonic flight regime.

The contemplated BCS should be capable of airworthy integration into a pod-like structure; demonstration of system performance including acquisition, tracking, pointing, and scoring; and characterization of the system environment, and incorporation with other laser subsystems. An option for a second BCS, with identical performance requirements, is desired. Refer to Attachment 1 for the Statement of Objectives (SOO).

2. Data Deliverables: The following deliverables are representative of the types of data that may be required for STRAFE. The offeror is free to propose additional content to these reports, in accordance with intent. Draft

Small Businesses, Historically Black Colleges (HBCU), Minority Institutions (MI), Small Disadvantaged Business (SDB), Woman-Owned Businesses, and Service-Disabled Veteran-Owned Businesses are encouraged to submit proposals; however, no part of this announcement will be a set-aside.

Due to the nature of this requirement no foreign companies at the prime or subcontractor level shall be considered for award.

B. Cost Sharing or Matching: The Government is not considering a cost sharing arrangement.

C. Federally Funded Research and Development Centers (FFRDCs): The following guidance is provided for DoD sponsored and Non-DoD sponsored FFRDCs contemplating submitting a proposal, as either a prime or subcontractor, against this BAA. FAR 35.017-1(c)(4) prohibits an FFRDC from competing with any non-FFRDC concern in response to a Federal agency request for proposal for other than the operation of an FFRDC (with exceptions stated in DFARS 235.017-1(c)(4)). There is no regulation prohibiting an FFRDC from responding to an announcement. However, the FFRDC’s sponsoring agency must first make a determination that the effort being proposed falls within the purpose, mission, general scope of effort, or special competency of the FFRDC, and that determination must be included in the FFRDC’s proposal. In addition, the non-sponsoring agency must make a determination that the work proposed would not place the FFRDC in direct competition with domestic private industry. Only after these determinations are made would a determination be made concerning the FFRDC’s eligibility to receive an award.

D. Government Agencies: If a Government agency is interested in performing work, contact the TPOC identified in Section III.A. of this BAA. If those discussions result in a mutual interest to pursue your agency’s participation, the effort will be pursued independent of this announcement.

E. Export Control DD Form 2345 (Militarily Critical Technical Data Agreement):

VI. OTHER

A. Available Government Furnished Property (GFP)/Government Furnished Information (GFI)

1. Offerors are not required to utilize GFP/GFI; however the Government anticipates requests for use of GFP/GFI. The Government will provide maximum accommodation possible for requests of GFP, GFI or other permitted assistance that arise during the performance of the contract. In accordance with FAR 45.201(b), the contractor is responsible for all costs related to making the property available for use, such as payment of all transportation, installation, or rehabilitation costs. The offeror shall submit information in the proposal relevant to use of GFP. A list of potential Scheduled GFP is included with this announcement as Attachment 4.

2. In accordance with FAR 45.201(c), if Government Furnished Property (other than any GFP identified in this announcement) is requested, offerors shall submit the following information with their offer:

a) A list or description of all Government property that the offeror or its subcontractors propose to use on a rent-free, non-interference basis.

The list shall identify the accountable contract under which the property is held and the authorization for its use (from the contracting officer having cognizance of the property);

b) The dates during which the property will be available for use (including the first, last, and all intervening months) and, for any property that will be used concurrently in performing two or more contracts, the amounts of the respective uses in sufficient detail to support prorating the rent;

c) The amount of rent that would otherwise be charged in accordance with

FAR 52.245-9, Use and Charges (APR 2012); and

d) A description of the offeror’s property management system, plan, and any customary commercial practices, voluntary consensus standards, or industry-leading practices and standards to be used by the offeror in managing Government property.

3. The following clauses will be incorporated into any cost reimbursement contracts resulting from this BAA: FAR 52.245-1 Government Property or Alternate I (APR 2012), FAR 52.245-9 Use and Charges (APR 2012), DFARS 252.211-7007 Reporting of Government Furnished Property (AUG 2012), DFARS 252.245-7001 Tagging, Labeling and Marking of GFP (APR 2012), DFARS 252.245-7002 Reporting Loss of Government Property (APR 2012), DFARS 252.245-7003 Contractor Property Management System Administration (APR 2012) and DFARS 252.245-7004 Reporting Reutilization and Disposal (MAR 2015).

B. Contractor Acquired Property: The offeror shall propose Contractor Acquired

Property (CAP) to fulfill the proposed objective.

C. Available Base Facilities: If requested, AFRL facilities identified in the supplemental data package (Government Resources Test Overview STRAFE BFI.ppt) may be made available. Offerors shall specifically call out elements of the effort proposed to be conducted within the confines of Kirtland AFB, NM, and those that are to be performed off-site. Any differences in on-site versus off-site rates shall be specifically annotated in the proposal.

D. Data Rights: DoD policy, per DFARS 227.7103-1, is to acquire only the technical data and the rights in that data, necessary to satisfy Government needs. The Government anticipates receiving, as a minimum, “Government Purpose Rights” to technical data developed under contracts awarded based on proposals received in response to this announcement.

1. AFRL is engaged in the discovery, development and integration of warfighting technologies for our air, space and cyber forces. As such, rights in technical data and non-commercial software (NCS) developed or delivered under this contract are of significant importance to the Government and AFRL/RDL SHiELD ATD program.

2. In exchange for paying for development of the data, the Government expects technical data, NCS, and NCS documentation developed entirely at Government expense be delivered with Unlimited Rights.

3. Technical data, NCS and NCS documentation developed with mixed funding are expected to be delivered with at least Government Purpose Rights.

Offerors that propose delivery of technical data, NCS, or NCS documentation subject to Government Purpose Rights should fully explain what technical data, NCS, or NCS documentation developed with costs charged to indirect cost pools and/or costs not allocated to a Government contract will be incorporated, how the incorporation will benefit the project, and address whether those portions or processes are segregable. The Government expects that delivery of technical data, NCS, or NCS documentation subject to Government Purpose Rights will fully meet project needs.

4. Offerors that propose delivery of technical data, NCS, or NCS documentation subject to Limited Rights, Restricted Rights, or Specifically Negotiated License Rights will be considered. Proposals should fully explain what technical data, NCS, or NCS documentation developed with costs charged to indirect cost pools and/or costs not allocated to a Government contract will be incorporated and how the incorporation will benefit the project.

5. Offerors are reminded that the Identification and Assertion of Restrictions on the Government’s Use, Release or Disclosure of Technical Data or Computer Software (Attachment 6), required under DFARS clause 252.227-7013 Rights in Technical Data - Noncommercial Items (Feb 2014) and DFARS clause 252.227-7014 Rights in Noncommercial Computer Software and Noncommercial Computer Software Documentation (Feb 2014), and must be addressed in the business section of the Business/Cost volume. Assertions must be completed with specificity with regard to each item, component or process listed. Nonconforming assertions lists will be rejected.

6. Note that DFARS clause 252.227-7014(d) Rights in Noncommercial

Computer Software and Noncommercial Computer Software Documentation (Feb 2014) describes requirements for incorporation of third party computer software (commercial and noncommercial). Any commercial software to be incorporated into a deliverable must be clearly identified in the proposal.

Because many commercial software licenses may not be acceptable to the Government, commercial software licenses proposed for delivery to the Government must be approved by the contracting officer prior to award.

7. As used in this subparagraph, the terms Unlimited Rights, Government

Purpose Rights, Specifically Negotiated License Rights, and Limited Rights in technical data are as defined in DFARS clause 252.227-7013 Rights in Technical Data - Noncommercial Items (Feb 2014). The terms Unlimited

Rights, Government Purpose Rights, Specifically Negotiated License Rights, and Restricted Rights in noncommercial computer software and noncommercial software documentation are as defined in DFARS clause 252.227-7014. The term Commercial Computer Software is as defined in DFARS clause 252.227-7014.

8. Data rights offered other than “Unlimited Rights,” as defined in DFARS

227.7103-5, should be identified in DFARS clause 252.227-7017, Identification and Assertion of Use, Release, or Disclosure Restrictions (JAN 2011) (Attachment 7, page K-15), and addressed in the business section of the Business/Cost volume. If no data rights are being asserted state “none” in the assertions.

E. Associate Contractor Agreements

1. Associate Contractor Agreements (ACAs) are agreements between

Contractors working on Government contract projects that specify requirements for them to share information, data, technical knowledge, expertise, or resources. The Contracting Officer may require ACAs when Contractors working on separate Government contracts must cooperate, share resources or otherwise jointly participate in working on contracts or projects. ACAs will be required with other SHiELD ATD contractors as awards are made. Prime Contractor to subcontractor relationships do not constitute ACAs.

a) The Contractor shall enter into Associate Contractor Agreements (ACA) for any portion of the contract requiring joint participation in the accomplishment of the Government’s requirement. The agreements shall include the basis for sharing information, data, technical knowledge, expertise, and/or resources essential to the SHiELD program, which shall ensure the greatest degree of cooperation for the development of the program to meet the terms of the contract. Associate contractors are listed in paragraph g) below.

b) ACAs shall include the following general information:

(1) Identify the associate contractors and their relationships.

(2) Identify the program involved and the relevant Government contracts of the associate contractors.

(3) Describe the associate contractor interfaces by general subject matter.

(4) Specify the categories of information to be exchanged or support to be provided.

(5) Include the expiration date (or event) of the ACA.

(6) Identify potential conflicts between relevant Government contracts and the ACA; include agreements on protection of proprietary data and restrictions on employees.

c) A copy of such agreement shall be provided to the Contracting Officer for review before execution of the document by the cooperating contractors.

d) The Contractor is not relieved of any contract requirements or entitled to any adjustments to the contract terms because of a failure to resolve a disagreement with an associate contractor.

e) Liability for the improper disclosure of any proprietary data contained in or referenced by any agreement shall rest with the parties to the agreement, and not the Government.

f) All costs associated with the agreements are included in the negotiated cost of this contract. Agreements may be amended as required by the Government during the performance of this contract.

g) The following contractors are associate contractors with whom agreements are required:

Offerors shall use the SOO, together with other applicable portions of this BAA, as the basis for preparing their proposal, including the CWBS, C-SOW and CDRLs. The offeror shall ensure all aspects of the SOO are addressed. The C-SOW should specify in clear, understandable terms the work to be done in developing or producing the goods to be delivered or services to be performed by the contractor.

b) Preparation of an effective C-SOW requires both an understanding of the goods or services that are needed to satisfy a particular requirement and an ability to define what is required in specific, performance based and quantitative terms. The offerors understanding of both the required goods or services, and work effort required to accomplish the objectives should be fully demonstrated in the offeror's proposed CWBS, C-SOW, and CDRLs.

c) The requirements listed in Section I, Paragraph F.2. are known minimum Government data requirements. The offeror may include additional data requirements. All data requirements shall be traceable to specific tasks defined in the C-SOW. Each specific data requirement shall be selected from DoD 5010.12-M and specified on DD Form 1423.

(5) Milestone Chart: A milestone chart should indicate when specific objectives are expected to be met in the overall program schedule and should identify specific accomplishments necessary to proceed to the next task. Provide a schedule of when deliverable items identified in the BAA are to be delivered. The Government considers key schedule events and delineates them in the SOO. The offeror may supplement these milestones with others unique to their program plan, and based on their programmatic approach, BCS design and Risk Management Plan. For those milestones associated with risk reduction activities, the offeror shall propose specific risk reduction milestone events and accomplishment criteria. At a minimum, the offeror shall define additional milestones such as:
