TECHNICAL EXHIBIT 1

Performance Requirements Summary

The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

Performance Objective (The Service required—usually a shall statement)

Standard Performance Threshold (This is the maximum error rate. It could possibly be “Zero deviation from standard”)

Method of Surveillance

PRS # 1.

The Contractor shall mix in 2 different tanks as follows:

1). Herbicide shall include Rejuvra (Indaziflam) at 5 ounces per acre including 15 gallons of water per acre Acreage 43.38.

2). Herbicide shall include Rejuvra (Indaziflam) at 5 ounces per acre AND Plateau (Imazapic) at 5 ounces acre including 15 gallons of water per acre Acreage 85.

3). The drift agent In-Place will be included in BOTH tank mixes at 1-2 ounces per acre.

The Contractor mixed herbicide as specified in the correct ratio of ounces gallon of water.

Zero deviation from standard

100% Inspection

PRS # 2

The Contractor shall apply the herbicide to the 129-acre project area.

The contractor applied the herbicide only to the target area and did not apply to areas outside of those authorized for treatment.

Zero deviation from standard

100% Inspection

PRS # 3

The Contractor shall apply herbicides before the ground is frozen and before the snow accumulates. It is important to spray herbicides within 24-48 hours prior to rainfall. The contractor only applied the herbicides on days where the wind was less than 10 mph (constant).

Contractor will follow guidelines outlined by the USFWS regarding herbicide aerial spray.

Zero deviation from standard

100% inspection

The following listing provides various types of Surveillance as examples to select from and should not be included on the final document:

Random Sampling: Appropriate for frequently recurring tasks. Evaluate randomly selected samples of the lot to determine the acceptability of the entire lot.

Random Inspection Guide, Method of surveillance, Lot size, Sample size, Performance requirement, Sampling procedure, Inspection procedure

100 Percent Inspection: Appropriate for tasks that occur infrequently. Inspect and evaluate performance each time task is performed

Periodic Surveillance: Evaluation of samples selected on other than 100% or statistically random basis.

(i.e., monthly, quarterly, semi-annually etc.)

Validated Customer Complaint: Complaints must be validated.
