About this file

This is a Sole Source Justification (SSJ No. 26-05JA) for a HUBZone direct award under simplified procedures for a commercial item procurement. The Naval Sea Systems Command, through its Northwest Regional Maintenance Center/Puget Sound Naval Shipyard and Intermediate Maintenance Facility in Bremerton, Washington, proposes to award a sole source contract to Motive Power Marine (401 E Alexander Ave, Ste 407, Tacoma, WA 98421-4225), a HUBZone-certified small business. The procurement is for emergent repair of the Beluga barge at the contractor's facility, classified under NAICS code 336611 (Ship Building and Repairing) and PSC code J019 (Maintenance/Repair/Rebuild of Equipment: Ships, Small Craft, Pontoons, and Floating Docks). The work includes coordinating vessel delivery, washing and cleaning, performing steel repairs, generating ABS-approved "Red Line" drawings, coordinating ABS inspections, and arranging vessel return. The period of performance is 50 days from award, with funding from Fiscal Year 2026 Operation and Maintenance (OMN) appropriations. The Independent Government Estimate (IGE) is redacted in the document.

The justification demonstrates that only one HUBZone small business in the Puget Sound region possesses the facility capability to dock a vessel of the Beluga barge's dimensions (240 feet long, 61 feet 8 inches wide, 14+ feet freeboard, 3.5 feet draft). Market research identified only two vendors regionally capable of docking this vessel; of these, Motive Power Marine is the sole HUBZone small business with the required technical capability and facility specifications. The contracting officer determined the anticipated cost to be fair and reasonable based on historical pricing and the government's independent estimate. A notice of the Government's intent to sole source will be posted to SAM.gov for five days. The statutory authority for this sole source award is 15 U.S.C. 657(a) (HUBZone Act of 1997) as implemented by FAR 6.302-5(b)(5), modified to reflect the use of simplified procedures under FAR subpart 13.5 in accordance with 41 U.S.C. 1901. Motive Power Marine's prior completion of work on the Beluga barge and knowledge of the vessel, combined with urgent operational need and the vessel's ABS certification expiration on January 15, 2026, support the sole source determination.

CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FEDERAL

On the basis of the following justification, I hereby approve the use of a sole source HUBZone direct award pursuant to the authority of 41 U.S.C. 1901.

1. Agency and Contracting Activity

Naval Sea Systems Command contracting activity Northwest Regional Maintenance Center/Puget Sound Naval Shipyard and Intermediate Maintenance Facility, Bremerton, WA proposes to HUBZone direct award to Motive Power Marine, 401 E Alexander Ave, Ste 407, Tacoma, WA 98421-4225 using simplified procedures for certain commercial items included in FAR subpart 13.5.

The period of performance is fifty days from time of award.

The Independent Government Estimate (IGE) for this acquisition is and will be paid for using Fiscal Year (FY) 2026 Operation and Maintenance (OMN) funding.

The Government’s minimum needs have been verified by the certifying technical andrequirements personnel.

4. The statutory authority permitting sole source.

Revised June 29, 2022

IAW 15 U.S.C. 657(a): HUBZone Act of 1997 as implemented by FAR 6.302-5(b)(5) modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C.1901.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.

The dimensions for the Beluga barge are 240’ long and 61’ 8” wide with a 14’+ freeboard, 3.5’ draft. There is only one large business and one small business in the Puget Sound region with the capability to dock the Beluga barge based on its dimensions. Motive Power Marine is the only HUBZone small business with the facility capability to fit a vessel of this size.

6. A description of efforts made to ensure offers/quotes are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized in FEDBIZOPPS (as required by FAR 5.2) and, if not, which exception under 5.202 applies.

In an effort to identify more potential sources, the technical subject matter expert was asked to identify any other known vendors who may be considered technically capable of performing this requirement. One small business and one large business are known to potentially be capable to dock this vessel. Out of the two businesses, the one small business Motive Power Marine is a HUBZone with the facilities capable of accommodating this vessel, and the technical capability to accomplish the work. After it became apparent that only one small business had the capability to complete this requirement the Small Business Deputy was notified.

IAW FAR 5.2, this requirement is not exempt from the requirement to synopsize; therefore, a notice of the Government’s intent to sole source will be posted to the Government-wide Point of Entry for five days (https://sam.gov).

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the contracting officer that the anticipated cost to the government will be fair and reasonable.

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. This determination is based on available historic pricing, the Government’s independent estimate, and other methods allowed under FAR 13.106-3.

8. A description of the market research conducted and the results or the reason market research was not conducted.

Market research was conducted using historical data. PSNS & IMF has docking capabilities for facilities in the Puget Sound region. The Beluga barge is 61’ 8” wide with a 14’+ freeboard, 3.5’ draft. Based upon market research there are only two vendor facilities with capability to dock the barge. Out of the two vendor facilities, only one is a small business. The one known small business Motive Power Marine is a HUBZone.
