STATEMENT OF WORK

PART ONE: GENERAL CONTRACT SPECIFICATIONS

1.0 DESCRIPTION OF WORK

The work covered by these specifications consists of furnishing all necessary equipment, material, labor, and supervision for performing all processes required for the collection, transportation, recycling, and disposal of all refuse materials specified in this Statement of Work (SOW) for the Statue of Liberty National Monument (NM) and Ellis Island (STLI) for the period of five (5) years beginning September 1, 2026, through August 31, 2031, if all option periods are exercised (base year plus (1) option year).

Materials identified as refuse include all garbage, construction, landscaping debris, rubbish, and other similar materials that shall be hauled to a state-approved/legal disposal site or, in the case of recyclables, to a state-approved/legal recycling facility.

1.1 DEFINITIONS

Construction and Landscaping Debris: Means grass cuttings, tree trimmings, stumps, dirt, walkway sweepings, roofing and construction wastes, and similar waste material.

Rubbish: This means various waste materials such as ceramics, floor sweepings, wrappings, containers, cartons, and similar articles not used in preparing or dispensing food. It also includes any items of metal, glass, plastic, and paper that are inappropriate for recycling. Similar materials or equipment of a weighty or bulky nature, such as iceboxes, refrigerators, deep freezers, ranges, sofas, water heaters, water tanks, and sinks, are also part of these requirements.

Garbage: This means meat and vegetable waste mixed with food product packaging resulting from handling, preparing, cooking, and consuming foods.

Recyclables: Mean paper, plastic, metal, and glass items ordinarily collected and targeted for recycling.

Such items include cardboard, office paper, newspaper, magazines, aluminum, steel, tin cans, plastic containers, bottles, and jugs.

1.2 SITE LOCATION & ACCESS

This contract will be at Liberty Island, New York (NY), and Ellis Island, New Jersey (NJ). Ellis Island is accessible by a service bridge that links it to Liberty State Park, Jersey City, NJ. The contractor shall transport Park refuse from Ellis Island utilizing the bridge. Liberty Island is only accessible by water transportation (i.e. barge vessel). The contractor will provide a location where the truck will embark and disembark.

PART TWO: SERVICE REQUIREMENTS

2.1 REQUIRED CONTAINER / COMPACTOR EQUIPMENT

Below is a list of the equipment the Contractor is required to provide on-site:

The Contractor is also required to have trucks that can remove a full load of each of the listed on-site equipment. See paragraph 3.3 for additional transportation truck requirements.

2.2 EQUIPMENT INSTALLATION AND MAINTENANCE SERVICES (CLIN 0010)

All equipment must be in good condition before initial installation and condition must be maintained for the duration of the contract to eliminate/reduce rodent infestations caused by leakage and/or spillage of waste. See paragraphs 3.7 and 3.8 for additional container maintenance requirements.

The contractor shall install the Self-Contained Compactor units on concrete pads supplied by the Government. The Government will supply 480-volt electrical feeds at the base of the concrete compactor pad. The contractor is responsible for the unit's connections to the electrical feed.

2.2 EMPTYING AND WASTE REMOVAL (CLIN 0020):

All containers shall be emptied of refuse and waste material before returning. After the contractor drops them off, the Contracting Officer's Representative (COR) inspects compactors and open tops. The Contractor is responsible for exposing of the waste material in accordance with New York and New Jersey State requirements. See paragraphs 3.4, 3.5, and 3.6 for additional emptying and waste removal requirements.

The open-top dumpster for Liberty Island must be transported to and from the contractor’s boat ramp location to Liberty Island by a barge vessel.

The open-top dumpster for Ellis Ilsand must be transported over the service bridge that links Ellis Island to Liberty State Park in New Jersey.

2.1 LOCATION

The Contracting Officer's Representative (COR) will designate pick-up container locations. Compactors are at the rear of the powerhouse on Ellis Island, and one compactor is at the maintenance facility on Liberty Island. The contractor shall transport and return the carting truck from their ramp location to Liberty Island.

PART THREE: EXECUTION OF WORK

3.0 SCHEDULE OF WORK

The containers shall be emptied during regular working hours (7:00 AM-to 5:00 PM). Collection shall be made from all locations identified by the Contracting Officer's Representative. The contractor shall respond within 24 hours for pick-ups and return of emptied containers. Emptied containers shall be delivered on the same day as the pickup.

Inclement weather is not considered justification for failure to comply with the terms of this contract.

Once street and park roads are passable, regular collection must resume in heavy snowfall.

3.1 ESTIMATED QUANTITIES

Historical records indicate that it is not unreasonable to expect the following annual estimated pick-ups of refuse collections and disposal pick-ups. As it is impossible to determine the exact quantity that will require removal during the contract period, the estimated amount shown herein is for information only.

It may be increased or decreased by the actual accumulations. Should it become necessary, the contractor shall provide additional or reduced pickups at the request of the Contracting Officer; a written modification of the contract will be sent to the contractor. Payment for authorized additional or reduced services shall be at the contract Unit Price. The contractor shall note that pickups will be more frequent in the summer and less in the winter and adjust accordingly.

3.3 EQUIPMENT

The contractor's trucks used to deliver and replace containers shall be equipped with a satisfactory cover to prevent littering of local streets and Park roads. Material spilled from the container shall be picked up immediately by the contractor, whether on or off Government property.

3.4 REMOVAL AND DISPOSAL

During the pickup operation, if the contractor spills refuse from the container, the driver shall immediately clean up all spilled refuse and return it to the container. The emptied container shall be returned to its original position, and the lid shall be replaced if applicable.

3.5 GARBAGE AND TRASH REMOVAL AND DISPOSAL

Garbage and trash shall be removed and disposed of outside Government premises. The disposal methods shall follow local, state, and federal government health and sanitation codes, laws, and regulations. The contractor shall provide written documentation as proof of the suitability of the final disposal methods. All fees associated with disposal are the responsibility of the contractor.

3.6 CONTAINER INACCESSIBILITY

All reasonable attempts will be made by the contractor to make the collections specified in this contract.

Should access to the container be obstructed, the contractor or his designated representative shall notify the Contracting Officer immediately. If access to the container is made available before the closing work hour, the garbage, refuse, and trash contained therein will be collected and disposed of by the terms of this contract. Should access to the container not be available before the closing work hour through no

STATEMENT OF WORK Page 5 of 5 fault of the contractor or his representatives, the contractor will not be held liable for nonperformance about that container and will be paid by the terms of this contract.

3.7 CONTAINER MAINTENANCE

Containers shall always be maintained in good repair. Lids and working mechanisms shall receive routine servicing as the container manufacturer recommends. Lids shall be repaired or replaced as often as necessary to prevent rodents and other pests from feeding on the container's contents. Containers that become unserviceable shall be replaced with new or serviceable units. The Contracting Officer's Representative has the right to inspect the containers daily and designate replacement containers.

Containers shall be cleaned inside and out, painted, washed, and sprayed as often as necessary to maintain sanitary conditions.

3.8 COMPACTOR MAINTENANCE

The contractor shall maintain all compaction apparatuses, hydraulics, mechanical, and electrical equipment supplied to the government under the terms of this contract. Within 24 hours of receiving a call of equipment failure, the contractor shall respond and fully repair or replace components as needed to return the equipment to full operation.

The government shall inspect the contractors’ equipment daily for hydraulic leaks, malfunctions, and erratic operation. The contractor shall respond and repair all deficiencies found herein.

4.0 SITE SECURITY

Due to heightened security at the Statue of Liberty, NM, and Ellis Island, vehicles and persons entering the site are subject to search. All contractor and subcontractor employees must obtain a park identification (Government-issued photo identification cards) that must be worn when entering and while on Government property. The Government will perform a background check for security purposes on all contractor personnel planning to work onsite at the Government’s location. The contractor shall provide the following information for all contractor personnel, including both prime and subcontractor personnel, who are planned to be working onsite at the Government’s location under this contract: full name, home address, date of birth, sex, race, height, weight, eye color, hair color, and social security number. The contractor shall provide the above information to the Government not less than one (1) week before the individual commences work onsite at the Government’s location. The Government reserves the right to deny access or remove any contractor or subcontractor employee from the park who, as determined by the Government, represents a risk or threat to security or safety.
