About this file

This document is an Addendum to Justification and Approval (J&A) 21-0212 for the use of other than full and open competition to award a contract to CAE USA, Inc. for the Undergraduate Military Flight Officer (UMFO) Multi-Crew Simulator (MCS) 2B51 device, Block 2 Upgrade effort. The original J&A was approved for $5,000,000, but the revised proposal from CAE USA, Inc. is for $9,368,022.32, which exceeds the 30% variance allowed. However, the scope of work has not changed, and the rationale for the sole-source award to CAE USA, Inc. as the Original Equipment Manufacturer remains valid due to the duplication of costs that would be incurred if another contractor were to perform the work. The Procuring Activity Competition Advocate has approved the new contract amount of $9,368,022.32 under the authority of 10 U.S.C. 2304(c)(1).

J&A 21-0212

ADDENDUM TO:

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

Justification and Approval (J&A) 21-0212 is for the Undergraduate Military Flight Officer (UMFO) Multi-Crew Simulator (MCS) 2B51 device, Block 2 Upgrade effort. This is to be awarded to CAE USA, Inc. (CAE) via issuance of a new C type contract.

The Procuring Activity Competition Advocate, , approved the J&A on 09 June 2021 for an amount of . The (revised) proposal was received in the amount of . The proposed amount falls outside of the 30% variance allowed by NAVAIR Instruction 4200.31F, but remains within the original approvers authority. The scope of work has not changed since the approval of the original J&A nor the rationale for awarding to CAE.

Recall from the J&A that duplication of cost was discussed as the rationale justifying the use of the cited statutory authority (10 U.S.C. 2304(c)(1)). The original cost estimate determined that the cost for CAE to complete MCS Block 2 upgrades would be . The estimate for another contractor to deliver the same required upgrades (inclusive of the additional re-work) was provided at . As such, the original duplication of cost was estimated to be about ( - ). Accordingly, the application of this same estimation logic to the current proposed value of leads to an estimated duplication of cost at . These costs are not expected to be recovered through competition of the MCS Block 2 effort.

Given these facts, I hereby approve the new amount of associated with J&A 21-0212.

APPROVED

Upon the basis of the above justification, I hereby approve as Procuring Activity Competition Advocate for NAWCTSD, the use of other than full and open competition for the proposed procurement described herein, pursuant to the authority of 10 U.S.C. 2304(c)(1).
