MEMORANDUM
Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE SLQ-48 MNV VALVE
PACKAGES FROM ADAMS AIR & HYDRAULICS, INCORPORATED
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order to Adams Air & Hydraulics, Incorporated, 904 S 20th St Tampa, FL 33605 to design, fabricate, and test a SLQ-48 MVN Valve Packages in direct support of the Mine Neutralization System (MNS).
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The following item is being acquired:
Item Part Number Qty
MNV Valve Packages AAH-NAVYMOOGPACKAGE-1 2
AAH-NAVYMOOGPACKAGE-2 2
Tax, Shipping & Handling 1
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.
4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.
This procurement is sole source for the following reasons. Adams Air & Hydraulics, Incorporated (MOOG) has over six decades of experience manufacturing, selling, and repairing hydraulic valves. The scope of this contract is to buy two (2) sets of valve packages that meet the specifications of the obsolete valves. The dimensions of the valves are exact and have very specific interface requirements so that they can fit and operate properly in the limited space of the MNS system. As the original equipment manufacturer of the obsolete valves, Adams Air & Hydraulics is the only company that has the in-house resident knowledge and design requirements that can fabricate new valves that can replace the obsolete valves for the MNS.
The proposed time of completion by Adams Air & Hydraulics is 16 weeks, whereas a company without previous experience would have to incur in additional cost and time of design, prototype and test new valves that both comply with the required military standards as well as meet the stringent operating requirements of the MNS. The time of completion for a company that has no previous experience building, qualifying, and testing, according to military standards, would be between six months and one year and would cost the Government thousands of dollars in design and testing costs. Given the limited space to fit the valves, Adams Air has redesigned the size of the valves that replace the obsolete ones to fit in the package space at no additional cost to the Government.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
The Government does not own the technical data package for the valve packages that would allow competition on this procurement. As the original equipment manufacturer (OEM), ADAMS Air & Hydraulics, Incorporated (MOOG) is the only company with the in-house resident knowledge to accurately fabricate the parts. Additionally, this procurement action will be posted in the Government’s point of entry site SAM.gov.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Adams Air and Hydraulics Incorporated is the only company that can meet the Government’s requirements
