BRAND NAME JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

USING SIMPLIFIED ACQUISITION PROCEDURES (SAP) UNDER THE

SIMPLIFIED ACQUISITION THRESHOLD (SAT)

AUTHORITY: FAR 13.106-1(b)(1), 13.501(a)(ii), 6.305

1. Contracting activity/agency. Department of the Interior, Interior Business Center, Acquisition Services Directorate, Division 3 on behalf of The Defense Intelligence Agency (DIA), Directorate of Science & Technology, Chemical and Nuclear Sciences Division, Advanced Technologies Intelligence (ATI‐3) Innovation Team.

2. Description of supplies or services required to meet agency needs.

Requirement is for Smiths Detection LCD 3.3 chemical detectors, hands free. Quantity needed is 5 with an estimated contract value of and a delivery date NLT 8 weeks after award.

3. Identification of the single source to be solicited.

Limited to brand name Smiths.

4. Reason for authority cited. The contracting officer has determined the circumstances of the contract deem only one source reasonably available.

Brand Name – The particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs. If the justification is to cover only the portion of the buy which is brand name, then it should so state; the approval level requirements will then only apply to that portion.

5. Rationale.

ATI currently uses the Smiths Detection LCD 3.3 Chemical Detector and needs additional units. ATI’s stateside and overseas teams are trained to operate the Smiths Detection LCD 3.3 Chemical Detector; acquiring the same brand and model chemical detector will allow the program to keep its operating procedures and documentation in place and will prevent the need for ATI staff to retrain on different equipment. Using the brand and model will also allow ATI to continue to use its existing shipping containers to transport the new systems to deployed locations.

6. Market Research.

The Mandatory sources per the Provision outlined in FAR Part 8 Excess Personal Property, AbilityOne, Federal Prison Industries (FPI), cannot provide the required supplies and services. AbilityOne and UNICOR were searched on 06/20/2023 using the product list search.

On 06/27/2023 a Dynamic Small Business Search was conducted using NAICS Code 334516.

GSA e-Library was searched on 06/20/2023 using NAICS code 334516; the results showed 14 small businesses. A solicitation was issued on 07/06/2023 through GSA with a total small business set-aside for this procurement. No quotes for the Smith’s LCD 3.3 were received.

Under the authority of FAR 13.106-1(b)(1), the undersigned hereby determines the circumstances of this contract action deem only one source is reasonably available as supported herein.
