About this file

This sole source justification memorandum seeks approval to award a firm fixed price purchase order to Phillips Federal Corporation Inc. for maintenance services on an EOS M290 industrial 3D printer. The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division requires two maintenance visits per year for the printer, each lasting approximately three days. Maintenance will be provided for a base year and four option years, for a total potential period of performance of five years. Phillips Corporation Incorporated is identified as the sole provider of factory certified maintenance for EOS equipment under its GSA contract. As no other contractors can meet the agency's requirement, this proposed sole source award is deemed to present the best value to the government.

SERVICE FOR M290 MACHINE

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems

Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110

Vernon Avenue, Panama City, FL 32407-7001

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order to Phillips Federal Corporation

Inc., 7390 Coca Cola Drive, STE 200, Hanover, MD 21076-1937, for Base Year

Maintenance Contract and 4 Option Years Maintenance Contract for the EOS M290 industrial 3D printer.

3. A description of the supplies or services required to meet the agency’s needs

(including the estimated value).

The contract effort is to procure a Base Year Maintenance Contract and 4 Option Years

Maintenance Contract for an EOS M290 industrial 3D printer. There will be two maintenance visits each year, each maintenance effort lasting approximately 3 days.

Maintenance services will be provided within one year of contract award. There will be four 1-year options for a total period of performance if five (5) years.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00.

4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

Pursuant to FAR 8.405-6 (a) and (b) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. The services required fall under GSA contract number GS-03F-080CA. Phillips Corporation Incorporated is the sole provider for EOS equipment, consumables, and any factory certified service to the

United States Government facilities. Therefore, they are the only company that can provide the required maintenance services.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

This requirement is on a GSA contract and therefore does not require posting on the Federal

Business Opportunities (FEDBIZOPPS) website per FAR 5.2. No additional market research was conducted for the reasons discussed in paragraph 4 above.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, the Phillips Corporation Incorporated is the only source that can meet this requirement.
