DIAGNOSTICIAN SERVICES, TAOS

I. STATEMENT OF WORK

The diagnostician provides work that relates to cognitive and academic functioning. The diagnostician will be required to be present at all initial evaluations of special needs students, including Gifted and Talented. The diagnostician will be licensed to administer standardized cognitive achievement tests such as, but not limited to the WISCV, KTEA, KABC, WAIS, WRAT, or any other deemed necessary to determine present levels of performance. The diagnostician will work with special education personnel to assure that the student receives proper placement and services. The diagnostician will be versed in the Individual with Disabilities Act, and act in accordance with its protocols for assessment. The diagnostician will utilize social checklists to determine the presence of emotional factors that may be impeding the student’s learning process. The diagnostician will attend Multi-disciplinary Team Meetings either virtually, or in person.

Diagnosticians assure the usage of the most current updated standards, testing standards and protocols. The Diagnostician will meet with parents’ pre-evaluation.

The diagnostician will help determine through the IEP process placement and therapy needs of the student. Due to the uniqueness of the student population at Taos Day School, understanding of cultural and traditional norms of Native Students on Taos Pueblo is imperative. An understanding of the local area and its unique impact on student learning is essential for the contractor to understand. There are approximately 6-8 new referrals a year, as well as about 5 or 6 re-evaluations. An estimated 12 evaluation and reevaluations.

II. WORK REQUIREMENTS

After being provided a copy of the parental permission form for assessment by the school, the contractor shall:

A. Complete a comprehensive review and summarize the following records provided by the local education agency for each child referred to for assessment (there will be times when the information is not available - pertinent to the processing of diagnostician.

a. All data (contained within the students, confidential file) collected up to the time of the receipt, by the contractor, of the referral, including:

i. Psycho-educational evaluations/development assessment

ii. Available education history, attendance (ratio to days in and out) and achievement records

iii. Available regular class teacher comments (or interview include:)

1. A description of the child’s academic performance limitations that seem to inhibit learning

2. A general rational for referral to special education

3. Copies of any pertinent medical information

B. Complete evaluation and assessment according to laws regarding minority non-discriminatory practices. a. IDEA requires that procedures developed for the purpose of evaluation and placement of children with disabilities will not be racially or culturally discriminatory. Such materials or procedures shall be provided and administered in the child’s language or mode of communication unless it is clearly not feasible to do so and no

Diagnostic Services 2 A single instrument of educational diagnostic tests shall be the sole criteria for determining the appropriate education program for a child. New Mexico state testing criteria shall be followed, and all nationally mandated educational diagnostic testing protocols shall be followed.

b. The examiner under contract shall consider the following adaptations:

i. Interpreter in the native language should be sought, when necessary,

ii. The contractor (professional examiner) must be available to perform the services specified herein with the hours of 8:00 am – 4:30 pm or as needed. Some diagnostic evaluations can be done on weekends (Saturdays/Sundays) or on holidays (national/federal or on tribal festivity days).

iii. The contractor (professional examiner) will provide reports within two weeks of examination date. The reports are to be hand delivered or mailed to Taos Day School including the protocols, if used. No requests shall be made for typing said reports to the school. All such reports should clearly be labeled or marked

“CONFIDENTIAL”

iv. Taos Day School staff will be expected to comply with requests for completion of the necessary referral data, in the interest of providing the information necessary for the completion of the most appropriate evaluation of terms of the laws regarding disabled students.

v. In regard to regular evaluations, the contractor will be expected to meet with all students qualifying for diagnostician services according to IDEA and each student’s IEP as needed.

vii. The contractor is also required to log in and out of the school site and to schedule herself/himself for each individual child’s IEP committee meeting at the school’s request. Weekly schedules shall be approved by the school’s special education coordinator.

A. During which time the contractor will be available to meet with close family members to discuss those issues, problems or concerns which are pertinent to or impact on the progress of the student within the school environment. Such session will occur as time scheduling allows so that such session do not reduce the therapy time of students placed to receive therapy. These meetings will be scheduled based on the willingness of family members to participate voluntarily and with consultation with the contractor.

a. The contractor will be expected to sign in and keep a log regarding the actual duration of diagnostic testing of an individual.

b. The contractor will maintain a mileage log for each trip.

c. The contractor will be paid for diagnostic services monthly. Invoices shall be submitted by the contractor directly to the contracting office and school serviced.

C. Maintain records of work performed for monthly invoicing

I III. EVALUATION REPORT OF PROGRAM EVALUATION

All reports contain all necessary information required to remain in compliance with any and all pertinent regulations mandated by Federal or State Laws including IDEA and the Taos Day School Equalization Program’s guidelines and criteria.

In addition, the completion of motor evaluation, the contractor shall:

A. The contractor shall be present at IEP/multidisciplinary placement team meeting to develop individual goals and objectives for each student to whom diagnostic is provided. The goals and objectives must be a part of each student’s

IEP,

B. Establish a rapport with client and assess any needs or accommodations that the student may need during defined diagnostic session.

I IV. CONFIDENTIALITY

All materials furnished or produced by the contractor under this agreement, including but not limited, to documents, reports, and correspondence will remain CONFIDENTIAL. The contractor shall not release information to any persons, group of persons, firm or organizations other than the Bureau of Indian Education, Taos Day School with information related to work performed, research or information derived from work performed under this agreement.

Breach of confidentiality shall be denied substantial breach of this agreement and may be grounds for rescission.

Qualification:

Experience, Education and Licensure/Certification

• Current New Mexico Level Three Pre K-8 Educational Diagnostician Licensure

• Master’s Degree

• Experience working with school age children, staff, parents/guardians, native population (Preferred)

Deliverable: Diagnostician Qualifications, education and certifications. The position of Diagnostician is considered key personnel. The contractor shall provide the BIE with the documentation to demonstrate the Diagnostician candidate(s) minimally meets the qualification, education, licensure and certification requirements outlined in the experience, education and licensure/certification section of the SOW. A copy of the person’s resume, degree, certifications, licensures and a letter of commitment must be provided to the COR and CO on the day of award or replacement of key personnel.

Contractor Request for Removal/Replacement

The following conditions for removal or replacements of the individual in the position of the Diagnostician shall be followed:

1. The contractor shall request government pre-approval to substitute or replace the individual.

2. At least 30 days prior to the contractor voluntarily diverting or replacing the individual, the contractor shall notify the Contracting Officer Representative, Contracting Officer in writing, and the SFPES Principal.

3. The contractor shall submit a justification for the diversion or replacement and a request to replace the individual.

a. The diversion or replacement must be mutually agreed upon between the Contracting Officer and the Contractor, before the existing individual vacates the position and leaves the contract.

b. The written request for pre-approval by the contractor shall identify the proposed replacement and provide an explanation for how the requested substitutes or replacements’ qualifications, experience and professional certifications are at least equal to or greater than the original candidate provided by the contractor under this contract. The Contractor shall submit justification (including proposed substitutions) in sufficient detail to permit evaluation of newly assigned contract candidate(s).

c. A copy of the proposed candidate’s resume, degree(s), certification(s), licensure(s) and a letter of commitment must be submitted with the written justification.

4. If the individual is terminated by the Contractor for cause or separates from the contractor voluntarily with less than thirty-day notice, the Contractor shall provide notice to the Contracting Officer Representative and Contracting Officer within 2 business days of this action.

5. If the individual is terminated or suspended by the Agency for cause the contractor will provide replacement key personal within 15 days after notice of termination or suspension.

6. When feasible, the individual shall commit to staying and continuing services under the contract for a minimum amount of time that allows for (1) the replacement to receive Pre-Employment clearance from the Personnel Security Branch and (2) a transition plan to be created that outlines the transition of services and activities between the existing Diagnostician, the new Diagnostician.

7. Key personnel requirement is for On-Site services for San Felipe Pueblo Elementary School. Virtual service is NOT an option. If virtual services become an option for key personnel, Contractor is to find replacement key personnel within 15 days and school will not accommodate virtual services.
