About this file

This document is a Sole Source Memorandum from the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) for acquiring tow cables. The procurement is for 2,600 ft of NAVSEA Cable (Part# SB-51582 RevA) from South Bay Wire and Cable Company, located in Idyllwild, CA, through a firm fixed-price purchase order. The acquisition is justified due to the obsolescence of existing sonar components, with South Bay Wire and Cable being the only vendor capable of meeting legacy cable specifications and providing Factory Acceptance Testing (FAT) within the first unit build.

The total acquisition will be conducted using simplified acquisition procedures, with a total dollar value above micro-purchase levels but not exceeding $250,000. The contract specifies equipment delivery within 30 weeks after purchase order award. The Contracting Officer has determined this represents the best value and lowest overall cost alternative. The requirement will be advertised on SAM.gov, and the procurement is being pursued under federal acquisition regulations that allow for sole source justification when only one responsible source can satisfy agency requirements.

MEMORANDUM

Subj: SOLE SOURCE MEMO TO ACQUIRE TOW CABLES FROM SOUTH BAY WIRE AND CABLE

COMPANY, LLC

1. Identification of the agency and the contracting activity, and specific identification

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order, on a sole source basis, to South Bay Wire and Cable Company, P.O. Box 67Idyllwild, CA 92549 for the acquisition of tow cables.

3. A description of the supplies or services required to meet (including the estimated value).

The following items are being acquired:

Part# Item Name Qty

SB-51582 RevA. NAVSEA Cable 2600 ft

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. All equipment will be delivered no later 30 weeks after award of the purchase order..

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C.

2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).

This procurement is the sole source for the following reasons. Since the sonar relies on older components, some of these are either near End of Life (EOL) or obsolete, e.g. Tow Cable. Due to the Tow Cable obsolesce, NSWC PCD personnel reach out to South Bay Wire and Cable and provided the old drawing to verify if they can meet legacy cable specs. SouthBay Cable meets legacy specs and provide the FAT test within the first unit build. For alternate companies to design and fabricate a suitable cable would take approximately the alternate company to conduct and complete FAT testing plus needing Government approval, for a total cost of $155k. It is not expected that either of these costs would be recouped through competition. Therefore, it is imperative that this procurement is awarded to South Bay Wire and Cable as soon as possible to maintain program capabilities and schedules.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

70,000K

For the reasons specified in paragraph 4 above, South Bay Wire and Cable Company is the only company that can meet the Government’s needs. Additionally, this requirement will be advertised in the Government’s Point of Entry website, SAM.gov.

6. Any other facts supporting the justification.

None.

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

For the reasons specified in paragraph 4 above, South Bay Wire and Cable Company is the only company that can meet the Government’s needs.
