About this file
This document is a Limited Source Justification (LSJ) Memorandum for Internet Services issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division. The document justifies a limited competition, firm fixed-price contract award to either AT&T Corporation or Comcast Government Services LLC for internet infrastructure services. The specific requirements include a 1 Gbps Ethernet Dedicated Internet connection with 12-month base and option periods, port installation, Ethernet equipment, and 30 usable static IPv4 addresses with fiber transport.
The justification is based on the limited availability of existing fiber infrastructure, which restricts potential service providers to AT&T and Comcast. The government determined that bringing in a new provider would require substantial investment in new fiber infrastructure, resulting in unacceptable delays. The acquisition will be conducted using simplified acquisition procedures, with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold. The contracting officer has determined that the order represents the best value and lowest overall cost alternative to meet the government's needs.

SUBJ: LIMITED SOURCE JUSTIFICATION MEMORANDUM FOR Internet Services
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a limited source justification. Contracting activity is:
Naval Sea Systems Command Naval Surface Warfare Center Panama City Division (NSWC PCD) 110 Vernon Avenue Panama City, FL 32407-7001
2. Nature and/or description of the action being approved.
This action will award a limited competition firm fixed price award to one of the following:
AT&T Corporation Comcast Government Services LLC 11951 Freedom Dr. Suite 900 Reston, VA 20190
3. A description of the supplies or services required to meet the agency’s needs.
This requirement is to purchase the following:
Description Qty.
Ethernet Dedicated Internet Basic Bandwidth - 1 Gbps
12 mos., Option 12 mos.
Port Installation 1 time Ethernet Equipment (Quantity 1) 12 mos., Option 12 mos.
Static IPv4, 30 Usable IPs, Transport type - Fiber 12 mos., Option 12 mos.
This acquisition will be conducted using simplified acquisition procedures. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.
This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c) (1) [10 U.S.C. 3204(a)(1)] - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.
The internet and cable services being acquired can only be provided from outside the base to the demarcation point by either AT&T (LEC) or Comcast (CEG) due to the limited number of existing fiber strands. Bringing in a new provider would necessitate substantial investment in new fiber infrastructure, including obtaining permits and deploying new fiber runs from outside the base to the required hub, resulting in unacceptable delay due to permitting and install times. At this time only AT&T (LEC) and Comcast (CEG) can deliver circuits to the demarcation point due to the limited number of existing commercial fiber strands. As demand for commercial internet increases, NSWC PCD will invest in additional fiber infrastructure to provide additional Internet Service Provider (ISP) access.
The Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to award on a limited source basis to Comcast Services or AT&T.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, the companies referenced in Section 2 are the only sources that can meet the Government’s needs. This requirement will be synopsized on the Contract Opportunities website at sam.gov.
7. Any other facts supporting the justification. None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, the companies referenced in Section 2 are the only approved sources that can meet this requirement.
