About this file

This document is a Sole Source Justification and Approval (J&A) for a Firm Fixed Price contract for DVB-S2 technical support Service Level Agreement (SLA) with Digital Glue. The contract is for the American Forces Network (AFN) Broadcast Center, supporting maintenance and support for various systems including Harmonic hardware, InView, EPG, Station Logo ID Cloud Service, Verimatrix, and Prisms. Digital Glue is the sole source because they designed and implemented the existing systems, possess proprietary engineering data, and have unique manufacturer Service Level Agreements that are critical to maintaining broadcast continuity.

The procurement is for FY26 with O&M funds, arising from previous contracts (HQ0516-20-C-0017 and HQ0516-24-P-0025) for the DVB-S2 Encoding System. The government will continue to conduct market research to potentially enable future competitive actions. The contract covers maintenance, support, reconfiguration, implementation, and testing for the DVB-S2 system at DMA Riverside and the DMA COOP site at Ft. Meade, with the justification emphasizing that no other vendor can provide equivalent support for the specialized broadcast encoding and encryption system.

SOLE SOURCE JUSTIFICATION AND APPROVAL (J&A)

Federal Acquisition Regulation (FAR) Subpart 13.501*

(*Format follows FAR 6.303-2, but modified to reflect FAR Subpart 13.5 procedures)

Purchase Request Number:

Contract Number: HQ051626PE003 Task/Delivery Order Number:

Procurement Title: FY26RIV-5189 DVB-S2 SLA Estimated Value:

Statutory and Regulatory Authority: 41 United States Code 1901 as implemented in Federal Acquisition Regulation 13.5, Sole Source (excluding brand name) Acquisitions using Simplified Procedures for Certain Commercial Products and Commercial Services

J&A Log Number:

Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of FAR Subpart 13.5.

1. REQUIRING ACTIVITY AND CONTRACTING ACTIVITY:

Requiring Activity:

American Forces Network Broadcast Center, AFN-BC/AFN 14855 6th Street, Bldg. 2725 Riverside, CA 92518

Contracting Activity:

DMA HQ, Acquisition and Procurement Directorate 6700 Taylor Avenue Fort Meade, MD 20755

2. NATURE/DESCRIPTION OF ACTION: This contract action is for a new Firm Fixed Price contract on a sole source basis for a follow-on for DVB-S2 technical support Service Level Agreement (SLA). FY26 O&M funds are being expended for this requirement.

3. DESCRIPTION OF SUPPLIES/SERVICES: This action is for a new Sole-Source, Firm Fixed Price (FFP) contract support service level agreement (SLA) for the DVB-S2 System located at

DMA Riverside. Support includes: Harmonic HW Maintenance and Support Renewal (NOTE:

Harmonic equipment is past EOL/EOS, support will provide repairs or replacement with "like" equipment of the same quality that will perform the same functionality,) InView, EPG, and Station Logo ID Cloud Service Maintenance and Support Renewal Verimatrix Maintenance and Support renewal Support renewal (Includes the original Primary and Backup systems, Verimatrix M&C Server Maintenance and Support. Prisms maintenance and support renewal, labor for maintenance and support SLA AFN Riverside DR System labor includes reconfiguration, implementation, and testing.

4. IDENTIFICATION OF STATUTORY AUTHORITY: 41 United States Code 1901 as implemented in Federal Acquisition Regulation 13.5, Sole Source (excluding brand name) Acquisitions using Simplified Procedures for Certain Commercial Products and Commercial Services.

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: Digital Glue currently possesses the equipment manufacturer Service Level Agreements for all equipment used in the DVB-S2 system owned by DMA. For equipment that is no longer supported by the manufacturer, or the manufacturer is no longer in business, Digital Glue is honoring the SLA terms and conditions throughout the required extended support period. In addition, Digital Glue possesses proprietary engineering and design data, unavailable to any other integrators. If DMA is unable to procure the maintenance and support SLA through Digital Glue, there is high risk that any system fault or equipment failure would leave AFN in a prolonged outage or mission failure. The required SLA would protect AFN broadcast continuity, and it is only available through Digital Glue.

6. CONTRACT OPPORTUNITIES ANNOUNCEMENT/POTENTIAL SOURCES: No other sources were found. Market research will be ongoing and if additional sources are found, future procurements will be competed.

7. DETERMINATION OF FAIR AND REASONABLE COST: The contracting officer will make a final determination of fair and reasonable price based on the one or more of the price analysis techniques included at FAR 13.106-3(a)(2).

8. MARKET RESEARCH: Market research was conducted between September - December 2025. Digital Glue designed and implemented the systems presently in use at AFN Riverside and the DMA COOP site at Ft. Meade. Digital Glue is the only company capable of providing and supporting a service level agreement covering the DVB-S2 system. Digital Glue does not provide pay per incident/case support service. The company will only support partners to have an active SLA in place. Based on the complexity and propriety nature of the system design and software, that only brand name support for the DVB-S2 Encoding and Encryption System provided by TDhigisitraelqGuliuremceantfiusllfyormpereotptrhietaGryovperrondmuecnt ts’uspnpeoerdt,. and no competitor functional replacement product support exists in the market to meet the Government's need. The Government will

Page 3 of 4 Pages continue to conduct market research to determine if there are changes in the marketplace that would enable future competitive actions; i.e., there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of the product, or it is economically feasible to procure a new system.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

(a) Procurement History.

(1) DMA HQ DVB-S2 Encoding System was awarded to Digital Glue on contract number HQ0516-20-C-0017as a Small Business Set Aside, as a sole-source action.

(2) DMA procured professional services for design, installation, configuration, management, training, service and support for a multi-channel television and audio service encoding and distribution system, under contract HQ0516-24-P-0025. Support for this system has expired as of September 30, 2025.

(b) Actions to Remove Barriers. As technology evolves, and equipment reaches life-cycle usability, replacement systems are designed and solicited based on requirements, rather than name-brand or sole-source objectives. Every effort is made to enhance transparency and promote small business participation when forecasting requirements, to include using commercially available goods and services whenever possible.

(c) The originally awarded DVB-S2 Encoding System, on DHHS Contract

HHSP23320165061A, specified operational broadcast requirements, encryption standards, and parameters that were integrated and fielded to thousands of set-top boxes and decoders around the globe. In order to maintain mission integrity and continuity, AFN must continue to broadcast utilizing these standards.
