PO BOX 5000

CORONA, CA 92878-5000

IN REPLY REFER TO

J&A No. 50,159 Ser 02/2921

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 02.

2. Description of the Action Being Approved

Award of a Firm-Fixed-Price, Indefinite Delivery Indefinite Quantity contract on a sole source basis to TestVonics, Inc.

(TestVonics) for the purchase of TestVonics Air Data Calibrator (ADC) part number (P/N) ADC-2580SYS. Authority to act under this J&A shall be effective from the date of approval to the end of the contract term.

3. Description of Supplies/Services

The Naval Air Systems Command (NAVAIR) Metrology and Calibration (METCAL) Program has a requirement for up to a maximum of 135 ADCs, P/N ADC-2580SYS and associated training to support Naval Aviation Fleet Intermediate Calibration Activities, Fleet Training Activities, and Navy Calibration Laboratories (lab).

The TestVonics ADCs will be procured over a five-year ordering period.

The total estimated value of this acquisition is and will be funded with Aircraft Procurement, Navy (APN) funds. The table below depicts the type of funding as well as the estimated amount per fiscal year.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

Ser 02/2921

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements as implemented by Federal Acquisition Regulation (FAR) 6.302- 1(a)(2).

5. Rationale Justifying Use of Cited Statutory Authority

NAVAIR METCAL currently has TestVonics P/N 2550 and King Nutronics (King) P/N 3689A ADCs deployed in over ten (10) METCAL Labs performing air data calibrations. These ADCs work in an existing infrastructure that supports over 850 annual calibration workload hours. The ADCs in the current NAVAIR METCAL infrastructure are operated manually, whereas the TestVonics P/N ADC-2580SYS is the only fully automated ADC system currently in the commercial marketplace with the capability of calibrating test instruments in the existing infrastructure of NAVAIR METCAL inventory.

NAVIAR METCAL requires automated calibration for test instruments to reduce labor hours and delays in processing support equipment from the fleet. The TestVonics P/N ADC-2580SYS is equipped with auto verify and auto calibration to increase the efficiency and time it takes to calibrate test instruments in the NAVAIR METCAL inventory. Some of these test instruments include air data test sets (ADTS) and manometers.

Currently, the TestVonics P/N 2550 and King P/N 3689A ADCs are manually calibrated over a period of up to 10 hours per unit.

As required by NAVAIR METCAL, the fully automated TestVonics P/N ADC-2580SYS have the ability to perform calibration within a period of one (1) hour. This is a total reduction of up to nine

(9) hours or 90% per unit calibrated in the NAVAIR METCAL inventory. Since NAVAIR METCAL calibrates approximately 85 unit per year, this would result in an annual reduction of 765 labor hours.

The TestVonics P/N ADC-2580SYS is the only system in the commercial marketplace with the ability to calibrate actual pressure and static pressure sensors with the accuracy of 0.008%. This accuracy rating is required when performing low air speed calibrations in the NAVAIR METCAL’s Laboratories.

Ser 02/2921

The transducers utilized in the TestVonics ADCs are not density sensitive, so they can be used with either air or Nitrogen.

This requirement provides flexibility for NAVAIR METCAL’s Laboratories to use air to perform calibration when Nitrogen is not readily available; thus, preventing delays in the calibration process when there is no immediate availability of Nitrogen. Additionally, the TestVonics P/N ADC-2580SYS has control features providing required accuracy for low airspeed between 15-30 knots. This low airspeed control is required to support test requirements for Navy operations and is unavailable from any other unit in the commercial marketplace.

Additionally, NAVAIR METCAL currently has 46 ICPs written for the TestVonics P/N 2550 ADCs. Since NAVAIR METCAL is procuring the automated version of this ADC, current ICPs will be revised rather than re-written. The estimated cost to revise the current ICPs is ( per ICP X 46 ICPs). The estimated cost to re-write ICPs for a unit other than the TestVonics P/N ADC-2580SYS would cost up to ( per ICP X 46 ICPs). The difference between revising the current ICPs and having to re-write the ICPs if an alternative ADC other than the TestVonics P/N ADC-2580SYS was procured is ( cost to re-write the ICPs - cost to revise the ICPs).

In addition to the cost to re-write the ICPs, a loss of time in fielding would occur if an ADC other than the TestVonics P/N ADC-2580SYS were procured. Since the TestVonics ADC is the only tested and verified ADC, procuring an alternative automated ADC would require testing and validation. Since the Government currently uses the King P/N 3689A ADCs, an email was sent to King on 14 April 2020 to verify if King could produce an automated ADC with the ability to calibrate ADTS and manometers in the current NAVAIR METCAL inventory and capable of working in the existing NAVAIR METCAL infrastructure. King responded on 6 May 2020 stating that they do not currently manufacture an automated ADC with the ability to calibrate ADTS and manometers in the current NAVAIR METCAL inventory. King further stated that they could build an automated ADC with the ability to calibrate ADTS and manometers in the NAVAIR METCAL inventory, but the ability to develop this capability would take nine (9) to twelve (12) months. In addition, procuring the King

Ser 02/2921 automated ADC would require testing and validation for up to twelve (12) months.

If the King ADC was procured, the Government could expect a 24-month delay (12 months for King to manufacture + 12 months of testing and validation). The delay to procure an automated ADC would cause unacceptable fleet impacts. Fleet impacts from the delay include a loss of air speed and cabin leakage calibration capability at several fleet calibration labs causing the removal of flight line support equipment required for the daily servicing of aircraft. These delays and their related impact are unacceptable and do not meet the NAVAIR METCAL requirements for this procurement.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research was conducted to determine if an ADC capable of meeting the Government’s requirement was available in the commercial marketplace. Market research using web-based searches including GSA Advantage, Google, Bing, and NAVICPmart did not reveal any sources for the requested equipment other than TestVonics, the original equipment manufacturer. The market research that was conducted revealed that TestVonics produced the only ADC capable of meeting the Government’s minimum requirements.

A Sources Sought Notice (SSN) was posted on the Beta.Sam website, indicating the Government’s intent to sole source this requirement to TestVonics. The posting was issued on 20 December 2019 and closed on 20 January 2020. At the close of the SSN, two responses were received from TestVonics and Druck, LLC (Druck). A capabilities analysis was performed by the certifying technical and requirements personnel, which concluded that TestVonics was able to meet the Government’s minimum requirements and Druck did not.

The ADC system contained in the response submitted by Druck did not perform to the temperature range of 15° to 35° degrees celsius. Additionally, Druck’s response did not provide the Government with any information on the capabilities of the trench etched resonant pressure sensors and required pressure mediums.

Ser 02/2921

Additional market research was conducted to verify if TestVonics has authorized distributors or resellers with the ability to provide the TestVonics P/N ADC-2580SYS. An email was sent to TestVonics on 28 January 2020 requesting information on any authorized distributors or resellers with the ability to produce the TestVonics P/N ADC-2580SYS. An email response was received on 30 January 2020 verifying that TestVonics works directly with the Department of Defense and does not have authorized distributors or resellers with the ability to provide the TestVonics ADC-2580SYS.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the items covered by this J&A will be fair and reasonable. The Contracting Officer will use price analysis, including commercial price lists and historical information to determine that the final price to the Government is fair and reasonable.

8. Actions to Remove Barriers to Future Competition

For the reasons set forth in Paragraph 5, Corona Division has no plans at this time to compete future requirements for the types of supplies covered by this document. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
