Small Purchase Brand name Mandatory Justification
1. Identify the required supplies or services by keyword nomenclature and model or stock number, and quantity. Identify the proposed source.
This requirement is for the renewal of Brand Name Oracle Sun Server Maintenance products for Oracle Premier Support of Systems, Customer Data, and Devise Retention hardware and software. Oracle is the only source that can provide the supplies and services and no other supplies or services will satisfy program requirement. The extensive parts list has been provided with the procurement package.
2. What unique capabilities does the proposed contractor/manufacturer possess which make it the only one capable of satisfying this minimum requirement? Which of these capabilities are mandatory?
Oracle has proprietary rights to the products and services associated with this acquisition requirement and as such are the only vendor, along with its authorized resellers that can provide original equipment manufacturer (OEM) parts, services and OEM qualified maintenance support. The Product warranty and licenser agreements will be voided if maintenance and technical support are provided by unauthorized sources
3. Was a market search or other informal survey conducted? Describe your search or survey?
In accordance with FAR 10.002, market research was conducted by technical representatives to accomplish research and analysis in connection with the Government's requirements, and to determine availability of the functionality required to meet the Government's needs. Oracle, along with its authorized resellers, is the sole provider for licenses, maintenance and technical support of
Oracle/Sun hardware, frrmware and technical support and no other supplies or services will satisfy the program's requirements. The requirement was placed in both SEWP V and GSA for a total of7 days. Best pricing from a small business was through SEWP V. We received one partial GSA quote.
4. What material evidence exists that the Government would be injured if the noncompetitive procurement is not made?
Our current Government Off The-Shelf (GOTS) and Commercial-off the-shelf (COTS) applications have been tailored to be compatible with the Oracle/Sun Solaris operating system. These applications will not transport to another brand of processor or operating system without recoding the software and in-house scripts requiring extensive testing and a long period of outage for the customers, further training of system administrators, database administrators and developers. Without renewal of the annual maintenance and support, the servers and their functionality would become unavailable to users causing enterprise wide work stoppages. No other products could be utilized without a substantial increase in effort and cost, and significant risk of data corruption, loss or removal during transition. If Naval Air Warfare Center, Aircraft Division (NA WCAD), Infrastructure and
Operations Division Patuxent River (PaxR) Data Center were to procure hardware with similar functionalities, it loses its current investmentmade for initial hardware/firmware which is approximately $3,757,215.00. This amount would not be recovered through competition. A non-Oracle/Sun solution would also require training, re-certifications, discontinuance of current maintenance contracts, establishment of new maintenance contracts, and additional labor hours that will be required to recode the software and in house scripts. The cost associated with that is anticipated to be significant but cannot be estimated effectively due to ever changing dynamic workforce and requirements. If the government did select another product, there would be a high risk tha data within our system could be corrupted, lost, or completely removed in either a manual or an automated transfer. This is not a viable option since it impacts the overall Fleet and mission critical activities
Provide the date by which the supplies or services must be delivered. How was this date determined?
The proposed requirement is for the period of performance will be 1 March 2021 through 28 February 2022 to continue uninterrupted maintenance support expiring 02/28/2021.
