Introduction:
AQD is a Federal Franchise Fund Contracting Office that operates under the authority of the Government Management Reform Act, as amended. AQD provides contracting support to all Federal Agencies and the Department of Defense. AQD will handle the solicitation, award, contract administration, and invoice payments for this requirement.
AQD is issuing this competitive RFQ on behalf of Indian Health Service (IHS) for the purpose of awarding a single contract after receipt and evaluation of all quotes. This RFQ a small business set-aside.
AQD will conduct this acquisition using Federal Acquisition Regulation (FAR) 13.
All interested small businesses within SAM.gov shall submit a response in accordance with the following instructions. The Government reserves the right to cancel this solicitation without award if the needs of the requirement are not met. Furthermore, the Government reserves the right to make a partial award, multiple awards, or award no contract at all, depending on the quality of the quotes, the availability of funding, and the continued existence of the requirement.
This RFQ does not commit the Government to pay for the preparation and submission of an offer.

1. PERIOD OF PERFORMANCE:
The anticipated period of performance for this requirement is one (1) base year of 12 months, and four (4) option years of 12 months each, for a total of five (5) years.
2. SPECIFIC REQUIREMENTS:
See Attachment 1 – Statement of Objectives (SOO), Attachment 2 – Performance Work Statement (PWS) template, and Attachment 3 - Pricing Spreadsheet
3. CONTRACT TYPE:
This requirement is Firm-Fixed Price (FFP).
4. RESPONSE DUE DATE AND QUESTIONS:
Questions are due on July 17, 2024 no later than 12:00 PM Noon Eastern Time. Identify the RFQ number 140D0424Q0553 in your subject line. Questions shall be submitted via email to the Contracting Officer at sara_proffitt@ibc.doi.gov.
The Government requests a quote in response to the attached documents. Please submit an offer via email to sara_proffitt@ibc.doi.gov with required attachments listed in Section 5 by July 31, 2024 no later than 12:00 PM Noon Eastern Time.
5. FORMAT FOR SUBMISSION:
All correspondence must have “RFQ 140D0424Q0553” in the submission and include all required attachments for Volume 1 and Volume 2 listed below.
*Note: Narrative shall be double-spaced with 12-point font style. Cover pages, acronym lists, and other introductory pages do not count against the page limit.
Quoters shall submit two separate volumes: Volume I – Technical and Volume II – Price. No cost or price information shall be included in Volume I - Technical.

6. REQUIRED COMPONENTS OF EACH VOLUME AND SECTION
Volume I: Technical Proposal Instructions:
Section 1: General
This section shall include a cover and title page. This cover sheet must only include the information listed below numbered 1-18.
Any introductory language that describes the nature of the Quoter, its history, its achievements, or its areas of specialization may be included in this section.

Section 2: SAM Registration
This section shall include evidence of the Quoter’s current System of Award Management (SAM) database registration (http://www.sam.gov). A screenshot of the Quoter’s SAM registration page is acceptable evidence. An active SAM registration is required at the time of quote submission, at the time of award, and through final payment under any awarded contract. If an Quoter’s SAM account will expire before the award date, it is the Quoter’s responsibility to ensure that its account is active at time of award.
Section 3: Representations and Certifications
This solicitation contains the following provisions that the Quoter must complete and return with its quote (see Section 8 of this RFQ for each provision in its full text):

Section 4: Technical Assumptions
The Quoter shall indicate, in this section only, if any technical-related assumptions have been made, conditions have been stipulated or exceptions have been taken with the SOO, as written. If technical assumptions are not noted in this volume and this section of the quote, it will be assumed that the Quoter’s quote reflects no technical assumptions for award and the Quoter agrees to comply with all the terms and conditions set forth herein.
Any technical-related assumptions listed in any other volume or section shall be null and void.
Section 5: Technical Quote/PWS
Quoters shall provide the following information in their technical proposals in response to the IHS SOO for EAMS. Listed in the SOO, those labeled Threshold (T) represent the minimal capabilities the vendor must meet to be considered viable for this acquisition.
Those labeled Objective (O) represent the Government’s desired capabilities for a solution that would meet all current and anticipated future needs. Quoter’s technical quotes must include a discussion of each factor outlined below:
Factor A: Threshold (T) Capabilities and Use Cases Those labeled Threshold (T) represent the minimal capabilities the vendor must meet to be considered viable for this acquisition. The Quoter shall provide a narrative on how it plans to meet all the threshold capabilities for each category within their technical quote, providing sufficient scope and detail to ensure confidence that all of the described elements will be fully addressed. The Quoter shall also provide narratives on how their solution will support each of the Use Cases listed in the SOO Section 5.5, Table 5, as part of their technical quote.
Quoters who do not sufficiently address all the threshold capabilities within their technical quote and PWS will be rated lower than those that do address all the threshold capabilities.
Factor B: Objective (O) Capabilities Those labeled as Objective (O) represent the Government’s desired capabilities for a solution that would meet all current and anticipated future needs. The Quoter shall provide a narrative on how it plans to meet as many or all of the objective capabilities listed in the SOO for each category within their technical quote.
Quoters who provide more of the objective capabilities within their technical quote and PWS will be rated higher than those that address fewer of the objective capabilities.
PWS:
In addition to the narrative, Quoters shall submit a PWS using the template provided (See Attachment 2 – PWS Template). The Quoter’s PWS shall describe how their solution will meet all of the Threshold and as many or all of the Objective Capabilities listed in Attachment 1 –SOO. This includes describing the proposed tasks for each capability and including the deliverables listed the SOO.
Volume II: Price Quote Instructions:
Section 1: Price Assumptions
The Quoter shall indicate, in this section only, if any price-related assumptions have been made, conditions have been stipulated or exceptions have been taken with the SOO as written. If not noted in this volume of the quote, it will be assumed that the Quoter’s quote reflects no price assumptions for award and agrees to comply with all of the terms and conditions set forth herein. It is not the responsibility of the Government to seek out and identify assumptions, conditions, deviations, or exceptions buried within the Quoter’s quote. Accordingly, any price-related assumptions listed in any other volume or section shall be null and void.
Section 2: Price Quote
To assist Quoter in providing conforming price quotations and to promote standardization across submissions, the Government has provided a Pricing Spreadsheet (Attachment 3) that shall be used by the Quoter. The price quotations shall include totals and subtotals for all columns and rows of data.
o Quoters shall leave the Pricing Spreadsheet as an Excel spreadsheet when submitting their price quotation. Failure to use the Excel spreadsheet as provided with the associated formulas may be viewed as unacceptable and the Quoter may be removed from consideration for award. The submitted spreadsheet shall not be locked.
The Government requests discounts. If a discount is provided, Quoter shall indicate the non-discounted rates, the proposed percentage of discount, and the discounted rate on the pricing sheet. This information (i.e., the non-discounted rates and the proposed percentage of discount) will be used to determine price fair and reasonableness. To assist with determining pricing fair and reasonable.
7. BASIS FOR AWARD
It is the Government’s intent to award a single standalone contract using the source selection procedures found in FAR 13, to the responsible Quoter whose quote, in conforming to the RFQ, provides the overall best value to the Government considering technical factors and price. The evaluation will be based on the demonstrated capabilities of the prospective quoters in relation to the needs of the project as set forth in the RFQ and the SOO. Each quote must document the feasibility of successful implementation of the requirements of the RFQ and the SOO.
The CO, as the source selection authority, will utilize a best value trade-off methodology, non-price factors, when combined, are significantly more important than price. The Government reserves the right to make an award to other than the lowest priced Quoter if another superior technical submission, or a submission indicating a reduced performance risk, warrants paying a premium.
The Quoter’s submission will be evaluated in accordance with the following evaluation criteria.

The rating definitions identified below will be used for the evaluation of Evaluation Factors A and B:
High Confidence The quote demonstrates a high understanding of the requirement and meets all of the threshold capabilities and most, if not all, of the objective capabilities listed in the SOO. The quote demonstrates ability to successfully perform most, if not all, of the use cases. The quote demonstrates a solution that results in high confidence in the performance and usefulness of the tool.
Moderate Confidence The quote demonstrates a moderate understanding of the requirement and meets the majority of the threshold capabilities and majority of the objective capabilities listed in the SOO. The quote demonstrates ability to successfully perform the majority of the use cases. The quote demonstrates a solution that results in moderate confidence in the performance and usefulness of the tool.
Low Confidence The quote demonstrates a low understanding of the requirement and meets less than the majority, or none, of the threshold capabilities listed in the SOO. The quote meets less than the majority, or none, of the objective capabilities listed in the SOO. The quote demonstrates ability to successfully perform less than the majority of the use cases.
The quote demonstrates a solution that results in low confidence in the performance and usefulness of the tool.
Factor A – Threshold (T) Capabilities The Government will evaluate whether the Quoter’s proposed methods and techniques, including proven tools and processes will enable the successful performance of the SOO threshold capabilities. The evaluation will be based on the following sub-factors, which are all of equal importance:
Factor A, Sub-Factor 1: Software Functional Capabilities (SOO Section 5.1, Table 1, Threshold Capabilities) The Government will evaluate whether the Quoter’s technical response and PWS:
Demonstrates the software provides a vendor-specific development process for Enterprise Architecture using a specified framework, e.g., Unified Architecture Framework (UAF), and a system modeling language (SysML) that may be used as an option by IHS developers. The software will not preclude or hamper IHS developers’ ability to use their own development process in addition to the vendor-specific process. (F-1)
Demonstrates the software supports development using the Business Process Modeling Notation (BPMN). (F-9)
Demonstrates the software enables custom extensions to architecture frameworks to support IHS development processes. (F-12)
Demonstrates the software enables custom extensions to modeling languages to support IHS development processes. (F-13)
Demonstrates the development environment supports ten (10) developers working on the same model in a shared environment. (F-17)
Demonstrates the development environment provides the means for reviewers who are not experts in EA development to review models and other data and provide comments, and for these comments to be traced and actionable by developers. (F-18)
Demonstrates the software supports requirements development and management. (F-21)
Factor A, Sub-Factor 2: Security Capabilities (SOO Section 5.2, Table 2, Threshold Capabilities) The Government will evaluate whether the Quoter’s technical response and PWS:
Demonstrates the development environment provides protection of IHS sensitive data in accordance with Part 10 of the Indian Health Manual. (https://www.ihs.gov/ihm/pc/part- 10/) (S-1)

Demonstrates for server-side data and model management tasks, the administrator will be able to restrict access to models/data based on the user’s role. (S-3)
Demonstrates the software minimum user identity and access control method permissible is individual username and password that can be assigned to authorization groups. (S-4)
Demonstrates how the vendor will provide all documentation (e.g., data, test results, proof of control compliance) needed to support an Authority to Operate (ATO) decision, and if configuration changes are needed to achieve ATO, how the vendor will make such changes and provide evidence of those changes. Demonstrates whether the development environment is cloud-based Software as a Service (SaaS) and whether it is FedRAMP-Moderate certified. (S-6)
Demonstrates whether the development environment is installed on-prem (on customer’s physical, virtual, or cloud-based servers) and requires an external network connection, and provided a description of all such communications methods and content shall be provided. (S-7)
Factor A, Sub-Factor 3: Technical Capabilities (SOO Section 5.3, Table 3, Threshold
The Government will evaluate whether the Quoter’s technical response and PWS:
Demonstrates the software supports server-side models, and data management provide a central repository accessible by client and virtual development environments. (T-3)
Demonstrates the license will be locally managed, with all licenses available to users on the local network. (T-4)
Demonstrates for both client/server and virtual/cloud applications, the software will allow the use of floating licenses. (T-5)
Demonstrates the development environment will be installable and accessible to users through a Virtual Machine (VM) or similar virtualization environment. (T-6)
Demonstrates the software supports the import, export, and discovery of data using Open Services for Lifecycle Collaboration (OLSC) and the Representational State Transfer (REST) application program interface (API). (T-7)
Demonstrates the software provides support for working with very large data (greater than 10,000 unique data elements) with multiple linkages between data elements. (T-8)
Demonstrates the development environment provides the capability for 10 users to concurrently execute development work. (T-9)
Demonstrates the software supports configuration management of data elements, e.g., a specific requirement object, and of information/models built from these data elements, e.g., a SysML Requirements Diagram. Elements placed under configuration management can be restricted from being changed. (T-16)
Demonstrates the software supports the development and configuration of model baselines. Each baseline will include model views and related data as specified by the developer. Elements placed within a baseline can be restricted from being changed. (T- 17)
Demonstrates the software supports versioning at the EA model level, encompassing all baselines and other configuration-managed data contained within that model. The software captures version author(s) and change notes. This capability will allow model-level excursions or branches that can be merged at the discretion of the developers. (T- 18)
Demonstrates the software supports the export of selected model views and underlying data into common office automation formats (e.g., Microsoft Word, Microsoft Excel, Google Docs, and Google Slides) using built-in templates and scripts. IHS developers shall be able to modify these templates and scripts as required. (T-19)
Demonstrates the software supports the export of selected model views and underlying data into common dashboards (e.g., Qlik, Tableau, Power BI) and hosted web locations (e.g., WordPress site, SharePoint site), using built-in templates and scripts. IHS developers shall be able to modify these templates and scripts as required. (T-20)
Demonstrates the software provides a means to write queries and print reports based on returned elements. (T-21)
Demonstrates the software provides the ability to search for modeling elements across models and indicate to the user where search elements were found. (T-22)
Factor A, Sub-Factor 4: Training Capabilities (SOO Section 5.4, Table 4, Threshold
The Government will evaluate whether the Quoter’s technical response and PWS:

Factor A, Sub-Factor 5: Program Use Cases (SOO Section 5.5, Table 5) The Government will evaluate whether the Quoter’s technical response and PWS:
Demonstrates that multiple, geographically dispersed developers can work concurrently on the same model. (UC-1)
Demonstrates that developers can present a sample patient case management business process traced to the underlying IT services and system, inclusive of cost and schedule perspectives. And demonstrated that developers can present this information to leaders in a format that allows them to make informed decisions. (UC-2)
Demonstrates that a facilitator can generate views for use during a working session with experts, which can be used to capture real-time feedback. And demonstrated that an expert can provide written and graphical feedback on models and explain data elements from a remote location without having to be an expert in the EA tool itself. (UC-3)
Demonstrates that the software supports building a baseline that contains many different views and data and the capability to trace this baseline to a previous baseline. (UC-4)
Demonstrates the software’s ability to import a model developed in the UAF framework, using both BPMN and SysML languages, from a different tool into the vendor’s tool.

Demonstrates the software’s ability to link model data from the vendor's tool to the matching data in an external data source and described limitations. (UC-6)

Factor C - Price: This contract will be priced on an FFP basis. In addition to comparing the total price between received quotes, the Contracting Officer will be evaluating to ensure prices quoted are fair and reasonable to the Government.
When evaluating price, the Government reserves the right to de-conflict or correct situations involving clerical errors, minor mathematical errors, rounding discrepancies or obvious misplacement of decimal points where there is a negligible impact on price.
The Government may reject any quote evaluated to be significantly non-compliant with the solicitation requirements, unreasonably high in price, or reflects a failure to comprehend the complexity and risks of the work to be performed. The Government reserves the right to stop evaluating a quote if any part of the Quoter’s submission is considered to be unacceptable.
Should the Quoter’s submission be found to have an unacceptable technical submission in any area, the submission may be considered to be unacceptable to meet the Government’s objectives as a whole. If the evaluation is stopped, the Quoter will no longer be considered for award.
The Government may award without discussions, while reserving the right to conduct discussions if the Government determines such is in its best interest. Therefore, each Quoter should recognize that its initial price and technical proposal may be used as the sole and final basis for award and should submit accordingly. Additionally, the Government reserves the right to award no contract at all, depending on the quality of the quotes, the availability of funding, and the continued existence of the requirement.
The Government reserves the right to validate the accuracy of statements made in the quotes.
The Technical Evaluation Committee (TEC) reserves the right to revise its technical consensus of a quote based on information within the Price Volume when the TEC determines that content within the Price Volume will have an impact on the technical evaluation factors or sub-factors.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment. (Nov 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(d) Representation. The Offeror represents that—
(1) It □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that— It □ does, □ does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.
(e) Disclosures.
(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number;
and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—

(a) Definitions. As used in this provision, "covered telecommunications equipment or services" and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(c)
(1) Representation. The Offeror represents that it □ does, □ does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.

FAR 52.212-3 – Offeror Representations and Certifications – Commercial Products and Commercial Services (May 2024) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision— Covered telecommunications equipment or services has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
Forced or indentured child labor means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror.
Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
Manufactured end product means any end product in product and service codes (PSCs) 1000- 9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.
Reasonable inquiry has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended."Sensitive technology"— Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3)of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business (SDVOSB) concern means a small business concern— (1)
(i) Not less than 51 percent of which is owned and controlled by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran; or
(2) A small business concern eligible under the SDVOSB Program in accordance with 13 CFR part 128 (see subpart 19.14).
(3) Service-disabled veteran, as used in this definition, means a veteran as defined in 38 U.S.C. 101(2), with a disability that is service connected, as defined in 38 U.S.C. 101(16), and who is registered in the Beneficiary Identification and Records Locator Subsystem, or successor system that is maintained by the Department of Veterans Affairs’ Veterans Benefits Administration, as a service-disabled veteran.
Service-disabled veteran-owned small business (SDVOSB) concern eligible under the SDVOSB Program means an SDVOSB concern that—
(1) Effective January 1, 2024, is designated in the System for Award Management (SAM) as certified by the Small Business Administration (SBA) in accordance with 13 CFR 128.300; or
(2) Has represented that it is an SDVOSB concern in SAM and submitted a complete application for certification to SBA on or before December 31, 2023.
Service-disabled veteran-owned small business (SDVOSB) Program means a program that authorizes contracting officers to limit competition, including award on a sole-source basis, to SDVOSB concerns eligible under the SDVOSB Program.
Small business concern—
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
Small disadvantaged business concern, consistent with 13 CFR 124.1001, means a small business concern under the size standard applicable to the acquisition, that—
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—
(i) One or more socially disadvantaged (as defined at13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States;
