STATEMENT OF WORK
TAOS DAY SCHOOL
PROFESSIONAL CONTRACT STAFFING SERVICES
1.0 BACKGROUND
The Bureau of Indian Education (BIE) is seeking a staffing services contract to support the Taos Day School (TDS) in Taos, New Mexico for up to three school years (SY): 2025-2026, 2026-2027, and 2027- 2028 to support a special education student with high needs. TDS is a K-8th grade school, serving approximately 95 students. It is operated by the Bureau of Indian Education, under the direction of the Associate Deputy Director, Bureau Operated Schools, and the Albuquerque Education Resource Center
(ABQ ERC).
The Taos Day School
The Taos Day School (TDS) is in Taos, NM, which is a Pueblo Tribal community. TDS serves the specific educational needs of the Taos Pueblo community’s children. The school is dedicated to this most critical time period-Kindergarten through 8th grade-in the development of the community. Health and safety are the top priorities as we establish effective learning programs to guide and support students from childhood through adolescence. Taos Day School’s constant connection to the Pueblo community will nurture all students as they develop academically, socially, emotionally, and spiritually.
The TDS is home to the Mighty Eagles. The mission is to make sure all students excel above and beyond all academic expectations using both traditional and digital learning initiatives. Every one of the students has access to high quality learning resources and modalities for success in all academic settings. TDS tries to welcome students to an exciting learning environment where every day presents a new opportunity to grow. As the Taos Eagles grow, soar, and reach new academic heights, their futures become brighter.
From childhood to adolescence, TDS students discover and develop a wide range of academic interests, skills, and talents.
The TDS academic programs help preserve tribal custom and build upon the rich Taos Pueblo history.
TDS curricula include Tiwa language studies, Taos Pueblo arts, culture, and traditions. Qualified and experienced teaching staff helps students to prepare and adjust to society’s continued technological advances while embracing all aspects of their true identities and ancestry. TDS understands the unique learning and teaching strategies necessary for growth of its community. Eager children enter the doors of our learning center and exit them as leaders.
1.1 PURPOSE OF THE CONTRACT
The purpose of this contract is to provide professional staffing services from a staffing firm (Contractor), to provide one key personnel: a Special Education One-on-One Aide.
2.0 SCOPE OF WORK
The Contractor shall provide professional contract staffing services to hire a Special Education One-on- One Aide at TDS. The contractor shall provide services under an all-inclusive labor rate and shall furnish all personnel, travel costs, materials, equipment and services necessary to fulfill the requirements of this contract at the Taos Day School located in Taos, New Mexico.
2.1 TASKS AND RESPONSIBILITIES OF STAFFING FIRM
2.1.1 The contract will provide professional staffing services to include the following:
a. Recruit, screen, and interview potential applicants to fill the position within 5-days of award of the contract.

b. Validate that the potential applicant meets the minimum qualifications outlined in Section 14.0 for the specific position the applicant is identified for.
c. Present potential applicants to BIE for final approval before proceeding with hiring.
d. Schedule an interview with the applicant, Principal of TDS and TDS Special Education
Director/Teacher.
e. All potential applicants must have the skills, competencies and experience as defined in the
Position Description for the position.
f. Present a complete applicant package for the potential applicant (See Section 12.2 & 12.3 for what must be included in a complete applicant package).
g. Upon BIE’s approval, hire and assign the person to perform the type of work described in the
Position Description under supervision of the TDS Principal and COR.
h. Status of Contract Staff “Nonpersonal Services”: This is a nonpersonal service contract for temporary help service which the contractor is an independent contractor. The Government may evaluate the quality of professional and administrative services provided but retains no control over the contractor staff. The Contractor shall indemnify the Government from any liability producing act or omission by the contractor, its staff and agents occurring during contract performance. The contractor shall maintain liability insurance, in a coverage amount acceptable by the Contracting Officer, which is no less than the amount normally prevailing within the local community. The Contract Staff will remain exclusive employees of the staffing firm. Because the Contract Staff are not employees of the BIE or TDS, the Contract staff are excluded from participating in any fringe benefit plans or programs of the BIE or TDS, including, but not limited to, health, sickness, accident or dental coverage, life insurance, disability benefits, severance, accidental death and dismemberment coverage, unemployment insurance coverage, workers’ compensation coverage, and pension or Thrift Savings Plan (401(k)) benefit(s). Thus, the staffing firm is the common law employer of Contract Staffs, and is responsible for the following:
i. Pay Contract Staff’s wages and provide them with the benefits that the staffing firm offers to them, if they are any.
j. Pay, withhold, and transmit payroll taxes; provide unemployment insurance and workers’ compensation benefits; and handle unemployment and workers’ compensation claims involving Contract Staffs.
k. Require Contract Staffs sign agreements acknowledging that they are not entitled to holidays, vacations, disability benefits, insurance, pensions, or retirement plans, or any other benefits offered or provided by the BIE; and
l. Require Contract Staff to sign confidentiality agreements before they begin their assignments to the BIE.
m. Comply with federal, state and local labor and employment laws applicable to Contract Staffs, including the Immigration Reform and Control Act of 1986; the Internal Revenue Code (“Code”); the Employee Retirement Income Security Act (“ERISA”); the Health Insurance Portability and Accountability Act (“HIPAA”); the Family Medical Leave Act; Title VII of the Civil Rights Act of 1964; the Americans with Disabilities Act; the Fair Labor Standards Act; the Consolidated Omnibus Budget Reconciliation Act (“COBRA”); the Uniformed Services Employment and Reemployment Rights Act of 1994; and, the Patient Protection and Affordable Care Act (ACA).
n. Comply with all provisions of the ACA applicable to Contract Staffs, including the employer shared responsibility provisions relating to the offer of “minimum essential coverage” to “full-time” employees.
o. Facilitate the federal background check with assigned BIE Security Personnel and the BIE, TDS point of contact, to ensure Contract Staff complete the federal onboarding, vetting and background clearance process required by BIE. Contract Staff must receive a preemployment determination and/or a favorable clearance before they can enter on duty at the TDS. A enter on duty date will not be established until TDS receives the approval from BIE Security.

p. Make reasonable efforts to provide a similarly qualified replacement in case the Contract Staff does not report to work. A replacement must be identified within 15 business days.
q. Upon receiving pre-employment determination, require Contract Staff to provide on-site services at the TDS no later than 10 business days from date of Pre-Employment Clearance.
r. Require Contract Staff to sign a letter of commitment, outlining that they have read the Task and Responsibilities related to their position and are committed to staying for minimally the school year.
s. Require Contract Staff to participate in required school staff meetings and required, BIE training as identified by the TDS Administration.
t. Ensure Contract Staff is provided with the lodging, transport and other tools required for the provision of the services.
u. Ensure the Contract Staff does not claim additional hours worked unless expressly agreed by BIE, TDS’ authorized representative in advance of the additional hours being worked.
v. Identify a Project Manager to coordinate contract activities. The Project Manager is not a chargeable labor category under the contract.
w. Invoice monthly.
2.2 JOB DUTIES OF THE SPECIAL EDUCATION ONE-ON-ONE AIDE (SPED 1:1 AIDE)
The SPED 1:1 Aide shall work daily to provide one-on-one support and assistance to an assigned student with a disability. This shall include but is not limited to:
A. General Duties and Responsibilities
a. Provide on-site services at the Taos Day School in Taos, NM based on the school year calendar schedule and determined by the TDS Principal.
b. Complete required online training to access BIE systems and to establish a BIE email.
c. Participate in required school staff meetings and required BIE training as identified by the TDS Administration.
d. Required to participate in any mandatory parent/teacher conferences and IEP meetings.
e. Follow the 25 Code of Federal Regulations, all applicable curriculum identified and provided by TDS, and state standards, where applicable. The SPED 1:1 Aide will assist the classroom teacher by providing instructional support and assistance in meeting the educational needs of a student with a disability.
B. Student Assistance
i. Provide one-on-one support to assigned students.
ii. Assist the student during arrival and dismissal, including escorting to/from the bus.
iii. Aid the student in moving between classrooms and activity sites.
iv. Help with personal needs including clothing, locker organization, eating, and toilet activities.
C. Educational Support
i. Assist in individualized instruction under the supervision of the special education teacher.
ii. Implement behavioral management systems and classroom strategies.
iii. Aid in basic personal hygiene and health care needs.
iv. Engage the student in conversation to promote language development.
v. Reinforce material introduced by the teacher through repetitive drills and supervision of tasks.
D. Supervision and Safety
i. Monitor and assist the student during emergency drills, field trips, and play periods.
ii. Guide the child to interact harmoniously with peers during play and school activities.
iii. Supervise the student during meals, promoting good eating habits and table manners.
E. Documentation and Reporting
i. Prepare simple records and reports on student progress.

ii. Collect and maintain accurate data for IEP goals and objectives.
F. Collaboration and Communication
i. Participate in the development of the student’s individualized education program (IEP).
ii. Collaborate with teachers, specialists, and parent requests to provide appropriate support.
iii. Alert teachers about any significant issues or observations regarding the student.
G. General Duties
i. Assist in maintaining a clean and organized work environment.
ii. Complete clerical tasks assigned by the teacher.
iii. Maintain confidentiality of student records.
iv. Perform any other duties as assigned by the special education teacher or principal.
2.2.1 MINIMUM QUALIFICATIONS, EDUCATION AND EXPERIENCE
A. High School Diploma; college-level coursework in education or related field* B. One (1) year working with children with a disability in service agency, educational or recreational setting.
C. Demonstrated ability to assist with instructional activities and to communicate effectively with students, parents and school staff D. Ability to establish good working relationships with children and others; familiarity with routine of school classrooms; physical strength and ability to lift and carry a student on and off buses, upstairs and through doorways; ability to aid a student with a disability with clothing, eating and toilet activities; patience and resourcefulness in aiding the student.
E. Knowledge of diverse needs of children with disabilities and appropriate special education classroom practices
2.2.2 CONDITIONS OF EMPLOYMENT
A. Appointment may be subject to suitability or fitness determination, as determined by a completed background investigation.
B. Must be able to obtain and maintain a background clearance.
C. Must obtain and maintain valid state driver's license.
D. Indian Preference preferred, although not required E. Must be a U.S. citizen
2.3 SPECIAL CONSIDERATIONS
The remote location of the TDS and the cost of living makes this contract unique, and special consideration for the Contractor is noted to meet the requirements and tasks. Key Considerations:
Contract Personnel may need to drive back and forth from their home and/or stay at hotel during the week to accommodate the school schedule.
3.0 GENERAL REQUIREMENTS
3.1 PERIOD OF PERFORMANCE
Base Year: August 1, 2025, through July 31, 2026 Option Year #1: August 1, 2026, through July 31, 2027 Option Year #1: August 1, 2027, through July 31, 2028
3.2 PLACE OF PERFORMANCE

3.3 HOURS OF OPERATION AND ESTIMATED WORK HOURS

Service shall occur during school hours and will follow the TDS school year calendar and summer school or extended school year, if needed. Typically, the regular school year is from August to May. Summer school is run in May & June, if needed. Hours may vary to meet the needs of the school and students, but on average the SPED 1:1 aide can expect to work minimally 180 days during the school year. The school day for students is between 8:00am and 3:00pm Mountain Time. The SPED 1:1 Aide will be required to work on-site from 7:30am to 4:00pm MDT to cover school hours and must plan accordingly to be available. The SPED 1:1 Aide is entitled to a 30-minute lunch during this time, which is not chargeable.
Hours are estimated based on government need. The government does not guarantee that all hours will be requested or worked. The SPED 1:1 Aide will be expected to work and follow the school calendar and shall not work on days the school is closed to accommodate Holidays, Snow Days, or other school closure events, like School Breaks, etc., as outlined on the TDS’s calendar. The SPED 1:1 Aide is expected to participate in staff development days or other staff events, identified by the school leadership team.

3.4 TRAVEL
The contractor shall be required to travel to and from his/her home to the school on a daily and/or weekly basis.
4.0 CONTRACTOR PERSONNEL ONBOARDING TIMEFRAME
The Contractor is responsible for recruiting individuals with the necessary level of expertise to support the tasks and requirements in this Statement of Work. The Contractor will provide only candidates whose experience and education meets or exceeds the minimum requirements. The following outlines the key steps and projected timeframes, for the Contractor and BIE to onboard and vet the Contract Teaching Staff to TDS.
• The Contractor shall identify and provide potential candidates for the position, within 5-days of Contract Award.
• The Government will review the applicant package to ensure it meets the minimum requirements of the contract. BIE will review the package within two business days of receiving it from the Contractor. If the potential candidate meets all the basic minimum requirements of the position, BIE will notify the Contractor.
• BIE and the Contractor will schedule a call with the candidate, the school for an interview and to ensure the individual is a good fit for the school.
• The Contractor must submit the BIE Personnel Security Intake Package (PERSEC Intake) within 3-business days after contract award
• The background check process may take up to 4 to 6 weeks.
• Contract Teaching Staff are required to report to TDS within 10 business days of the BIE
Personnel Security Office providing a favorable background check and an entering on duty date.
4.1 WORK ENVIRONMENT
Most of the work is done in a school environment and on the TDS school campus.
4.2 PERSONAL CONTACTS
Personal contacts are with students, co-workers, Area/Agency employees, Federal and non-Federal agencies, parents, other professional educators, social services agencies, law enforcement agencies, and community members, who work at or in partnership with TDS.
4.3 SUPERVISORY CONTROL ON-SITE

General supervision of Contract Teaching Staffs at the TDS will be received from the TDS Principal or designee. The TDS Principal will help to make assignments and set priorities for the school. It will be important for Contract Teaching Staff to keep the TDS Principal always informed. For example, if the individual will be absence or need leave, to notify the TDS Principal, in advance, as much as possible.
The TDS Principal will also provide professional advice, upon request, when deemed necessary, and in unusual situations. All Contract Teaching Staffs performance will be evaluated through general observations and in-person conferences between Contract Teaching Staffs with the TDS Principals and/or Contracting Officer Representative.
5.0 SECURITY
Background Investigations are required for the position. All contract positions with duties and responsibilities involving regular contact with or control over Indian children are subject to a background investigation and determination of suitability for employment. Accordingly, all such positions require a favorable background screening by the Bureau of Indian Education (BIE), Personnel Security and Suitability Program and a favorable background investigation by the Defense Counterintelligence Service Agency (DCSA). There are additional clearance requirements for Contractors working in school locations. Contractor personnel under this contract, are required to submit to suitability clearance procedures, and shall not commence work under the contract until the COR and/or Government Contract Officer have cleared them to be on site. All contract staff must be United States citizens. The information collected during this effort is considered unclassified, sensitive; therefore, Moderate Risk Public Trust, is the sensitivity level. The Contractor will be provided access to BIE computers and information. The Contractor shall report suspected computer security breaches at TDS as soon as the breach is received, heard of, or found to the Indian Affairs Information Technology (IAIT) help desk. The Contractor shall adhere to government requirements on IT usage and access to service IA users, equipment, and software;
under no circumstance is the Contractor permitted to make use of Government computer systems, information, equipment, software, supplies, or accounts for purposes other than the performance of this contract. Personal or Contractor-owned computers are not permitted on any of the government networks.
The Contractor shall abide by United States Federal policies and procedures, the DOI policies and procedures, IA policies and procedures, and court orders.
6.0 DATA RIGHTS & DOCUMENT OWNERSHIP
The Government requires unlimited rights in any material first produced in the performance of this SOW, in accordance with the FAR clause at 52.217-14. The BIE shall have unlimited rights to, and ownership of all deliverables provided under this SOW. The Contractor, agrees, that any TDS student, staff, or parent data, collected in support of this agreement, will not be used, or shared. The implementation and outcome data collected, analyzed, and used in support of the Contract Requirements, Tasks and Deliverables are explicitly for the benefit of the BIE, TDS. Upon the expiry or termination of the service contract, the Service Provider will return to BIE any property, documentation, records, or confidential information which is the property of BIE.
7.0 CONFIDENTIALITY & PRIVACY ACT
The BIE recognizes that Contract Staff may have access to confidential information concerning BIE, TDS, TDS Students, Families, and other community members in the fulfillment of their job duties.
Contract staff agree to maintain the confidentiality of all such Confidential Information.
In particular, and without limiting the foregoing, BIE acknowledges and understands the confidential information to which Contract Staff will gain access is the confidential and proprietary information of BIE and TDS. Thus, Contract Staff agree:
• not to disclose any confidential information to anyone other than an employee of BIE, TDS who has a need to know such information.
• Prevent any unauthorized use or disclosure of the confidential TDS student, family, or employee

• Promptly notify the BIE, TDS of any unauthorized use of which the Contract Staff or staffing firm learns of.
• To use such confidential information for the sole purpose of fulfilling the performance under the
SOW.
Further, work on this Contract will require Contract Teaching Staff to have access to Privacy Information.
Contract Teaching Staff shall adhere to the Privacy Act, Title 5 of the U.S. Code, Section 552a and applicable agency privacy rules and regulations and remain compliant with HIPAA.
8.0 KEY PERSONNEL.
The position of School Social Worker is considered key personnel.
The Contractor shall:
a. Present at least one qualified individual in the technical proposal and at time of award. This includes validating that the potential applicant meets the minimum qualifications and educational requirements for the position being filled, including:
i. Providing the individual’s resume demonstrating their experience as a School Social Worker.
ii. Providing a copy of a current New Mexico Certification or Licensure.
iii. Providing a signed Letter of Commitment from the individual, that includes the following: The individual is committed to moving forward upon approval by the BIE.
This includes understanding they must undergo the BIE’s federal background check and are committed to working as the service provider minimally through the TDS school academic year to ensure continuity and consistency.
b. Present potential applicants to BIE for final approval before proceeding with hiring and placing the applicant. All potential applicants must have skills, competencies, and experience.
c. Present a complete BIE Background Check Intake Package.
d. Upon BIE’s approval, hire and assign the service provider to perform the respective duties of the position for which the individual is being hired. The Service provider will be under the supervision of the TDS Principal or his/her designee, on day-to-day operations, and must start providing services within 2 weeks of a favorable preemployment determination.
9.0 CONTRACTOR REQUEST FOR REMOVAL/REPLACEMENT.
The School Social Worker and Special Education One-on-One Aide is considered a key personnel position. Thus, the following conditions for the removal or replacements of either of these positions shall be followed during the award period.
1. The contractor shall request government pre-approval to substitute or replace the individual.
2. At least 45 days prior to the contractor diverting or replacing the individual in the position, the contractor shall notify the Contracting Officer in writing, and the TDS Principal and Special Education Director.
3. The contractor shall submit a written justification for the diversion or replacement to the Contracting Officer with a courtesy copy to the TDS Principal and COR.
i. The diversion or replacement must be mutually agreed upon between the Contracting Officer and the Contractor, before the existing individual vacates the position and leaves the contract. The expectation is the current individual will continue to provide services while a new candidate is being cleared through the BIE Background Check.
ii. The written request for pre-approval by the contractor shall identify the proposed replacement and provide an explanation for how the requested substitutes or replacements’ qualifications, experience and professional certifications are at least equal to or greater than the original candidate provided by the contractor under this contract.

The Contractor shall submit justification (including proposed substitutions) in sufficient detail to permit evaluation of newly assigned contract candidate(s).
iii. A copy of the proposed candidate’s resume, certification(s), licensure(s) and a letter of commitment must be submitted with the written justification.
4. If the individual is terminated by the Contractor for cause or separates from the contractor voluntarily with less than thirty-day notice, the Contractor shall provide notice to the Contracting Officer within 2 business days of this action, and BIE will issue a Failure to Perform.
5. When feasible, the existing individual in the position, shall commit to staying and continuing services under the contract for a minimum amount of time that allows for (1) the replacement to receive Pre-Employment clearance from the Personnel Security Branch and (2) a transition plan to be created that outlines the transition of services and activities between the existing service provider, and the new service provider.
10.0 TDS RESPONSIBILITIES (GOVERNMENT FURNISHED ITEMS).
TDS will provide the School Social Worker and Special Educational One-on-One Aide, with the following:
• Access to SPED Case File and key documentation, to fulfill services.
• Access to a BIE computer to access NASIS to fulfill requirements, and deliverables of the contract.
11.0 TDS REVIEW.
• Oversight and review of the contract will be provided by the TDS Principal or his/her designee, the School’s Special Education Coordinator and COR, as needed.
• TDS will certify and ensure all deliverables to assess performance and compliance with Contract Requirements and will utilize scope of work as a basis for review and certification.
12.0 INSPECTION AND ACCEPTANCE REQUIREMENTS.
• Quarterly performance reviews will be conducted by the TDS Principal or his/her designee, Special Education Coordinator, and/or Contracting Officer Representative.
• Any corrective actions will be addressed in a timely manner and documented for the official contract record.

5 Monthly Case Activity Report A written monthly report outlining key activities and tasks accomplished for the month mapped to key activities, i.e., conducting initial/triennial counseling evaluations, participating in eligibility IEP Meeting with Families and SPED Coordinator to interpret results, case load information and pending referrals/ assessments, and any open or pending requests for paperwork or school/parent input.

Deliverable: Service Provider’s Qualifications, Resume, and Certifications/Licensures. The positions under this contract are considered key personnel. The contractor shall provide the BIE with the documentation to demonstrate the proposed candidate to fulfill each position minimally meets the qualification, licensure and certification requirements. A copy of the person’s resume, certifications, licensures and a letter of commitment must be provided to the COR and CO on the day of award for each position.
Deliverable: BIE Personnel Security Intake Package for the BIE Background Check. The contractor shall provide the COR a complete BIE Personnel Security Intake Package to initiate the BIE Background Check. A BIE intake package typically includes the following required forms listed below with an *, however, the final intake package, will depend on where the individual has lived, as outlined on their Places Applicant Lived (PAL) form. Each state has different requirements. This list of forms may change once the COR receives the PAL Form. The COR will advise the contractor of any additional forms needed. A Completed Intake Package will include all intake forms including any relevant state check forms, fingerprint cards, and driver’s license (if applicable).

• The contractor will invoice BIE for services rendered monthly.
• The attachment uploaded in IPP, shall include adequate supporting documentation, including: (1) an invoice per SF 1149 and Optional Form 336, (2) timesheets signed off by the school and (3) a monthly activity status report.
o A Monthly Activity Status Report shall be a detailed informative, all-inclusive monthly status report outlining all efforts under the Contract that will contribute to the successful fulfilment of services at TDS.
• The contractor will invoice by the 5th day of each month through IPP and send a copy of the invoice and supporting documentation.
Deliverable: Final Report Requirement:
The contractor shall provide a final report to the TDS Principal and Contracting Officer Representative at the conclusion of the period of performance. This report shall summarize objectives achieved, significant issues, problems, and recommendations to improve the process in the future. In addition, the following information must be included in the Final Report:
• A narrative on work performed and progress made on all tasks levied under the resulting contract.
Including any key accomplishments.
• Recommendations on the next steps and ways to improve staffing services at TDS based on the Contract Staff’s personal experience.
• Final Costs Breakdown over the lifetime of the contract including outlining the position, total number of days worked, total costs, and billing rate per position.
14.0 TERM AND SEVERABILITY. All contract positions under this SOW are intended to be short-term, and temporary to address the staff shortages and vacancies at TDS.
14.1 GOVERNMENT. Upon TDS selecting and onboarding a permanent full-time BIE employee into the position supported by this SOW, BIE will notify the staffing firm in writing. The Contract staff person will be released of his/her duties from TDS. The contracted staff person will remain in the position for a minimum of one week to allow the transition of activities with the full-time BIE employee. This overlap is intended to allow a transition period of job activities and duties. BIE will provide a fifteen (15) day written notice when this occurs, to adequately notify the staffing firm that the SPED 1:1 Aide’s time with BIE will be coming to an end.
14.2 CONTRACTOR. The contractor will provide a fifteen (15) day written notice when a contracted staff plans to leave or vacate the contract. The current individual in the SPED 1:1 Aide position will, when able to, stay until the Contractor can identify a replacement.
