About this file
This document is a Sole Source Justification for a firm fixed-price purchase order to be awarded to Innovative Professional Solutions (IPS) for repairs and upgrades to the Battlespace Management System (BAMS) and Battle Space Profiler (BSP) subsystem for a Taiwan Navy Mine Hunter Coastal (MHC) ship under a Foreign Military Sales (FMS) case.
The justification states that IPS is the only responsible source that can meet the Navy's requirements due to their specialized knowledge of the BAMS, BSP subsystem, and cable repairs required. The repairs and upgrades are estimated to be acquired using simplified acquisition procedures. The government has determined this sole source award to IPS represents the best value to meet its needs. No other contractors are expected to be able to provide the required services or achieve the necessary timeline without significant delays. The acquisition will be synopsized on SAM.gov.

The Navy is providing repairs and maintenance for the BAMS for a Taiwan Navy MHC ship. The Foreign Military Sales (FMS) Case Number is TW-P-GPJ. The task requires specialized knowledge of the BAMS, specialized knowledge of the BSP subsystem, specialized knowledge of cable repairs and watertight penetrators to repair two Acoustic Doppler Speed Log (ADSL). The contractor will procure two Conductivity, Temperature, and Depth (CTD) Probes and integrate them with the government furnished equipment which consist of the non-magnetic rigging cage to produce a product that meets non-magnetic requirement of the Mine Hunter Coastal (MHC) ship This acquisition will be conducted using simplified acquisition procedures. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C.
2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).
This procurement is sole source for the following reasons. The Navy is providing repairs and maintenance for the BAMS for a Taiwan Navy MHC ship. The Foreign Military Sales (FMS) Case Number is TW-P-GPJ. Under FMS, the U.S. government uses DoD’s acquisition system to procure defense articles and services on behalf of its partners.
In general, FMS purchase agreements offer standardization with U.S. forces and may help lower unit costs by consolidating purchases for FMS customers with those of DoD. Major FMS programs also nurture long-term relationships with the U.S. military, including access to joint training and doctrine and increased opportunities for interoperability with U.S. forces. IPS’ personnel developed the procedures and techniques for repairing these subsystem on the American Avenger Class MCM ships, and will apply these techniques to the BAMS. IPS’ knowledge of the unique BAMS coupled with their experience in designing and fabricating the unique fixtures required to repair the BSP and acoustic doppler speed logs uniquely qualifies them to perform this SOW. No other contractor will be able to duplicate the knowledge and processes. As such, the Government does not expect significant savings through competition and does expects significant and unacceptable delays that will negatively impact this requirement. Therefore, it is imperative that this procurement is awarded on a sole source basis to IPS.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, IPS is the only source that can meet the Government’s needs. This requirement will be synopsized in the government point of entry SAM.gov.
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, IPS is the only source that can meet this requirement.
