Section L - Instructions, Conditions and Notices to Bidders
INSTRUCTIONS FOR SUBMISSION
To be considered for award, an offeror must be determined responsible in accordance with FAR 9.1 and submit a proposal that is technically acceptable. The offeror shall submit a proposal which is comprehensive enough to provide the basis for a sound evaluation by the Government. Information provided should be precise, factual, and complete. Legibility, clarity, completeness, and responsiveness are of the utmost importance. Proposals shall remain valid for a period of at least 120 days from the due date.
Any proposal, which does not offer, at a minimum, that which is requested within this solicitation, may be determined to be substantially incomplete, and therefore unresponsive, and not warrant further evaluation or discussions. Proposals shall be sufficiently detailed to enable the Government to determine the acceptability of the proposal solely from its contents. The Government will not assume or consider anything that is not specifically addressed in the proposal. Therefore, it is incumbent upon offerors to submit proposals that are responsive to the Government's requirements and that clearly present the offeror's capabilities and offer.
The offerors proposal shall consist of four parts: 1) Technical; 2) Price; 3) Past Performance Information;
and 4) Responsibility Determination. In each section, the offeror shall provide its response to the information requested in that section. All documents submitted shall have a cover page with the identifying solicitation title, the solicitation number, volume number, volume title and name and mailing address of the offeror.
The proposal shall be emailed to the following personnel:
Lissa Ewers, Purchasing Agent Email: lissa.k.ewers.civ@army.mil
Part I Technical Part II Price Part III Past Performance Part IV Responsibility Determination
Files shall be in read-only format, using PDF electronic files. Printing should be single spaced. Each paragraph shall be separated by at least one blank line. A standard, 12-point minimum font size applies.
Arial or New Times Roman fonts are required. Tables and illustrations may use a reduced font size no less than 8-point and may be landscape. The proposals must clearly demonstrate the capability of the contractor to meet the requirements of the solicitation.

All listed characteristics must be addressed. Expected delivery schedule for the batteries must be indicated.
B. The offeror shall describe the ability to provide all listed documentation specified in the table in the Salient Characteristics in Section C.
PRICE
A. All information pertaining to price shall be confined to the price volume.
B. Review in this area is in accordance with FAR 15.404 (b) and (g), responsiveness and conformity to the solicitations requirements and FAR 15.403-1(c)(1)(i) Adequate Price Competition.
C. CLIN Pricing Format: Include the solicitation Section B schedule page, fully filled in with Firm Fixed Pricing.
PAST PERFORMANCE
Offerors shall provide narrative descriptions for up to three (3) contracts for the prime Offeror and no more than two (2) for all major subcontractors of performance during the past five (5) years from the date of issuance of the final solicitation, which are relevant to the supplies required by this solicitation. Data concerning the prime Offeror shall be provided first, followed by each of the proposed major subcontractors, in alphabetical order. The Offeror shall also submit the written consent of its major subcontractors to allow the disclosure of its subcontractor’s past performance information to the Offeror.
A “major subcontractor” is defined as a member of the Offeror’s overall team who is expected to perform 10% of the total proposed price. A “recent” contract is defined as one that is performed for at least three years during the past five years from the date of issuance of the final solicitation, which is relevant to the efforts required by this solicitation. A relevant contract is defined as having similarity of service/support, complexity, dollar value, contract type, and degree of subcontract/teaming to the effort to be acquired through this source selection.
The Government reserves the right to use alternative resources to gather past performance information.
The Government may independently obtain information from other sources, which may be used to evaluate past performance against the requirements set forth in the solicitation. Past performance information is used to assess how well the Offeror or major subcontractor(s) performed on contracts for the same or similar items and/or services as an indicator of how well they will perform the proposed requirements. Offerors with no past performance shall so state.
RESPONSIBILITY DETERMINATION
Tabbed submissions shall include the following:
a. Signed/executed page 1 of the basic RFP and all amendments.
b. Completed RFP Section K Certifications and Representations.
c. Certifications and Representations Sub-Tab - If the offeror has submitted and maintains current and complete annual certifications and representations to System for Award Management (SAM.gov), then so state. If not, include here the responses to all the clauses in the Section K portion of the solicitation.
d. Other Business Sub-Tab - On company letterhead, list the names, positions and telephone numbers, for those in the offeror's company that may negotiate terms and conditions and/or sign agreements with the government. List any restrictions the listed individual may have.
Section M - Evaluation Factors for Award
EVALUATION
The Government will evaluate all proposals for technical acceptability, then conduct a price evaluation of each. The Government intends to award a contract without discussions with offerors (except clarifications, as warranted and as described in FAR 15.306(a)). Therefore, the offerors initial proposals should contain the offerors best terms in all areas. The Government reserves the right to conduct discussions if the PCO later determines them to be necessary. The Government intends to award to one offeror on a Lowest Price Technically Acceptable basis. A rating of Unacceptable for the Technical and/or the Past Performance factor will result in elimination of the offeror for award consideration. Technical and Past Performance will be rated as follows:
Adjectival Rating Description
Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
