Notice to Quoters

1. This solicitation is being posted as a Small Business Set-Aside. The applicable NAICS code 325199 with a small business size standard of 1,250 employees. This solicitation is being prepared in accordance with FAR part 13 Simplified Acquisition Procedures. USDA APHIS PPQ Program intends to issue one firm fixed priced Indefinite Delivery, Indefinite Quantity (IDIQ) contract as a result of this solicitation.

2. Quoters must be fully registered in the System for Award Management (www.sam.gov) including current online representations and certifications, no later than the solicitation response date/time.

3. The U.S. Department of Agriculture (USDA) is an agency of the Federal Government and is tax exempt (Tax ID # 41-0696271).

Questions should be submitted no later than seven (7) days prior to the response deadline to ensure adequate time is available to respond and to amend the solicitation if necessary.

The Government reserves the right to request product samples for testing and evaluation purposes. Upon request, the quoter shall mail the required samples within one (1) business day, ensuring delivery is received by the Government within two (2) business days of the request. The Government may waive the requirement for the product samples if supplies identical to those called for in the solicitation have previously been furnished by the quoter and were accepted by the Government.

☐ d.) Quality Control Plan. The plan shall explain the quoter’s quality control system and clearly outline the quoter’s ability to meet contract specifications and contract delivery requirements. The plan must also include the contractor’s ability to produce, ship orders and process orders.

☐ e. Representations and Certifications. Quoters must complete annual representations and certifications online in the System for Award Management (SAM) in accordance with FAR 52.212-3. If paragraph (b)(2) of the provision is applicable, a written submission is required. Quoters are advised that the “Buy American Certificate” applies to this solicitation and must be completed. See 52.212-3(f)).

7. Award will be made to the responsible quoter whose quote conforming to this solicitation will be most advantageous to the Government, price and other factors considered in accordance with FAR part 13. The following factors shall be used to evaluate offers: Price, Technical Capability, and Past Performance.

8. Implementation Of Executive Order 14173, 14168, and 14148 Notice: System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations. Examples include 52.222-25, Affirmative Action Compliance, and paragraph

(d) of 52.212-3, Offeror Representations and Certifications—Commercial Products and

Commercial Services. Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM. In advancement of Section 2 of Executive Order 14208, the removal of requirements related to Executive Order 14057 eliminates all non-statutory sustainability requirements or preferences in purchases of food service wares, including paper straws. In addition to removing requirements related to Executive Order 14057, the attachment also reflects recent updates to Code of Federal Regulation citations for the U.S. Department of Agriculture’s BioPreferred® Program, a statutory purchasing preference program.

1.0 SCHEDULE OF SUPPLIES/SERVICES:

This is a 5- year fixed price Indefinite Delivery Indefinite Quantity (IDIQ) Contract for the supply of Solid Methyl Eugenol (ME) lures – Plug style – 6-grams to USDA, Animal and Plant Health Inspection Service (APHIS), Plant Protection and Quarantine (PPQ) Moore Air Base in Edinburg, TX. The quantities in the pricing schedule are estimates only for evaluation purposes. Delivery or performance shall be made only as authorized by delivery orders issued in accordance with the Ordering clause (52.216- 18). Unit prices must include all costs associated with performing all work required in a complete and acceptable manner.

2.0 Statement of Work

6-GRAM METHYL EUGENOL SOLID DISPENSERS

2.1 SCOPE

APHIS seeks to purchase:

6-gram methyl eugenol solid dispensers in support of the fruit fly detection program.

2.2 BACKGROUND

Fruit flies, in particular Mediterranean (Medfly), Mexican (Mexfly), oriental (OFF), and melon fruit flies, are some of the most serious exotic plant pests threatening United States (U.S.) Agriculture.

The cost of infestations to the U.S. Department of Agriculture (USDA) and to U.S. agricultural industries can exceed $33 million dollars per year. If not eradicated or managed, the cost to live with these pests is estimated at $821 million or more per year.

2.3 OBJECTIVE

There are several compounds that have been identified as potent male attractants for specific fruit fly species (as opposed to food-based lures that attract both males and females and are weaker and more general attractants). Methyl eugenol solid dispensers are needed to equip program personnel in detecting fruit fly infestations. Methyl eugenol solid dispensers are one of the primary detection tools used to survey and delimit the extent of fruit fly infestations, and to manage introduced fruit fly populations. Without these dispensers, detecting and delimiting infestations might not be possible.

3.0 SPECIFICATIONS

3.1 Specifications for purity of raw chemical ingredients

If there are significant concerns related to the active ingredient content of the submitted lures, APHIS may request a certificate of analysis or a 100 ml sample of preproduction liquid methyl eugenol to confirm purity. The 100 ml sample must represent the associated lot/batch produced.

APHIS may use these samples to assure product specifications and purity are met. Various methods to determine purity may be used.

• Must be pale yellow or colorless, pungent odor with an aroma of cloves and have a spicy taste.

• The purity level shall be no less than 95 percent, and the refractive index range shall by 1.5100-1.5329.

• All lots must be uniform in composition.

3.2 Sizing

Lures must be compatible with a Jackson trap and basket (see image). Samples of the trap type are available upon request.

• The basket has an outside diameter at the top of 35 mm, the outside diameter of the bottom of the basket is 20 mm, and the height is 27.5 mm. Up to 10 percent variation in size of the lure is acceptable.

3.3 Chemical properties for solid dispensers

Chemical characteristics of each solid dispenser must:

• Meet or exceed an initial total content of 6 grams of methyl eugenol ± 10 percent

• Must attract the target flies for up to 6 weeks (as determined by field bioassays)

3.4 Physical properties for solid dispensers

Physical characteristics of each solid dispenser must:

• Consist of a solid matrix that facilitates handling and is capable of absorbing, immobilizing and sequestering methyl eugenol liquid concentrate, so that it will be emitted at a controlled rate of release only after volatilization. "Facilitates handling” shall mean that each dispenser, when handled individually, shall be non-sticky and non-friable (i.e., not stick to the hand or crumble) when a deliberate effort is made by hand (i.e., unaided by mechanical devices) to compress and deform it.

• Continue to meet the test of handling after being filled with methyl eugenol concentrate and be resistant to damage and moisture when handled during normal field trapping operations.

• Be manufactured from and composed of nontoxic materials that remain nontoxic after filling with liquid methyl eugenol concentrate "Nontoxic" shall mean not causing any medically definable disease and/or adverse reaction to humans after 8 hours of continuous exposure to hands protected with latex gloves or an equivalent skin protection device.

• Sequester and retain liquid methyl eugenol without leaking or weeping. This shall mean that properly stored dispenser immediately following removal from its previously sealed individual packaging, shall be free of droplets of methyl eugenol or any other liquid exudates on dispenser surface, when visually inspected without the aid of optical magnification equipment.

• Be non-adhesive. This means that at ambient temperatures of 40°C or less, a dispenser shall not adhere to and remain stuck to (i.e., not removable from).

o The hand when gripped by individual wearing latex gloves;

o The inside of a standard Jackson trap in a way that significantly impedes its installation or replacement with a new dispenser.

• Be non-friable. This means that during or following a use period of 8 weeks or less in a standard Jackson trap, the dispenser shall not crumble or otherwise decompose in a way that significantly impedes its removal and replacement with a new dispenser.

• No other methyl eugenol solid dispensers (e.g., pouches or packets) will be considered under this solicitation.

• General operational feasibility and ease-of-use will also be considered during submission evaluation.

3.5 Quality control

The vendor is expected to have a written quality control program which will be submitted to APHIS for review prior to award of the contract. Vendor testing protocols should mirror current APHIS standards, however some mutually agreed upon variations may be allowed by APHIS.

The plan shall explain the contractor’s quality control system and clearly outline the contractor’s ability to meet contract specifications and contract delivery requirements. The plan must also include the contractor’s ability to produce, ship orders and process orders.

3.6 First article testing

First Article Testing

Prior to each delivery, the contractor shall supply a ______ sample (First Article) that will be representative of all of the units in the pending shipment for testing by the Government. The sample shall be received three weeks prior to each delivery. The sample shall be delivered to: USDA APHIS PPQ in Edinburg, TX and should be labeled as such.

First article testing shall be performed in accordance with contract clause 52.209-4 First Article Approval – Government Testing. The sample will be tested for compliance with Product Specifications (Section 3.0). The Contractor will be notified by the Government of the results of Pass or Fail. If the results pass the Contractor shall proceed with delivery. If the results fail, the Contractor shall provide a second sample for testing immediately as to not affect the delivery schedule.

52.209-4 First Article Approval – Government Testing

(a) The Contractor shall deliver sixty (60) freshly produces lures (First Article) representative of all of the lures in the pending shipment for testing by the Government. The sample shall be received three weeks prior to each delivery. The sample shall be delivered to: USDA APHIS PPQ, 22675 N.

Moorefield Road, Building 6420, Edinburg, TX 78541. The shipping documentation shall contain this contract number and the Lot/Item identification. The characteristics that the first article must meet and the testing requirements are specified elsewhere in this contract.

(b) Within 5 business days after the Government receives the first article, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article.

The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.

3.7 Quality assurance

Once the new contract is awarded, APHIS will conduct quality assurance testing of each new lot of lures that is produced. The vendor will be required to submit 10 lure units from each new batch that is produced under the contract to APHIS for quality assurance testing. APHIS will develop quality assurance pass/ fail criteria for each contracted product individually to account for differences in physical and chemical properties of products manufactured by different vendors. These criteria developed by APHIS and used by APHIS in the quality assurance testing will be designed to evaluate the following salient characteristics:

• Uniformity with approved product – newly procured lots must be equivalent or better than the original product that was first contracted by the fruit fly program In particular:

o Attractiveness to target species and life stages of fruit flies – newly produced lots of lures must be able to attract fruit flies to the same or greater extent as was originally established during the testing and approval process.

o Longevity – newly produced lots of lures must last as long or longer in the field as was originally established during the testing and approval process.

• Chemical assays – quality assurance will rely on chemical assays preferentially because these are more cost-effective and faster to perform than field bioassays. However, chemical assays of lure content cannot be used to quantify fruit fly attraction on their own. Therefore, APHIS will develop chemical assays using concurrent field bioassays. Once reliable chemical assays and work instructions are developed, and APHIS understands the correlation of chemical content to fruit fly attraction, then APHIS may deploy chemical assays alone as part of the quality assurance process.

• Multiple criteria – for pass/ fail criteria of 6g ME plugs, APHIS will develop quality assurance criteria that take into account initial content of methyl eugenol, initial mass percent composition, and residual content of methyl eugenol following 4 weeks of weathering under standardized conditions. These criteria together ensure that the lure will effectively attract the target fruit flies for a period of up to 8 weeks.

• Documentation – newly developed quality assurance criteria will be documented in a written report.

4.0 PACKAGING

Each lure shall be individually packaged. The packaging shall prevent the release of chemicals into the environment when unopened. The package material and sealing system shall prevent odors detectable by humans when stored unopened at room temperature.

• Packaging must be impregnable to other chemicals to protect the semiochemicals.

• Packaging must prohibit the leaching of semiochemicals to ensure extended storages in extreme conditions (90°F Plus)

• Each individually packaged lure dispensers must include at a minimum the following markings:

• Items will be sub-packed in tear-free plastic bags, with each bag holding a standard count of 100 units or fewer (i.e. 25, 50, 100 units each bag)

• Packing boxes shall have secondary containment inside, such as a poly bag.

• Packing boxes shall not contain mixed lot/batch numbers.

• Each shipment will contain a valid Material Safety Data Sheet (MSDS).

• Each shipment will contain a valid Certificate of Analysis (COA), indicating the amount of each chemical component

• Shipping containers must be adequate to reach the delivery destination fully intact and without damage.

• If shipped via pallets, height of the cargo may not exceed a total height of 56” (inclusive of the pallet height).

• Lures shall be uniformly packaged in boxes that are easily movable by a person, not to exceed 20 pounds per container/package.

4.1 Package markings

Affixed to the outside of each shipping container in a waterproof plastic pouch, each shipment shall include the following:

• Safety Data Sheet (SDS)

• Certificate of Analysis (COA), indicating the amount of each chemical component

• Packing slip identifying the following:

5.0 ADMINISTRATIVE

5.1 Invoicing

Payments will be made according to the firm-fixed unit price established in the contract Pricing Schedule. Invoices will be submitted in arrears and prepared in accordance with FAR 52.212-4(g).

USDA uses the Invoice Processing Platform (IPP) for electronic submission and tracking of purchase orders, invoices, and payment information to its suppliers of goods and services: Enroll at https://ipp.gov. The IPP is a government-wide secure web-based invoice processing service offered free of charge to government agencies and their suppliers by the U.S. Department of Treasury’s Financial Management Service (FMS).

Contractors must submit invoices and attach all supporting documentation as required.

Supporting documentation includes, number of kits delivered, Delivery Oder number, and company information. The IPP Approver will review the supporting documents before approving invoices in IPP, if supporting documentation is not provided the invoice will be rejected. IPP will issue a notification to contractor that they must submit supporting documentation and resubmit the invoice. See FAR 52.232-33

5.2 Contracting Officers’ Representative

The Contracting Officer (CO) will designate a Contracting Officer’s Representative (COR) at the time of award. The COR will be the contractor’s local Government contact for contracts awarded against this requirement.

The COR is responsible for monitoring the performance of work under contracts awarded as written in the contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of the contract be effective or binding upon the Government unless advance authorization is received from the Contracting Officer, and proper contractual documents executed by the Contracting Officer prior to performing the work.

The COR shall inform the Contracting Officer as soon as possible of any recommended modifications, and actions or inactions of the contractor or the Government which could affect the contractor’s ability to comply with the contract performance requirements or completion times.

Whenever, in the opinion of the contractor, the COR requests effort outside the scope of the contract, the contractor shall so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer shall be notified immediately.

PROCEEDING WITH WORK WITHOUT PROPER CONTRACTUAL COVERAGE AND APPROVAL OF THE

CO COULD RESULT IN A BREACH OF CONTRACT AND NONPAYMENT.

The designation (delegation of authority) shall be provided in writing to the COR and the contractor.

The delegation of authority shall clearly explain the COR’s role and responsibility on the contract, and limitations of authority.

5.3.1 Delivery order set up

USDA/APHIS/MRPBS will issue the minimum required under this contract in the first delivery order upon award of the contract. Additional delivery orders may be issued throughout the life of the contract. They will be numbered with an 126395YYFNNNN. Upon delivery and acceptance of the products for any Delivery Orders, the contractor will be responsible for submitting the invoice for payment against the IDIQ Contract number, referencing the individual order number in the IPP system at https://www.ipp.gov.

Delivery orders will be issued in accordance with the Ordering clause (52.216-18, Ordering).

Delivery orders will be issued against this contract on a firm fixed unit prices established in the pricing schedule.

Orders may be placed by a warranted USDA contracting officer through email.

5.3.2 Delivery Timeline

From the moment the vendor receives the order, delivery will occur in 60 days, or less.

5.3.3 Placement of orders

The contractor shall provide the products under this contract only as directed in the delivery orders.

In accordance with FAR 16.505, each order will include:

4. Delivery date/schedule

5. Place of delivery or performance (including consignee)

5.4 Ordering authority

USDA APHIS Contracting Officers may place orders up to their warrant and within the limits of the contract Min/Max as established in the contract clauses.
