STATEMENT OF WORK

SCOPE OF WORK

1. INTRODUCTION

The mission of the Tribal Justice Support Directorate (TJS), a division within the Office of Justice Services (OJS), Bureau of Indian Affairs (BIA), Department of the Interior (DOI) is to further the development, operation, and enhancement of approximately 425 tribal justice systems and 8 Courts of Indian Offenses[footnoteRef:1]. In 1993, Congress passed the Tribal Justice Support Act, which requires TJS to conduct tribal court surveys and identify specific needs. [1: 25 U.S.C. § 3611 (a)]

2. OBJECTIVE

The scope of this effort is to provide commercial printing to produce and bind the Tribal Court Assessment reports on a repetitive basis.

3. PERIOD OF PERFORMANCE

The period of performance for this purchase order includes a Base Year plus four (4) Options Years beginning on the date of award, with annual reviews by the Contracting Officer.

4. PLACE OF PERFORMANCE

The contractor shall be located in Albuquerque, New Mexico, and who will work closely with the TJS Staff. The TJS Office is located in Albuquerque, New Mexico at the BIA Southwest Region Headquarters.

5. REQUIREMENTS

The contractor shall work closely with the TJS Tribal Court Assessment Director and the TJS Tribal Court Assessment Specialist, whose role and focus is to coordinate all TJS tribal court assessments and ensure all TJS tribal court assessments are printed and distributed to the tribe properly and timely.

The contractor must have experience working with federal government office and be able to respond to immediate and unscheduled inquires from TJS. The contractor shall be capable of producing reports in a timely fashion and make reports readily available for delivery to the TJS office. The contractor shall also be available to expedite printing of reports if needed and be readily available to communicate with TJS staff on general inquires. On occasion, at the request of TJS, the contractor may be required to ship reports directly to the respective tribe or deliver the reports to the TJS office. Any shipment cost will be the responsibility of the contractor.

6. SPECIFIC TASKS

Upon the request of the TJS office, the contractor shall print and bind 15 copies of the tribal court assessment report per printing request. An average of 60 printing requests is expected per contract year, totaling 900 individual reports (60*15) is expected per contract year.

The tribal court assessment reports shall be produced specifically to the following:

i. Printed on 32# paper with 80# paper as cover

ii. Double-sided

iii. Print in color

iv. Clear plastic cover

v. Black-vinyl back cover

vi. Coil-Binding

7. DELIVERABLES AND DELIVERY SCHEDULE

All printed reports shall be delivered to the TJS office within the next business day of completion. If delivery cannot be completed by the contractor, the contractor must immediately contact the TJS office to schedule a pick-up.

8. NOTICE REGARDING LATE DELIVERY

The contractor shall notify the COR, as soon as it becomes apparent to the contractor, that a scheduled delivery will be late. The contractor shall include in the notification the rationale for late delivery, the expected date for the delivery and the project impact of the late delivery. The COR will review the new schedule and provide guidance to the contractor. Such notification in no way limits the Government’s right to any and all rights and remedies up to and including termination.

9. QUALITY ASSURANCE AND MONITORING OF WORK DELIVERABLES

All work under this contract shall be monitored by the Program Office (TJS) or the COR, who will act as the primary technical representative of the Government. Final inspection and acceptance of all work performed, reports and other deliverables shall be performed at the place of delivery by the CO/COR.

The CO/COR, with the assistance of the other affected Project Managers, is responsible for:

· Setting task priorities, revising task priorities when necessary;

· Communicating these priorities to the contractor;

· After consultation with the Contracting Officer when appropriate, modifying delivery dates and schedules, so that the revised priorities can be met, and

· Formally assessing the level of contractor performance and ascribing the extent to which quality assurance and acceptable performance levels have been met

10. GENERAL ACCEPTANCE CRITERIA

General quality measures as set forth below shall be applied to each work product received from the contractor under this statement of work.

· Accuracy – Work Products shall be accurate in presentation, technical content, and adherence to accepted elements of style.

· Clarity – Work Products shall be clear and concise.

· Consistency to Requirements – All work products must satisfy the requirements of this statement of work.

· File Editing – All text and diagrammatic files shall be editable by the Government.

· Format – Work Products shall be submitted in in hard copy. Format shall follow the specific assessment guidance provided.

· Timeliness – Work Products shall be submitted on or before the due date specified in this statement of work or as described in assigned tasks or submitted in accordance with a later scheduled date determined by or approved by the Government.

11. ESTIMATED LEVEL OF EFFORT

12. NON-PERSONAL SERVICES:

As stated in the Federal Register, Volume 57, No. 190, page 45096, dated September 30, 1992, Policy Letter on Inherently Governmental Functions, no personal services shall be performed under this contract. All work requirements shall flow only from the Project Officer to the Contractor's Senior Project Manager. No Contractor employee shall be directly supervised by the Government. The applicable employee supervisor shall give all individual employee assignments, and daily work direction. If the Contractor believes any Government action or communication has been given that would create a personal services relationship between the Government and any Contractor employee, the Contractor shall promptly notify the Contracting Officer of this communication or action.

The Contractor shall not perform any inherently governmental actions under this contract. No Contractor employee shall hold him or herself out to be a Government employee, agent, or representative. No Contractor employee shall state orally or in writing at any time that he or she is acting on behalf of the Government. In all communications with third parties in connection with this contract, Contractor employees shall identify themselves as Contractor employees and specify the name of the company for which they work. In all communications with other Government contractors in connection with this contract, the Contractor employee shall state that he/she has no authority to, in any way, change the contract and that if the other contractor believes this communication to be a direction to change their contract, they should notify the Contracting Officer for that contract and not carry out the direction until a clarification has been issued by the Contracting Officer.

The Contractor shall insure that all its employees working on this contract are informed of the substance of this article. Nothing in this article shall limit the Government’s rights in any way under the other provisions of the contract, including those related to the Government’s right to inspect and accept the services to be performed under this contract. The substance of this article shall be included in all subcontracts at any tier.
