Notes for RFQ

1. This solicitation is being issued in accordance with FAR Part 13, Simplified Acquisition Procedures and is a Request for Quote. This solicitation is for commercially available of the shelf (COTS) Binary Explosives and thus fall under FAR Part 12, Acquisition of Commercial Items.

This solicitation is for multiple award (5) year Blanket Purchase Agreement (BPA) awards.

2. Quoter’s price (1.1 Price Schedule) shall include all costs necessary to produce and deliver the supplies FOB destination to the address listed. Price and delivery schedule must be valid for 60 days. Price will be used to determine award and fair and reasonable pricing.

a. Quoters must price all of the components necessary to use the quoted binary explosive to receive a BPA. Awards will be made to ensure competition requirements can be met in future Call Orders if and where possible.

3. Email your response/quote directly to Jeremy Pouliot at Jeremy.pouliot@usda.gov before the time specified on the solicitation announcement. It is the contractor’s responsibility to ensure quotes are received on time. Please note that file size limitations, formatting, or other problems may hamper receipt so please verify that the contract specialist has received your quote.

a. The following items must be submitted with a valid response/quote

i. Company DUNS number and confirmation of current SAM registration

ii. Completed Price Schedule (section 1.1)

iii. Written Certification about the binary explosive being quoted. Certification shall include:

1. Complete product specifications applicable to type/component of the explosive (size of components available, make-up/chemicals used, ect.)

2. Detonation velocity, and

3. Detonation pressure or energy

iv. Completed fill-in sections of all applicable Provisions under section: 5.0 Contract Provisions. Many of the provisions have sections to be completed if applicable and checkboxes that require a selection of one or another checkbox. Please ensure to read all provisions carefully and fill in all applicable sections

4. Awards will be made to the Vendors that represent the best value to the government, and to the quantity of venders needed to maintain competition in future orders.

5. Entering into a BPA with USDA for binary explosives does not guarantee a current or future order. A BPA is required for initial competition in future orders.

6. Any questions pertaining to this Request for Quote (RFQ) shall be directed to Jeremy Pouliot, by email to Jeremy.pouliot@usda.gov no later than five (5) business days before offers are due.

7. Contractors must be registered in SAM prior to submitting an offer. Please ensure that your registration is current.

9. This solicitation is being issued as a small business set aside under NAICS 325920, with a small business size standard of 750 employees.

Addendum

1. General Information U.S. Department of Agriculture’s (USDA), Animal Plant Health Inspection Service’s (APHIS) intends to award one or more Blanket Purchase Agreements (BPAs) to procure Binary Explosive in accordance with certain size and performance specs as detailed below and delivered to various USDA State and local offices.

Cost per unit shall include all costs necessary to supply and deliver the items FOB Destination to North Carolina. If different labeling of the description is required, please create your own price schedule similar to the above and price equivalent.

The quantities in the schedule are annual estimates only and are not guaranteed. There is no minimum order. There is no obligation or guarantee that explosives will be ordered, only that if explosives are ordered, quotes will be sought in accordance with Section 3.2.

1.2 Type of Contract

This is a Blanket Purchase Agreement (BPA) with a limit of $250,000.00 throughout the life of the BPA.

Supplies will be ordered through the issuance of individual Call Orders (orders) as the requirements of the USDA dictate. Each order will include the items, quantities, and delivery location required. Any explosive not currently listed in the BPA will include a list of performance and characteristic specs.

Order pricing will be provided in a fair opportunity competitive quote for all orders above the Micro- Purchase Threshold. Call Orders shall be issued by a warranted USDA Contracting Officer or a USDA P- Card holder via email.

The line item quantities listed in the Pricing Schedule are estimates for evaluation purposes only and are not intended to convey either a minimum or maximum quantity that will be ordered by the Government.

1.3 Scope of work

The USDA Animal and Plant Health Inspection Service (APHIS), is contracting for the supply of binary explosives requirements. Binary explosives are used by a number of USDA programs for the destruction of beaver dams.

The Contractor shall provide USDA the required explosive components that meets the performance and saline characteristic specifications on each order. USDA reserves the right to place small orders of explosives for testing prior to the main order being placed. This is to ensure conformance with the specs and ensure the safety of both life and property.

USDA will order currently approved binary explosives from BPA holders. Any new explosive requirement, not currently listed in the BPA, will be first competed amongst all BPA holders. If no commercially available of the shelf explosives can be supplied by the BPA holders a new solicitation will be posted to the open market for competition outside the BPA holders. BPA holders are not restricted from competing on any USDA solicitation for explosives outside or in addition to their BPA.

Overall estimated need is $50,000 of binary explosives over the course of 5 years. This amount is the current estimated need for all explosives for all USDA locations and is not a guaranteed amount.

1.4 Background

The USDA, APHIS, requires binary explosives which is used in various applications such as, but not limited to:

1.4.1 1/2lb binary mix are used in smaller culverts. Must work to remove the beaver dam without causing damage to the culvert. Shall be shaped for easy stacking with other explosives of the same make for increased explosive force. Must work with delayed blasts in concrete culverts.

1.4.2 1lb binary mix are used in larger culverts and open areas. Must work to remove the beaver dam without causing damage to the culvert and surrounding area. Shall be shaped for easy stacking with other explosives of the same make for increased explosive force.

2. Minimum Specifications and Performance Requirements

The Vendor shall supply complete specifications on the quoted binary explosives Vendor shall state whether specifications were derived from independent testing or in house testing.

2.1 Binary Explosive Performance and Characteristic Specification Requirements

Binary explosives are prepackaged products consisting of two separate components: oxidizer and fuel. When the components are combined, the resulting mixture is an explosive material subject to regulatory requirements found in 27 CFR, Part 555. The components are not explosive before mixing, do not have to be transported as explosives, and do not have to be stored as explosives.

Two components to be combined to form a cap sensitive explosive. The liquid component is mixed with the solid component. In five to fifteen minutes, the liquid will soak down to the bottom. It will be highly explosive. It shall be able to be initiated with a number 8 detonator or 10 gram per meter detonating cord. When mixed, has a density of 1.2 grams/cubic centimeter, velocity of detonation of 6300 meters/second (27,000 feet per second), and a detonation pressure of 121 kiloBars.

Preference may be given for Binary components that do not consist of toxic components such as silver magnesium/silver phosphorus due to safety concerns. Preference will be notated at time of order.

Preference may be given for binary explosives that do not require USDA employees to wear personal protective equipment (PPE) to handle during or after mixing.

Binary components shall have a long shelf life when stored in their pre-mixed, inert state at the proper storage conditions. Instructions for proper storage shall be included on the containers or with the shipments.

2.2 Delivery

Binary explosive components will be shipped from the manufacturer directly to USDA locations listed in the Call Order. At time of award, the location known for delivery is listed below for pricing and evaluation purposes. Other locations may be added in future Orders.

3.0 Contract Administration

3.1 Call Orders

Orders will be issued against BPAs on a firm fixed price bases at the quoted price.

Orders may be placed by a warranted USDA contracting officer or by a USDA P-Card holder up to their limit through email.

3.2 Competitive Process for Placing Orders

Orders will be competitively awarded based on price and favorable past performance. The Government reserves the right to award an order non-competitively based on proper justification identifying past performance, preference, and price considerations.

The following procedures will be followed in issuing orders under multiple award BPAs.

3.2.1 Awardees will be provided a fair opportunity to be considered for each Order exceeding the micro-purchase threshold of $10,000.

The value of an order is considered the total price for all required binary explosive components in a single order to a single location. Individual orders shall clearly describe all supplies to be delivered and the delivery location. Orders shall be within the scope, issued within the period of performance, and be within the maximum value of the BPA.

3.2.2 Orders valued between $10,000 and $250,000

For Orders valued within this range, the contracting officer will contact each of the BPA awardees and request a quote (RFQ) for the required binary explosives before selecting an awardee.

The contracting officer will consider the following information:

(1) Firm fixed prices provided in the awardee’s response to the RFQ

(2) Past performance on earlier orders under the BPA, including quality and timeliness;

(3) Delivery capability of the required binary explosives;

(4) Other considerations as appropriate.

3.3 Placement of Orders

All Orders will be issued via email by a warranted Contracting Officer or a USDA P-Card holder.

The vendor shall provide the products under this BPA only as directed in the Orders.

3.4 Ordering Authority

Orders under the micro-purchase threshold may be placed by a USDA warranted P-Card holder up to their limit. Orders placed by a P-Card holder must be paid with their P-Card and notice of the award must be provided to the Contracting Specialist.

USDA APHIS Contracting Officers may place orders up to their warrant and within the limits of the contract Min/Max as established in the contract clauses. Orders placed by Contracting Officer shall follow the fair opportunity ordering process detailed in section 3.2 above.

USDA uses the Invoice Processing Platform (IPP) for electronic submission and tracking of purchase orders, invoices, and payment information to its suppliers of goods and services: Enroll at https://ipp.gov. The IPP is a government-wide secure web-based invoice processing service offered free of charge to government agencies and their suppliers by the U.S. Department of Treasury’s Financial Management Service (FMS).

Contractors must submit invoices and attach all supporting documentation as required. Supporting documentation includes, number and type of binary explosive delivered, Oder number, and company information. The IPP Approver will review the supporting documents before approving invoices in IPP, if supporting documentation is not provided the invoice will be rejected. IPP will issue a notification to contractor that they must submit supporting documentation and resubmit the invoice. See FAR 52.232- 33.

Invoicing for orders placed by P-Card holder, please see FAR 52.232-36. The same supporting documentation and invoice stated above will be required by the P-Card Holder.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
