About this file

This Justification for Brand Name Products document details a National Park Service (NPS) solicitation for upfitting a Ford F-150 patrol vehicle with law enforcement equipment in 2025. The NPS is seeking a contractor to purchase and install specific branded equipment, with the agency providing only the radio and radar. The justification emphasizes the need for consistent equipment across vehicles for law enforcement personnel's ease of use, efficiency, and safety. The procurement will be a competitive solicitation issued on SAM.gov, with quotes already obtained from two local small businesses: Two-Way communications Inc. and Watts Upfitting Inc.

Key procurement details include the use of commercial terms and conditions, a focus on off-the-shelf (COTS) items to potentially reduce pricing, and strict requirements for equipment installation and functionality testing. The document provides legal justification for brand-specific requirements under FAR regulations, citing the necessity of consistent law enforcement equipment and the potential risks of using alternative or inconsistent gear. The solicitation is being managed by the Nebraska Major Acquisition Buying Office, with a planned procurement value under $50,000.

NATIONAL PARK SERVICE

CONTRACTING OPERATIONS - CENTRAL

1849 C Street NW Washington, DC 20240

Justification for Brand Name Products

Date: September 2, 2025

Project: BLCA Ford F150 Patrol Vehicle Upfit 2025

1. Identifications

a. Agency: National Park Service

b. Contracting Office: Nebraska Major Acquisition Buying Office

2. Description of the action being approved:

The National Park Service (NPS) shall be soliciting for the upfitting of a law enforcement patrol vehicle with necessary equipment and accessories. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).

3. Description of supplies and services: Purchase and installation of law enforcement vehicle equipment and accessories. The contractor shall provide and install all the required equipment as listed in the SOW. The NPS will provide the Radio and Radar to be installed. The contractor shall test all installed equipment to ensure proper function and workmanship before delivery of the vehicle to NPS. The contractor shall review and demonstrate the full functionality of all equipment upon pickup of vehicle.

4. Authority:

a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.

c. FAR 6.302-1: The use of the name brand products are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

5. The description of the product’s unique qualifications or the unique nature of the acquisition:

The National Park Service (NPS) requires consistency between vehicles in law enforcement equipment for ease of use, efficiency, and safety. Additionally, NPS often reuses older equipment and has it installed in a newer replacement vehicle. Consistent installation and operation are required.

6. Efforts to obtain competition:

a. Efforts to ensure offers are solicited from as many potential sources as is practicable:

For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, sam.gov.

b. Presolicitation notice per FAR 5.2:

For acquisitions over $25,000 a pre-solicitation notice shall be posted on the Government’s Point of Entry, sam.gov unless the exception noted at FAR Part 5.202(a)(13) applies.

7. Determination that costs will be fair & reasonable:

Competitive quotes are anticipated. If there is no competition, there are several past awards for the same/similar requirements which may be used for price analysis.

8. Description of the market research conducted:

This requirement will be solicited under commercial terms and conditions. Modification of equipment is not desired as there are COTS items that meet the required specifications, which should result in lower pricing. The customer verified their requirement specifications, and obtained quotes from two different vendors, both of which have an active SAM registration.

9. Other facts supporting other than full & open competition:

a. Reason why documents suitable for full & open competition have not been developed:

The National Park Service (NPS) requires consistency between vehicles in law enforcement equipment for ease of use, efficiency, and safety. Additionally, NPS often reuses older equipment and has it installed in a newer replacement vehicle. Consistent installation and operation are required.

b. Data, estimated costs or other rationale as to the extent or harm to the Government:

Law enforcement personnel require the equipment they use to be standard/consistent for ease of use and safety.

Other equipment or inconsistent equipment could potentially cause risk to law enforcement personnel.

10. Interested Sources:

The customer obtained quotes from two local vendors with active SAM registrations; Two-Way Communications Inc and Watts Upfitting Inc. Both vendors have a small business status.

11. Actions to remove barriers to competition in the future for similar acquisitions:

N/A. This will be a competitive solicitation with some brand name requirements.

12. Certifications:

I certify that any supporting data that is the responsibility of technical or requirements personnel (i.e. verifying the Government’s minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate:
