This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, using Simplified Acquisition Procedures, as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation will be posted on SAM (sam.gov).

The RFQ number is N42158-23-Q-S009. This solicitation documents and incorporates provisions and clauses in effect through FAC 2022-08 October 28, 2022 and DFARS Change Notice 20221028. It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The NAICS Code is 532490 and the Small Business Standard is $35 million.

The proposed contract action is for commercial services for which the Government intends to solicit as full and open. Interested persons may identify their interest and capability to respond to the requirement or submit quotes. This posting is a request for competitive quotes. All quotations received by the closing response date may be considered by the Government.

QUESTIONS: Offerors may submit their questions regarding clarification of solicitation requirements to Heidi Miller by email at heidi.r.miller.civ@us.navy.mil no later than 4:30pm EST on December 12, 2022. Any questions received after this deadline may not be answered.

This announcement will close on 16 December 2022 at 4:30 PM Eastern Standard Time.

Shipping term shall be FOB Destination; therefore, quote SHALL include shipping cost.

System for Award Management (SAM). Quoting vendors must be registered in the SAM database to be considered for award. Registration is free and can be completed on-line at http://sam.gov/.

To be considered for this opportunity, all quotes shall be submitted in either Microsoft Word, Excel spreadsheet or Adobe PDF. Quote must include price(s), FOB Destination, a point of contact, name and phone number, business size, and payment terms. Quote must include signed vendor certification attached in the SOW. An award will be made based on Lowest Price Technically Acceptable (LPTA). Each quote must clearly indicate the capability of the vendor to meet all specifications and requirements in the SOW. Responses to this solicitation are due by 4:30 pm EST on December 16, 2022. Email quotes to heidi.r.miller.civ@us.navy.mil.

Quotes shall be valid for sixty (60) days (at minimum).

All interested vendors shall provide a quote for the following:

Statement of Work

Section A: Scope

1. Objective:

Rent 98% Argon and 2% Oxygen gas mixture to support the repair/welding of Naval Propulsion shafts to support fleet readiness.

2. Background/Introduction:

The rental of these 98/2 cylinders are needed in order to support the repair/welding of Naval Propulsion shafts to support fleet readiness. NNSY use to utilize a mixer to mix the oxygen and argon from cylinder banks. After some weld defects NNSY started analyzing the mixture we were actually receiving and found that we couldn’t maintain a tolerance within the specifications to prevent the weld defects we were seeing. NNSY then began contracting out for premixed analyzed gas within specifications to ensure a more consistent result.

Section B: Applicable Documents

3. Documentation: The following documents of the issue in effect on the date if invitations for requests for proposal form a part of the specification to the extent specified herein.

4.2 Non-Government Documents:

4.3 Order of Precedence:

In the event of conflict between the test of this specification and the references sited herein, the text of the specification shall take precedence. However, nothing in this specification shall supersede applicable laws and regulations unless a specific exemption has been obtained.

Section C: Requirements

4. Scope of Work:

a. NNSY requires the delivery of 98% Argon and 2% Oxygen tanks on an as needed basis, unless otherwise requested by the Government.

b. The requirement is not to exceed 22,000 Cu. Ft. for a one (1) year period. The (12) cylinders must be palliated together. Each cylinder must be weighed separately and tested to make sure the correct percentage of gas is in each cylinder.

c. The quantity of mixed gas listed within this statement of work is an estimate and shall not be exceeded without the prior approval of a contracting officer.

d. The cylinder size will be between 235 and 336 Cu. Ft.

e. The price shall include the cost of delivery and pick up of empty cylinders

5. Contractor Responsibilities: The Contractor shall:

a. Respond to requests from the Government within 24 hours of Government notification.

b. Make as needed deliveries of full cylinders while picking up empty cylinders in the same visit.

c. Only invoice for the actual amount of 98% Argon and 2% Oxygen delivered during the duration of the contract.

d. Lease no more than 250 cylinders a year and shall not exceed six (6) pallets of twelve (12) cylinders at a time. Three pallets (3) of twelve (12) cylinders will be delivered to Norfolk Naval Shipyard and the other three (3) pallets will be on standby at the vendor’s location. Vendor will route out when we have a pallet empty.

e. Responsibility for Inspection: Unless otherwise specified in the contract or purchase order, the contractor is responsible for the performance of all inspection requirements (examinations and tests) as specified herein. Except as otherwise specified in the contract or purchase order, the contractor may use his or her own or any facilities suitable for the performance of the inspection requirements specified herein, unless disapproved by the government. The government reserves the right to perform any of the inspections set forth in this specification where such inspections are deemed necessary to ensure supplies and services conform to prescribed requirements.

f. Responsibility for Compliance: All items shall meet all requirements of Section B. The absence of any inspection requirements in the specification shall not relieve the contractor of the responsibility of ensuring that all products or supplies submitted to the government for acceptance comply with all requirements of the contract.

6. NNSY Responsibilities: The Government shall:

a. Provide the contractor 24 hours’ notice for the Government’s need to be filled.
