Case Name: SAJH Tract No. 01-159 (Canyon Tree Property) Realty Action: Acquisition

Requested Service: Appraisal and Review

Section 2: Subject of the Appraisal

Proposed Acquisition:

The National Park Service proposes to acquire 20 contiguous parcels totaling approximately 460.55 +/- acres adjacent to the English Camp Unit of San Juan Island National Historical Park. The parcels are vacant undeveloped land with timber. This is the subject property to be appraised. The subject property is part of a larger property of 67 contiguous parcels totaling 1,400.38 +/- acres.

Legal Description of Proposed Acquisition:

Parcel A is situated in Section 6, Township 35 North, Range 3 West; Parcel B is situated in Section 31, Township 36 North, Range 3 West; Parcel C is situated in Section 32, Township 36 North, range 3 West, all of which is in San Juan County, WA. Insurance Report prepared by Chicago Title Company, dated April 10, 2024 (Title Report) provided with award package.

Property Interest:

The interest to be appraised is the Fee simple estate, subject to existing easements and encumbrances as described in the 2024 Commitment for Title Insurance that will be given with the award. The appraiser must immediately notify the AVSO review appraiser of any indications of rights contrary to these described. This may result in amended instructions.

There is merchantable timber on the subject property. There must be a timber cruise completed. The appraiser must submit evidence of experience with appraising properties of this type with quote. The appraiser must submit an example of the methodology used in determining the contributory value of the timber relating to the overall value of the property. Please read the Special Instructions section later in this SOW.

The appraiser must investigate for, and promptly report, additional or inaccurate encumbrances on the property to the AVSO review appraiser. All of the title exceptions and any other recorded or unrecorded documents, conditions, agreements, easement, and encumbrances discovered during the appraisal due diligence must be identified and discussed in the appraisal report relative to their impact on value.

There is physical and legal access. The property owner will give a tour of the property to the appraiser. San Juan Island is served by Washington State Ferries, which docks in Friday Harbor. The island also has aircraft and seaplane services to Friday Harbor and Roche Harbor. A private airstrip is available at Roche Harbor.

There are several interior roads and trails on the subject property. This parcel also contains a remnant of the Old Military Spur Road. The road was constructed and used between 1850-1870 and was very important to the peace between British Royal Marines and the U.S. Army because it was used for communication, socialization, and trading. Old Military Road connects American Camp and English Camp. Built by British and American military forces, it was the first major road to cross the island. A section of road is located within the southwest part of the subject property.

2 Uniform Appraisal Standards for Federal Land Acquisitions 6th Edition, Section 1.2. 4 at page 10.

Intended Use:

To assist the client agency in its determination of the amount to be paid as just compensation for the property rights acquired or conveyed.1

Type of Value: Market Value

Definition of Market Value:

Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property.2

Effective Date:

The latter of:

a) The date of the last property inspection, or

b) The date upon which the appraiser has concluded his market research and analysis

Appraiser Instructions:

This Statement of Work is a guide to the appraiser to help identify the appraisal problem. It is not intended to limit the scope of appraisal investigations or bias the independent judgment or value opinions of the appraiser.

The selected appraiser must independently verify all information provided in this Statement of Work for reliability and subsequent use in the appraisal.

Any questions about these appraisal instructions or other technical requirements for this assignment should be addressed to the AVSO review appraiser.

There is merchantable timber on the subject property. There must be a timber cruise. Please refer to Special Instructions regarding the timber valuation. This is an acquisition of a portion of the property owner’s interest. There are 20 contiguous parcels which are part of a larger property. The appraiser must immediately notify the AVSO review appraiser of any indications of rights contrary to these described. This may result in amended instructions. The appraiser must submit an example of a similar property appraised with the methodology demonstrated for determination of the contributary value of timber to the property as a whole.

Section 4: Assignment Conditions

Applicable Standards:

USPAP

UASFLA 6th Edition

Extraordinary Assumptions:

None.

If the appraiser determines that any extraordinary assumption is required, he/she must contact the AVSO Review Appraiser.

Legal Instructions: None.

Hypothetical Conditions: None.

RFQ 140D0425Q0112

If the appraiser determines that any hypothetical conditions are required, he/she must contact the AVSO Review Appraiser to request legal instruction.

Jurisdictional Exceptions:

A jurisdictional exception to USPAP Standards Rule 1-2(c) is required for appraisals for federal acquisitions—i.e., appraisals applying the federal definition of market value—to ensure the opinion of value can be used as a reliable measure of just compensation under the Fifth Amendment to the U.S.

Constitution. Therefore, the appraiser must include the following statement:

• The appraisal was developed and the appraisal report prepared in conformance with the Appraisal Standards Board’s Uniform Standards of Professional Appraisal Practice and complies with USPAP’s Jurisdictional Exception Rule when invoked by Section 1.2. 7.2 of the Uniform Appraisal Standards for Federal Land Acquisitions.

Pre-Work Meeting:

A pre-work meeting, scheduled by the Review Appraiser at a mutually acceptable time and place, must precede the appraiser’s scope of work determination.

This meeting should include the agency, the private property owner, and/or other stakeholders, to provide transparency with respect to the process, to exchange vital information, and to assign tasks as necessary.

Property Inspection:

In compliance with applicable standards.

The appraiser will schedule the property inspection as soon as practicable, providing the review appraiser adequate notice of the date of the inspection to allow the review appraiser and a U.S. NPS representative to attend the inspection.

Contacting Landowners:

Under the Uniform Act, the owner or the owner’s designated representative must be given an opportunity to accompany the acquiring agency’s appraiser during the appraiser’s inspection of the property (UASFLA 1.2.6.4).

Larger Parcel:

The appraiser must make a larger parcel determination in every appraisal developed under these Standards (UASFLA 1.4.6 at page 24).

Special Instructions:

The appraiser must consider, as part of their bid, hiring a timber expert (if necessary) as a subcontractor to complete a check cruise and/or timber valuation as part of this assignment. The timber value methodology should be discussed with the review appraiser in advance and must adhere to the following:

The cruise methodology must be the most typical method, or combination of methods, employed in the private sector for the transaction of similar properties in the subject market area, and to produce the desired accuracy.

Merchantability limits must conform to those prevailing in the market.

Log grading standards should correspond to those most commonly relied upon in the market, in most cases the Columbia River Log Scaling and Grading Rules disseminated by the Northwest Log Rules Advisory.

Generally, the sampling error goal should be 10% or less at the 67% confidence interval (1 standard deviation for each parcel or group of parcels, depending on size, homogeneity, and other site specific factors). The post-

RFQ 140D0425Q0112

3 Uniform Appraisal Standards for Federal Land Acquisitions 6th Edition, Section 1.5.2.2, p 26.

cruise calculated sampling error of up to 15% may be acceptable for stands with a high degree of variability.

The cruise and timber valuations must include, at a minimum:

1. The cruise design

2. Road network including and required new construction

3. Timber type map

4. Harvesting restricted zones

5. Harvesting method by area

6. Stand tables

7. Gross and net volumes and the basis for the adjustment

8. Statistical analysis

9. Delivered log prices

10. Log and haul costs

11. Post-harvest required activities and costs (any RMAP obligations)

12. Whatever else is necessary to help the reader understand what was done and how the conclusions were developed.

The report should include market support, i.e. information regarding timber sales of like product classes and quality from which you are basing the unit values and arriving at market value estimates for the timber. Ideally, this information should be detailed to the point of identifying buyer/seller, date, price, acreage/volumes, location map, and sale conditions such as access, stand operability, and the contact time to remove timber.

Section 5: Additional Assignment Conditions

1. The AVSO Statement of Work (SOW), and other assignment instructions must be included in the addenda to the appraisal report.

2. The appraisal development must substantially conform to the process described in Section 1 of the Uniform Appraisal Standards for Federal Land Acquisitions 6th Edition.

3. The appraisal report should substantially conform to the sequence and content described in Section 2 of the Uniform Appraisal Standards for Federal Land Acquisitions 6th Edition.

4. The appraisal must include color photographs of all comparable sales from a terrestrial point of view, unless granted a waiver by the AVSO Review Appraiser in writing to use aerial photographs or satellite imagery, in which case the appraiser should cite the source and date of the aerial photographs.

5. All comparable sales must be confirmed by the buyer, seller, broker, or other person having knowledge of the price, terms, and conditions of sale. 2F3 The appraisal should include contact information for the party or parties relied upon to verify each sale (i.e. telephone number, email, etc.), along with maps clearly showing the location of the subject relative to the comparable property. It is important that the locations of the comparable sales

and the subject property are shown on the same map so that a reader of the report who may not be familiar with the area can understand the relative proximity of the properties and locate them in the field.3F4

6. The appraisal report will be reviewed for compliance with the Uniform Standards of Professional Appraisal Practice, the Uniform Appraisal Standards for Federal Land Acquisitions 6th Edition, and the terms of this Statement of Work. The appraiser must provide explanation, clarification, and/or modification, for any inadequacies identified by the review appraiser, before AVSO will accept an appraisal report.

7. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and Agency policy may result in the release of all or part of the appraisal report to others.

8. If the appraiser encounters any intractable questions of fact, law, or appraisal methodology requiring resolution, the appraiser must contact the Review Appraiser for direction.
