Notes to Offerors

1. This solicitation is being issued in accordance with FAR Part 15 and is a Request for Proposal.

This solicitation is for a multiple-award five (5) year fixed price Indefinite Delivery Indefinite Quantity (IDIQ) contracts. Offeror’s price (1.1 Price Schedule) shall include all costs necessary to produce and deliver the supplies FOB destination to the address listed and packaged as specified in Attachment 1 Instructions to Contractors for Packaging 2018.

2. You may email your offer directly to Jeremy Pouliot before the time specified on the solicitation announcement. Send your offer to Jeremy.pouliot@usda.gov. It is the contractor’s responsibility to ensure offers are received on time. Please note that file size limitations, formatting, or other problems may hamper receipt so please verify that the contract specialist has received your offer.

If you are a large business with a proposal exceeding $700,000.00, submission of a Subcontracting Plan in accordance with the above clauses will be required with your proposal. The Contracting Officer will review the plan using the following goals to assure that it represents your best efforts to maximize subcontracting opportunities. Award will not be made until the Contracting Officer approves the Subcontracting Plan. The offeror’s subcontracting plan shall meet or exceed the goals expressed below, in terms of percentages of total planned subcontracting dollars. The accepted plan shall be included in and made part of the resultant contract. The minimum required goals expressed in percent of total planned subcontracting dollars are:

1. General Information U.S. Department of Agriculture’s (USDA), Animal Plant Health Inspection Service’s (APHIS), Veterinary services (VS) intends to award one or more fixed- priced Indefinite-Delivery Indefinite-Quantity (IDIQ) type contracts to procure USDA Approved AIN Compliant RFID Button Ear tags for USDA’s Traceability Program.

Cost per tag shall include all costs necessary to supply and deliver the tags FOB Destination to Kansas (including but not limited to, tag cost, and per order costs for set-up and data entry). If different color tags have different pricing, please break that down in the response.

The quantities in the schedule are estimates only and are not guaranteed. The current minimum order required by this contract is $25,000. There is no obligation or guarantee that additional tags will be ordered.

1.2 Type of Contract

This contract is an IDIQ contract. Supplies with be ordered through the issuance of individual Delivery Orders (orders) as the requirements of the USDA dictate. Each order will include the specific requirements for quantities, colors, and delivery. Order pricing will be in accordance with the fixed rates established in the pricing schedule unless a lower price is provided in a fair opportunity competitive quote. Delivery Orders shall be issued by a warranted USDA Contracting Officer via email.

Contract and delivery order minimums and maximums are addressed in the following clauses: See 52.216-19, “Order Limitations” and 452.216-73 “Minimum and Maximum Contract Amounts”. The line

12639520R0027 RFID Cattle Ear Tags 7 of 52 item quantities listed in the Pricing Schedule are estimates for evaluation purposes only and are not intended to convey either a minimum or maximum quantity that will be ordered by the Government.

The period of performance for this contract is five (5) years from date of award. See clauses 52.216-18, Ordering and 52.216-22, Indefinite Quantity.

1.3 Scope of work

The USDA Animal and Plant Health Inspection Service (APHIS) Veterinary Services (VS), is contracting for the supply of AIN Compliant RFID cattle ear tags and ear tag applicators. These cattle tags are commercially available off the shelf items and come in many colors.

The Contractor shall provide USDA approved, Animal Identification Number (AIN) compliant, Half Duplex (HDX) Low Frequency (LF) RFID button ear tags, and their associated applicators to the USDA, APHIS, VS.

The RFID button ear tags will be provided to USDA in support of the Animal Disease Traceability (ADT) Program.

USDA will order currently approved tags from vendors at the time of the order per the terms of AIN Tag manufacturer’s Agreement.

Overall estimated need is five (5) to eight (8) million tags per year. This amount is the current estimated need for all contracts combined and is not a guaranteed amount.

1.4 Background

USDA/APHIS has announced a transition period for the US cattle and bison industry to fully adopt EID as the sole form of official animal ID by January 1, 2023. In an effort to assist the cattle and bison industries with this transition, USDA/APHIS is working with state agencies and stakeholders to replace the metal tags that were previously supplied by USDA with AIN compliant RFID ear tags (also known as 840 EID tags).

The USDA, APHIS, VS, intends to acquire plastic HDX LF RFID button ear tags for cattle and bison and the associated ear tag applicators for use with the ADT program. Eligible vendors are limited to manufacturers that are USDA approved AIN tag manufacturers prior to Award. Eligible devices are limited to HDX LF AIN button tags certified by ICAR for conformance with ISO-11784 and 11785 that received USDA approval prior to Award and have current approval status. Manufacturer must be able to provide white and orange tags but other colors of tags may be ordered at the discretion of USDA.

1.5 Period of Performance

Award (estimated May 11th, 2020) through five years (estimated May 10th, 2025) consisting of 5 ordering periods.

2. Contract Requirements

The Contractor shall supply proof of their status as an USDA AIN device Manufacturer. This includes a written certification that the device being offered is a currently approved AIN device and further that the device meets the same standards and specifications of its initial approval and current device standards as indicated in Tables 1-3 below. The certification must also include the AIN product number, species certification, and the Manufacturers Product name/Number; (example… AIN 0002, 4 Star button tag, approved for use with Cattle, Bison, Deer & Elk).

2.1 Contractor’s Tag Performance Requirements

Performance Requirements

One-time use – Tamper evident

The tag must be designed for one-time use (tamper evident), making it impossible to remove and reapply the tag without visual evidence of tampering.

Unalterable The printing on the tag may not be readily altered.

Readability The AIN must be easily and reliably readable with 20/20 vision. The printing and color contrast of official ear tag shield, lettering, and numbers are to be easily and reliably readable at a distance of 30 inches (0.75 m).

The percent of data matrix read on new tags being shipped from the manufacturing plant must be at 100% when read with a camera based image reader (barcode reader).

Tag loss rates On average, when applied in a manner approved by the manufacturer, not more than 1 percent of tags applied may be lost in the year following application or in any year thereafter under normal field conditions over the expected life of the tag.

Expected tag life The minimum time that a tag shall be expected to remain on an animal in a functional state (physically) is for the expected life of the animal.

Tag toxicity and animal injury

Tags may do no harm to an animal or affect its health or well-being.

Tags may not cause chemical contamination of meat or edible offal or damage the hide.

Tag deterioration There may be no diffusion of colorant from tags.

There may be no apparent physical deterioration (other than color) due to detrimental effects by UV light, rain, heat (45°C) and cold (-30°C) or other environmental influences such as chemicals, mud, urine, or manure for at least 5 years of wear.

Tag plasticity Devices may not split or crack under normal use.

Tag coupling/tensile strength

Tag coupling/tensile strength: Evaluation standards must conform to ICAR testing standards and, at minimum, should comply with ISO standards 37 and 527.

Tag abrasion resistance

Tag abrasion resistance: Tags shall not exhibit damage or change due to wear, may be subjected to ICAR testing standards and, at minimum, should comply with ISO standard 9352.

1.5.3 Tag Printing Standards

Printing Description

• The tag must have the official ear tag shield imprinted on its surface1 imprinted at a minimum height of 5 mm (0.2 inches).

• The tag must bear the entire official animal number and imprinted at a minimum height of 5 mm (0.2 inches). For AIN tags a space must be inserted between each 3rd digit of the AIN imprinted on the AIN tag, e.g., 840 003 123 456 789.

• The font for all characters for required information imprinted on the tag must be Arial or, if different, approved by APHIS.

• The text “UNLAWFUL TO REMOVE” must be imprinted on the tag2 and must be a minimum height of 3 mm (0.12 inches).2

• All NUES and AIN characters that are part of the official number format must be 5mm (3/16 of an inch) high and easily readable with 20/20 vision at a distance of 30 inches (0.75 m).

Note: Exception may be made for small size tags, in particular RF tags, that do not allow the printing of the official identification number at 5mm but are clearly read at the required distance

• An indentation of the manufacturer’s unique, copyrighted logo or trademark must be easily observed on the tag. Having such information permanently imprinted on the tag is also acceptable.

• Printing of other information may be authorized if it does not compromise the readability of the required information.

• Visual only tags must be imprinted with a 2D Data Matrix that conforms with the ECC200 Data Matrix protocol. The data matrix is to be printed on the device in a square approximately 5mm x 5mm and should be a two dimensional representation of the official animal number printed on the tag. The data matrix must be imprinted on any part of the tag containing official animal identification number. Readability (percent of data matrix read) on new tags being shipped from the manufacturing plant must be at 100% when read with a camera based image reader (barcode reader).

• AIN tags that contain RF technology must have the 2D Data Matrix described above imprinted on the tag piece that contains the official animal number unless waived by USDA.

1 The above printing standards are for visual identification, and the visual ear tag is the animal's official identifier. Radio frequency identification technology (RFID) may be incorporated in the visual tag when the above printing criteria is met. Such technology is considered supplemental identification. Tags with RFID technology must have all 15 digits of the AIN printed on the portion of the tag that contains the transponder which is coded with the identical 15 digit AIN. Imprinting the AIN on the portion of the tag that does not contain the transponder is optional, but when this is the case, the tag set is packaged in containers or trays so that the two pieces are maintained as a pair until they are applied.

2 In order for producers, market operators, and animal health officials, etc., to recognize ear tags as "Official", it is essential that the official ear tag shield be visible on the animal after it is tagged.

Similarly, in order to emphasize the need to maintain this identification for the life of the animal, it is necessary to have the text, "UNLAWFUL TO REMOVE" clearly visible. Therefore, the official ear tag shield must be printed on both parts of a two part tag, and the text, "UNLAWFUL TO REMOVE" must be printed on the portion of the ear tag that is most visible following application.

For small button tags, the "UNLAWFUL TO REMOVE" text must be printed on the back piece of the tag (outside of ear). For panel tags, the text must be printed on the back piece (outside of ear), but may also be printed on the front piece (inside of ear).

2.2 Radio Frequency Technology Specifications

The radio frequency technology must meet the criteria defined in Table 3 below.

ISO Compliant All transponders must be certified by ICAR for conformance with ISO-11784 and 11785.

Electronic Read Rates and Ranges

In a laboratory with a neutral electromagnetic environment:

Transponders must have a 100 percent read rate in best orientation at 24 inches (60 cm) in a stationary test and a moving test of 1 m/sec over a passage length of at least 20 inches (50 cm). Note: This test information is optional.

In a field test environment: Transponders must be reliably machine read at a rate of 95 percent without regard to orientation by a standardized dual HDX/FDX reader, as cattle move by in a single file passage at 4 mph (1m/sec).

Expected tag life The minimum time that a tag shall be expected to remain functional (electronically) is for the expected life of the animal.

Transponder security The official number encoded within each transponder must not be able to be altered and must be contained within the tag.

Tags will be tamper-evident and impossible to unseal without visible evidence of tampering.

Transponder failure rates The transponder within the tag shall be reliable and machine-readable for the expected lifetime of the animal.

2.3 Quality Control

Contractors shall have a quality control plan and must explain the contractor’s quality control system and clearly demonstrate the manufacturer’s ability to consistently adhere to contract specifications and contract delivery requirements.

After a contract is awarded, each shipment/lot must include Quality Assurance records that shows the number, type and dates of quality assurance checks performed, and also if applicators have been reworked or previously rejected. Failure to provide these QA records may be grounds for rejection of the entire lot shipped.

2.4 Printing

Tags must meet current AIN compliant device standards in Section 1.5.4 above as of April 27, 2020, and the following additional requirements:

At a minimum, contractors must have the ability to print tags in the colors of white, and orange. Orange tags are intended for use for Official Calfhood Vaccination (OCV) and should have the letters “OCV”

12639520R0027 RFID Cattle Ear Tags 12 of 52 printed on the back piece of the two-piece tag. Additional colors may be requested by USDA as need arises and orders will be competed based on contractors that are able to supply the required colored tags.

Contractor shall provide written certification that the device being offered is a currently approved AIN device and further that the device meets the same standards and specifications of its initial approval and current device standards. The certification must also include the AIN product number, species certification, and the Manufacturers Product name/Number; (example… AIN 0002, 4 Star button tag, approved for use with Cattle, Bison, Deer & Elk)

2.5 Packaging

Male and female tag pairs must be packaged in holding trays. The trays will then be placed in a bag containing 100 tags per bag. Contractor will affix the 13 digit National Stock Number (NSN) Z888-00- HDX-RFID to each outer bag.

In addition, each bag containing 100 RFID females and 100 males will have a 7 digit number (3 alpha and 4 numeric) affixed to the bag.

The sequence range of bags will be AAD 0001 to ZZZ 9999. The female RFID tags contained in the bags must have the Animal Identification Numbers in a sequential range and placed in a holding tray.(i.e.

8400000000000001 to 8400000000000020 in bag AAC0001)

Additional general packing and shipping instructions related to this request for proposals (RFP) can be found in the included document entitled “Instructions to Contractors for packaging and Marking of Supplies/Tags for Shipment to the National Logistics Support Center, Kansas City, Missouri.” These instructions are to be considered requirements for this RFP.

2.6 Additional Administration Requirements

All tag distribution records must be reported to the Animal Identification Number Management System

(AIMS).

2.7 Delivery

Tags and applicators will be shipped from the manufacturer directly to USDA warehouse in Kansas City, MO. This should be done via the most cost effective and efficient means that will insure intact and on time delivery. Please see Attachment 1, “Instructions to Contractors for Packaging 2018”.

3.0 Contract Administration

3.1 Delivery Orders

Delivery orders will be issued against this contract on a firm fixed price bases at the quoted price.

Orders may be placed by a warranted USDA contracting officer through email.

3.2 Fair Opportunity Process for Placing Orders

Delivery orders will be competitively awarded based on price and favorable past performance. The Government reserves the right to award an order non-competitively based on proper justification identifying field performance/preference and cost considerations. USDA may set orders aside for small business in accordance with FAR 52.219-13 and in the best interest of USDA.

The following procedures will be followed in issuing orders under multiple award contracts. Awardees will be provided a fair opportunity to be considered for each task order exceeding the micro-purchase threshold of $10,000 unless a statutory exception applies, as described in this section and FAR 16.505, Ordering (listed in paragraph c below).

The value of an order is considered the total anticipated value based on all known pricing listed in the price schedule. Individual orders shall clearly describe all supplies (tags/applicators) to be delivered.

Orders shall be within the scope, issued within the period of performance, and be within the maximum value of the contract.

a. Orders valued between $10,000 and $250,000

For task orders valued within this range, the contracting officer is not required to contact each of the multiple awardees before selecting an order awardee if the contracting officer has information available to ensure that each awardee is provided a fair opportunity to be considered for each order (FAR 16.505 (b)).

The contracting officer will consider the following information:

(1) Firm fixed prices established in the Pricing Schedule

(2) Past performance on earlier orders under the contract, including quality and timeliness;

(3) Potential impact on other orders placed with the contractor (max delivery capability);

(4) Other considerations as appropriate (i.e. minimum order requirements, proposed discounts to fixed unit prices established in the Pricing Schedule).

b. Orders valued in excess of $250,000

Each order exceeding $250,000 shall be placed on a competitive basis unless an exception applies. The contracting officer will provide a fair notice of the intent to make a purchase, including a clear description of the tags/applicators required and delivery timeframe and the basis upon which the selection will be made to all IDIQ awardees.

All IDIQ awardees will be afforded a fair opportunity to submit an offer and have that offer fairly considered.

The contracting officer will consider the following information:

(1) Firm fixed prices established in the Pricing Schedule, including proposed discounts to fixed unit prices.

(2) Past performance on earlier orders under the contract, including quality and timeliness

(3) Potential impact on other orders placed with the contractor (max delivery capability)

(4) Other considerations as appropriate (i.e. minimum order requirements)

Regulations do not require formal evaluation plans or scoring of quotes or offers (FAR 16.505).

c. Exceptions to the fair opportunity process include the following (FAR 16.505(b)(2)(i):

(i) The contracting officer shall give every awardee a fair opportunity to be considered for a delivery-order or task-order exceeding $10,000 unless one of the following statutory exceptions applies:

(A) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

(B) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

(C) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

(D) It is necessary to place an order to satisfy a minimum guarantee.

(E) For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

(F) In accordance with section 1331 of Public Law 111-240 (15 U.S.C. 644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3). When setting aside orders for small business concerns, the specific small business program eligibility requirements identified in part 19 apply.

d. All Delivery Orders will be issued via email by a warranted Contracting Officer or a USDA P-Card holder.

3.3 Placement of Orders

The contractor shall provide the products under this contract only as directed in the delivery orders. In accordance with FAR 16.505, each order will include:

1) Date of order

2) Contract number and order number

3) Item number and description, quantity, and unit price

4) Delivery date/schedule

5) Place of delivery (see Attachment 1)

6) Packaging, packing, and shipping instructions (see Attachment 1)

7) Accounting and appropriation data

8) Method of payment and payment office, if not specified in the contract

9) Any other pertinent information

3.4 Ordering Authority

Orders under the micro-purchase threshold may be placed by a USDA warranted P-Card holder up to their limit. Orders placed by a P-Card holder must be paid with their P-Card and notice of the award must be provided to the Contracting Specialist.

USDA APHIS Contracting Officers may place orders up to their warrant and within the limits of the contract Min/Max as established in the contract clauses. Orders placed by Contracting Officer shall follow the fair opportunity ordering process detailed in section 3.2 above.

3.5 Invoicing

USDA uses the Invoice Processing Platform (IPP) for electronic submission and tracking of purchase orders, invoices, and payment information to its suppliers of goods and services: Enroll at https://ipp.gov. The IPP is a government-wide secure web-based invoice processing service offered free of charge to government agencies and their suppliers by the U.S. Department of Treasury’s Financial Management Service (FMS).

Contractors must submit invoices and attach all supporting documentation as required. Supporting documentation includes, number and color of tags delivered, Delivery Oder number, sequence number range, and company information. The IPP Approver will review the supporting documents before approving invoices in IPP, if supporting documentation is not provided the invoice will be rejected. IPP will issue a notification to contractor that they must submit supporting documentation and resubmit the invoice. See FAR 52.232-33.

Invoicing for orders placed by P-Card holder, please see FAR 52.232-36. The same supporting documentation and invoice stated above will be required by the P-Card Holder.

The COR shall inform the contracting Officer as soon as possible of any understandings, tentative agreements, recommended modifications, and actions or inactions of the Contractor or the Government which could impact the Contractor’s ability to comply with the contract performance requirements or completion times.

Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor shall so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer shall be notified immediately.
