About this file
This document is a Sole Source Memorandum for rebuilding the Grade B Hot Water Kettle Pipe System for the Naval Experimental Diving Unit's (NEDU) Class 6 Oxygen Clean Room. The Naval Surface Warfare Center, Panama City Division (NSWC PCD) intends to award a firm fixed-price contract to Consolidated Water Group, LLC (dba Culligan) to replace a water system that is currently only 33% functional. The procurement includes 3 GL 100MSIE4DO 1 HP SS Centrifugal Pumps, CPVC pipe and fittings, and associated labor.
Culligan is being selected as the sole source vendor because their equipment is already installed throughout NEDU's clean room systems and is the only approved vendor through NEDU's certification authority. The water system is critical for creating Grade B water used to clean diving and life support equipment in high-pressure pure oxygen environments, with contamination levels required to be less than 5 parts per million. The Contracting Officer has determined this represents the best value and lowest overall cost alternative, and the requirement will be synopsized on sam.gov.

WATER KETTLE PIPE SYSTEM FOR NEDU’S CLASS 6 OXYGEN CLEAN ROOM
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.

This action will award a firm fixed price contract on a sole source basis to have Consolidated Water Group, LLC (dba Culligan, CAGE: 6RDB4) rebuild the hot water system used to create Grade B water currently utilized by the Class 6 O2 clean room. The hot Grade B water has degraded all the pipes, valves, and pumps of the current system which is currently only 33% functional.
3. A description of the supplies or services required to meet the agency’s needs.
Culligan will provide NEDU with a rebuilt Grade B hot water system so NEDU can continue to execute our mission.

This acquisition will be conducted using simplified acquisition procedures. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.
4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
Culligan equipment is installed throughout NEDU’s Class 6 Clean Room systems and Culligan currently services all the equipment. This equipment is utilized to create Grade B water for the cleaning of diving and life support equipment in high pressure pure O2 environments to contaminate levels of < 5 parts per million (ppm). The Culligan systems are the only approved systems for NEDU through NEDU’s certification authority. In order to maintain certification and warranties of the reverse osmosis system Culligan is the only vendor qualified to perform the modernization effort.
As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Government’s best interest to award on a sole source basis to Consolidated Water Group, LLC (dba Culligan).
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Consolidated Water Group, LLC (dba Culligan) is the only source that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 and 6 above, Consolidated Water Group, LLC (dba Culligan) is the only company that can meet the requirements.
