About this file
This is a Sole Source Memorandum justifying a firm fixed price contract award to FIBA Technologies Inc. for the procurement of two 8-bottle banks to replace aging and leaking legacy bottles in the Naval Education and Training Command (NEDU) Ocean Simulation Facility bottlefield.
The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) is the contracting activity. FIBA Technologies Inc., located at 53 Ayer Road, Littleton, MA 01460 (CAGE 1TB18), will manufacture and deliver the equipment with an estimated ship year of 2026. Each DOT Ground Storage Tube Assembly features a 3,169 psi pressure vessel rated design, with individual tubes measuring 22" OD x 34'4"L x .492" wall thickness, nominal water volume of 627.2 cubic feet (78.4 per tube), and nominal weight of 4,433 pounds per tube. The assemblies will be configured in an I-beam arrangement (2 wide x 4 high), cleaned to SP-45 standards with Monel dip tubes, equipped with CPV380-3 and CPV380-1 globe valves, and shipped under vacuum. All components are USA-origin with country of origin certification.
The sole source justification is based on FIBA Technologies' unique qualifications: it is the exclusive supplier approved by NAVSEA00C for the Saturation Flyaway Dive System (SATFADS), developed the SP-45 cleaning standard jointly with the Navy and NAVSEA00C, collaborated with NEDU on design specifications to fit existing legacy bottlefield infrastructure, and is the only vendor approved to ship bottles under the NEDU BOTTLE-FLASK PURGE PROCEDURE, which provides cost savings through elimination of multiple fill and purge cycles with Grade B helium. The contracting officer determined the award represents best value and lowest overall cost. Market research was not conducted because FIBA Technologies is the only manufacturer capable of meeting the Government's needs. The requirement will be synopsized on sam.gov.

This acquisition will be conducted using simplified acquisition procedures. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.
4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
FIBA Technologies is the sole supplier of the bottles for NEDU’s Saturation Flyaway Dive System (SATFADS). FIBA supplies other flasks to the Navy, the SP45 cleaning standard for divers’ breathing gas and enriched oxygen/mixed gas was developed between FIBA, the US Navy activity who own the MIL-STD 1330 oxygen cleanliness standard, and NAVSEA00C. NAVSEA00C is the NEDU Immediate Superior In Command and certification authority as well as technical authority. NEDU provided feedback during the process since we have personnel here who are fluent in speaking about oxygen cleanliness, but NAVSEA00C approved this as the standard accepted for large bottle flasks for US Navy diving. Since NAVSEA00C certifies us and signs off on all changes within the scope of certification for the human subject testing and training that we do, we must use FIBA bottle banks as they are the only vendor with this certification. The approved cleaning procedure is the intellectual property of FIBA.
FIBA engaged with the Navy, at their own expense and of their own volition, to develop the cleaning standard. NEDU, 00C, and FIBA Technologies spent an entire year developing the cleaning standard, gathering the required data, and getting it approved to supply divers breathing gas through NAVSEA’s systems.
Secondly, FIBA Technologies and NEDU developed the design and the drawing specifications required to replace the legacy bottlefield flasks to fit within the confines of the legacy bottlefield and remaining piping and valving and to get the bottle banks approved by NAVSEA 00C for divers breathing gas for the Ocean Simulation Facility
(OSF).
Lastly, FIBA Technologies is the only vendor approved to ship the bottles in the condition that was used to develop the NEDU BOTTLE-FLASK PURGE PROCEDURE approved by NAVSEA 00C. This purge procedure allows for the elimination of having to double or triple fill and purge the bottles with Grade B helium, thus allowing for the realization of cost savings.
Therefore, FIBA Technologies is the only company that can provide the equipment, installation, objective quality evidence (OQE) as required to maintain certification.
Other systems would require recertification and development of a system design and cleaning standard approval to maintain the OSF Certification.
As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to acquire the bottles from FIBA Technologies.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, FIBA Technologies is the only manufacturer that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraphs 4 and 6 above, FIBA Technologies is the only company that can provide the required equipment.
