Location Quay County, New Mexico

Acreage Total Acreage to be appraised 371.74 acres

Total acreage owned 1,231.26 acres

Property Type Agricultural livestock grazing

Case Type Sale Price Approval, Retrospective Date of Value

Client U.S. Department of Interior, Appraisal and Valuation Services Office (AVSO)

Intended Users The appraisal report will be used by Bureau of Reclamation (BOR), on behalf of the United States of America.

Intended Use The appraisal report will be used by USBR on behalf of the United States in connection with the USBR Excess Land Program. The Bureau of Reclamation will use the appraisal to evaluate if the price agreed upon in a private sale of “excess land” (defined as land that is deed restricted from receiving Federal irrigation water) properly excludes the contributory value of the Federal irrigation water. The appraisal will set the maximum value and is binding on both parties. The appraisal is not intended for any other use.

Definitions Sale Price Approval is the process where excess land can be sold or transferred at a price approved by Reclamation and become non-excess in the new landowner’s landholding, if that landowner has ownership entitlement available (that is, owns a total number of acres that is less that the applicable ownership entitlement).

Excess land that is acquired without sales price approval continues to be ineligible to receive Reclamation irrigation water until action is taken to obtain the required sales price approval. 1

Additionally, all excess land that is sold or transferred at an approved price must have a covenant placed in the deed transferring the excess land to an eligible buyer

1 Fact Sheet 17 – Excess Land. Reclamation Reform Act of 1982 (RRA). May 2013. Pg. 4.

AVSO # R240003 Page 8 of 59

(a deed covenant) in order for the formerly excess land to be eligible to receive Reclamation irrigation water. The covenant (the text of which is specified in the Regulations) also specifies that:

• The future sales price of the land is restricted to a price approved by

Reclamation.

• If the buyer sells or transfers the land (for example, into a trust) prior to the expiration of the deed covenant, then a new sales price approval will be required for the new landowner in order for the land to continue to be eligible to receive Reclamation irrigation water.

• The deed covenant will be in place for 10 years from the date the land was sold or transferred from excess to non-excess status.

• Upon expiration of the deed covenant a landowner may resell the land in question at fair market value.

Acreage limitation provisions mean the ownership limitations and pricing restrictions specified in Federal reclamation law, including but not limited to, Sections 203(b), 204, and 205 of the Reclamation Reform Act of 1982 (43 U.S.C.

390aa et seq.)2

Excess land, for Reclamation purposes, is defined in regulation as “nonexempt land that is in excess of a landowner’s maximum ownership entitlement under the applicable provisions of Federal reclamation law.3

Nonexempt land is also defined in regulation and “means either irrigation land or irrigable land that is subject to the acreage limitation provisions.4

Location Access route to the subject beginning in Tucumcari, NM at State Highway 209 travel easterly on Interstate 40 about 12 miles, then take Exit 339 to State Highway 278, continuing this route about 1.5 miles arriving at the approximate northwest corner of the subject ownership. It may be necessary for owner’s representative to provide a guided tour of the various tracts of land forming the subject property.

Property Description The subject property is located about five miles slightly southeast of Tucumcari, Quay County New Mexico and about one mile south of U.S. Route 66 on the east side of State Highway 278 between Quay County Roads 62 and 61. The designated excess land comprising the subject property is 371.74 acres out of the entire ownership which recently sold involving 1,231.26 acres. The property was acquired on May 6, 2024 and is the retrospective date of valuation for the appraisal.

As a non-disclosure state, the appraiser must gather the sale price and terms from the ownership or another knowledgeable source.

There is a lake (Brissy Lake) and a county water line serving the ownership according to BOR. The appraiser must independently verify if this water source derives from the Arch Hurley Conservancy District. If so, it must not be considered in the valuation.

Current use of the subject (excess land only) is reported by BOR to be bare land to low intense agricultural uses such as grazing and possibly dry crops. The excess land is comprised of multiple individual irregular shaped parcels of land, some

AVSO # R240003 Page 10 of 59 being non-contiguous. There does not appear to be any improvements on the subject excess land parcels, although the ownership is improved with a farmstead.

The larger parcel(s) determination excludes any area outside the subject excess land, including the rest of the ownership. Please see the larger parcel section later in the SOW. Any private water source serving the excess land but excluding the Federal irrigation water shall be considered in the valuation. The applicant reports a small lake exist on the border of Sections 30 and 31 with private appropriative rights.

Legal Description The following section, township, and ranges table describe the approximate location of each tract of land comprising the excess land area as provided to the BOR by the sale-price-approval applicant. It is worth noting the individual tracts are sometimes contiguous and sometimes non-contiguous. See the documents hereby attached to this statement of work (SOW) for visual references of the excess land.

Exhibits are poor to fair quality, lacking metes and bounds descriptions. The selected appraiser must visit the Arch Hurley Conservancy District offices to view the district’s official enlarged wall map for an overview and explanation of the layout of the subject excess land. This shall be documented in the appraisal to properly identify for certainty the property appraised. The contact information for the district will be provided with the award to the selected appraiser.

It is highly recommended that a representative knowledgeable of the subject tracts accompany the appraiser during their field inspection. Following the table below I have highlighted and included two exhibits with the estimated location of subject excess land tracts within the ownership for purposes of providing a fee quote only.

The selected appraiser must independently identify and describe the subject property in the appraisal based on research and site inspection.

SECTION 2 – Appraisal Requirements & Instructions

Appraisal Standards

1. Uniform Standards of Professional Appraisal Practice (USPAP)

2. Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA)

3. If the appraiser is a member of a professional appraisal organization, the appraisal requirements of the organization or organizations of which the appraiser is a member would apply.

Applicable Law, Regulation, and Policy

Acreage limitation provisions mean the ownership limitations and pricing restrictions specified in Federal reclamation law, including but not limited to, Sections 203(b), 204, and 205 of the Reclamation Reform Act of 1982 (43 U.S.C. 390aa et seq.)5

Market Value

Market value is the amount in cash or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of the appraisal, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property. [Uniform Appraisal Standards for Federal Land Acquisitions, 6th edition, 1.2.4.]

Date of Value

The date of value is May 6, 2024, the date which Double S, L.L.C. purchased the property. This is a retrospective date of value. The appraiser must consider USPAP (2024 Edition) Competency Rule and should review Advisory Opinion 34.

Extraordinary Assumptions

None. If the appraiser determines that extraordinary assumptions are necessary for the completion of the assignment, he/she must contact the AVSO review appraiser for prior written approval.

5 43 CFR 426.2 – Definitions.

AVSO # R240003 Page 19 of 59

Hypothetical Conditions

None. If the appraiser determines that hypothetical conditions are necessary, he/she must contact the AVSO review appraiser for prior written approval.

Jurisdictional Exceptions

The appraiser has been instructed to produce a UASFLA compliant appraisal. Section 1.2.4 of UASFLA states that “appraisers should not link opinions of value under these Standards to a specific opinion of exposure time.” USPAP requires the appraiser to develop and report a reasonable exposure time if it is a component of the definition of market value, which contravenes the UASFLA. Therefore, the appraiser should invoke USPAP’s Jurisdictional Exception Rule.

Placement in Report

The appraiser must clearly identify all extraordinary assumptions, hypothetical conditions, and jurisdictional exceptions wherever the final value conclusion is stated, including the Letter of Transmittal and the Summary of Salient Facts. These must also be communicated with any General Assumptions and Limiting Conditions.

Property Inspection

The appraiser must inspect the subject property and all of the market properties used in direct comparison, unless the AVSO review appraiser has approved other conditions in writing.

Permission to enter upon and appraise the property has been granted has not been granted although the property owners are expected to cooperate. The appraiser must contact the property representative listed in the project contacts document which will be provided to the selected appraiser in the award.

You must notify in advance both the BOR realty specialist and AVSO review appraiser when the property inspection will occur.

Pre-Work Meeting

The appraiser is required to attend a pre-work conference call with the assigned AVSO review appraiser, the agency Realty Specialist and/or other agency representative, and possibly other parties. The AVSO review appraiser will coordinate the date, time & place of the meeting.

Controversies/Issues

The value requested is for a Sale Price Approval, and as such, the value reported must be reflective of the market value of the subject property with no consideration of the availability and/or use of Reclamation irrigation water (Federal water). If a Sales Comparison approach is performed, no sale comparables should be used to reflect value for the Excess Land that received Federal project water (unless supported adjustments are made). Comparable sales should have irrigation water delivery systems that are the same

AVSO # R240003 Page 20 of 59 or comparable to the subject (same or similar water delivery costs). If an Income approach is applied, the costs should reflect the actual costs to provide water on the subject, and if a Cost Approach is applied, the costs should reflect the costs for infrastructure to deliver water as currently in place.

A detailed examination of water sources in the subject neighborhood and sales, as well as their impact on value/price is expected as part of the analysis.

Should the appraiser identify additional controversies or issues during the course of assignment, he/she must immediately notify the AVSO review appraiser.

Legal Instructions

None.

Special Appraisal Instructions

1. Even though communication is encouraged with the property owner and the client agency, only the assigned AVSO review appraiser can modify appraisal instructions (in writing).

2. The appraiser may not communicate assignment results to any party except AVSO until authorized to do so in writing by AVSO.

3. Any communication (verbal or written) with the agency realty contact shall include the assigned AVSO review appraiser.

4. The purpose of this appraisal is for sales price approval. During the description and analysis of the Sale and Comparable Properties, care should be given to include well developed analyses of water sources and their impact on value.

General Appraisal Requirements & Instructions

1. The appraiser must hold a valid license as a Certified General Appraiser for the jurisdiction in which the subject property is located. (Valid credentials include those obtained directly from the jurisdiction, those issued under a reciprocity agreement, and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes.)

2. The AVSO Statement of Work, other assignment instructions and engagement letter must be included within the addenda to the appraisal report.

3. All appraisals complying with UASFLA must conform to the sequence and content outlined in UASFLA, Appendix A, B, C and D).

AVSO # R240003 Page 21 of 59

4. UASFLA (Page 56) states that a report prepared in accordance with UASFLA Sections 2.3, 2.4, and

2.5 is consistent with and/or exceed the requirements for an appraisal report under Standard 2 of

USPAP.

5. The appraiser must appraise the subject property in its “as is” condition unless authorized in writing by the AVSO review appraiser to do otherwise.

6. Color photographs and maps of comparable properties shall be included in the appraisal report. AVSO will accept aerial photographs for comparable properties, unless the aerial photographs do not accurately represent the property as of the date of inspection. The appraiser must photograph any unusual property features from the ground.

7. The appraisal report will be reviewed for compliance with the terms of this Statement of Work

(including all cited standards). Any findings of inadequacy will require clarification and/or correction.

8. The appraiser shall consider the appraisal report and all DOI internal documents furnished to the appraiser to be confidential. Refer all requests for information concerning the appraisal to the AVSO review appraiser.

9. AVSO will not normally accept custody of confidential information. Should appraiser find it necessary to rely on confidential information, he/she will contact the AVSO review appraiser for instructions.

The review appraiser will view the information and provide further instruction to the appraiser regarding handling and storage of the confidential information.

10. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and agency policy may result in the release of all or part of the appraisal report to others.

11. If including any proprietary information in the appraisal, appraiser must gain concurrence from AVSO review appraiser and deliver the proprietary information in a separate binder.

12. When the appraiser has performed any services regarding the subject property within the three prior years, he/she must disclose this in the bid proposal.

13. An adjustment grid must be provided that is directly correlated to the narrative analysis provided in the appraisal document prepared under this SOW.
