52.252-1 Solicitation Provisions Incorporated by Reference. (FEB 1998) This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

______Technical, Project management, Past Performance, and Price__________________________________________ Technical and past performance, when combined, are equal.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

52.212-2 Addendum Evaluation of Offers Evaluation of quotes will be conducted using Simplified Acquisition Procedures, FAR Part 13 (FAR 13.106-2). The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government (best value), price and other factors considered. The following factors shall be used to evaluate offers: Technical capability, Project management past performance and Price. Submit relevant information demonstrating technical capability. These will be access based on response to questionnaire. See Submission Requirements.

EVALUATION FACTORS

1. Technical Expertise

The offer will be evaluated as to whether the vendor understands the work requirements as embodied in the SOO and their proposed approach to meeting those requirements.

2. Project Management/Schedule

The offeror will be evaluated on their ability to meet the project management requirements as set forth in the SOO, including reporting.

3. Past Performance Information

Describe the experience and capability of your organization in conducting similar work.

Provide a summary of at least three (3) similar contracts/orders performed by your organization for the last three (3) years. Include a brief description of the project, contract number, period of performance, contract amount, client identification (including agency), point of contact information (e-mail and telephone number). The contract information must be current.

Rating/Description Table

The table below demonstrates the ratings, and corresponding descriptions, which will be used by the Department to rate each offeror's technical proposal according to the Technical Evaluation Factors for this contract.

4. Rating

Blue

The offeror exceeds the requirements of the solicitation, as explained in the statement of work and proposal evaluation criteria. The offeror has proposed a superior candidate(s) and there is no question as to the offeror's ability to perform successfully. There are no deficiencies or weaknesses.

Green It appears that the offeror meets the basic requirements of the solicitation. While the proposed approach does not exceed expectations, the offeror will most likely be able to perform successfully, though minor deficiencies or weaknesses may exist. While further dialogue with the offeror may be needed, a revised proposal may not be necessary.

Yellow

The offeror may meet the requirements of the solicitation, though there are doubts as to the offeror's ability to perform successfully. In order to make their proposal fully acceptable, they would need to correct their deficiencies or weaknesses through submission of a revised proposal.

Red

The offeror fails to meet the basic requirements of the solicitation. There are so many deficiencies and weaknesses that, should the offeror be allowed to correct them, it would be tantamount to submission of a new proposal. The proposal should not be considered for award.

ADDENDUM

(6) FAR Part 13 will be utilized to accept valid quotes as per the specifications, terms and conditions of the solicitation, and the government reserves the right to review any and all quotes received, regardless of date, prior to making a final award decision.
