STATEMENT OF WORK
1.0 GENERAL
1.1 Introduction
1.1.1 The Medford District, Bureau of Land Management (BLM) is contracting for land treatment services as an integrated approach to young stand management. Project areas are located within the Ashland, Butte Falls, and Grants Pass Field Offices in Jackson, Josephine, Douglas, Curry, and Coos Counties, Oregon.
1.1.2 Treatments to be performed are Pre-commercial Thinning, Hardwood Spacing, and Brushing.
1.1.3 The performance period for the base contract shall be for one (1) year, its term commencing October 01, 2022, and ending September 30, 2023. At the end of the performance period for the Base contract there will be an option to include one (1) additional one-year option period that may extend the contract up to September 30, 2024.
1.2 Historical Background The project areas are reforestation units that are the result of past timber harvest or wildfires. The vegetation to be treated will be the young understory, generally less than 25 years old.
Some units may be very dense with conifers, hardwoods, or brush on slopes ranging from 0-70 %.
1.3 Need for Treatment Scientific research and empirical data supports the concept that overstocked stand conditions do increase competition for water, light, and soil nutrients amongst individual trees. Past plantings, natural seedlings, and germinating brush along with resprouting established hardwoods have in many places created stand conditions where there is too much vegetation. These areas would benefit from a brushing and/or thinning treatment. Brushing and thinning treatments would reduce the amount of competitive vegetation. Conifer survival, growth, and overall vigor would be improved. Brushing and thinning treatments also provide an opportunity to select species and individuals most appropriate for the site.
1.4 Applicable Directives for Project - The proposed project work shall be done in accordance with the Southwest Oregon Record of Decision and approved Resource Management Plan: Medford District, Lakeview District, and Roseburg District- August 2016.
1.5 Environmental Conditions- Weather conditions in the Medford District may include snow through April which may lead to road closures due to snow. Additional time has been added to the contract to cover these closures. There may also be work restrictions and closures during fire season. A Contractor may start in one area and be moved to another area should a closure occur. The performance time is wide enough to cover these circumstances.
1.6 Description of Work—below is a summary of the work to be done for each bid item. The specifics are given in Section C.5.0.
Item 1 – 100% Maintenance Brushing without conifer spacing.
Item 2 –Conifer Spacing 14’ x 14’ with 100% Maintenance Brushing.
1.7 Some project units may contain wire wickets from previous tubing or shading treatments. The wire wickets may pose a safety hazard and could cause damage to equipment. A slower work rate may be necessary. If wire wickets are encountered in a unit, the Contractor shall notify the COR before additional work is completed.
1.8 Boundaries - Boundaries are marked with yellow and/or orange flagging on unit boundaries and yellow and/or blue flagging on property lines or are bounded by existing roads.
SOLICITATION NO. 140L4322Q0116
1.9 Access to Project Areas
1.9.1 Motor vehicles shall only be driven on existing roads.
1.9.2 Access will be by both gravel roads (improved) and natural surfaced roads (unimproved) and may require four-wheel drive vehicles. Standard access will include up to 0.5 mile from the closest drivable road to the unit boundary.
1.9.3 Road use on unimproved roads will be restricted to the dry season conditions (typically May 1 through October 31). These roads may be restricted from use during this period if a precipitation event should occur that would cause unacceptable road damage from motor vehicles driving on them. Also, these roads could be used outside this time if no precipitation occurs for a long enough time to allow the roads to dry out enough to sustain motor vehicle use without unacceptable damage. These exceptions will be determined by the Contracting Officer’s Representative (COR).
1.9.4 If the Contractor desires to access the units by foot or by roads across private land, the Contractor shall first obtain written permission from the landowner.
1.9.5 Road Gates
a. Access behind locked gates shall be for the purpose of conducting work under this contract only.
Gates with locks shall be locked immediately after entry or exit by the Contractor for each project unit. Keys may be issued to the Contractor by the COR at the BLM, Medford District Office.
Supplying the Contractor a key for access is at the discretion of the COR. Gate keys shall be returned to the COR within five (5) days after completing the work for units requiring gate keys for locks . A charge of $50.00 will be assessed for each gate key not returned in a usable condition and will be deducted from the final payment for the Contract.
b. When two or more locks are present on a gate, the Contractor shall secure the lock so that access is not restricted nor prevent the unlocking of other locks on the gate.

SECTION E – INSPECTION AND ACCEPTANCE
9.0 INSPECTION
9.1 The Government will make periodic inspections while work is in progress to assure that work is proceeding satisfactorily. These inspections will initially be done daily to address questions the Contractor may have and to provide recommendations for improving work quality. Once a satisfactory work pattern is established, the periodic work inspections will begin. The time between inspections will depend upon the production rate and work quality of the Contractor. Inspection for acceptance will be accomplished by a visual or plot inspection of each unit and will be based on adherence to the specifications. Work quality determined to be 90% or greater will be considered acceptable.
If a visual inspection is used initially and it indicates that work quality appears unacceptable, then a formal plot inspection will be used to determine if the specifications have been met.
9.2 Inspections conducted using plots will be made on a series of 1/55.5 acre plots (15.8-foot radius) and located at predetermined intervals across each work unit. Sufficient plots will be taken to obtain at least a one (1) percent sample of the work unit. This is equivalent of one plot per two (2) acres.
9.3 Items 1 and 2 - plot inspection
9.3.1 Each plot will be inspected for compliance with the specifications listed in sections 5.0 through 7.0.
9.3.2 Each plot will be broken up into 4 quadrants: NW, NE, SW, and SE.
9.3.3 Each quadrant satisfactorily treated is awarded 1 point.
9.3.4 Unsatisfactory quadrants receive 0 points.
9.3.5 See Form- 2 Brushing/ PCT Inspection Instructions.
9.4 Work Quality Percentage (WQP)
a. The WQP is derived from data developed from inspection plots on an individual unit basis.
b. The WQP will be determined by dividing the total number of satisfactorily treated inspection quadrants by the total number of quadrants inspected from all plots in the entire unit. This result multiplied by 100 is the WQP.
EXAMPLE:
Number of satisfactory inspected quadrants = 36
Number of quadrants inspected = 40
WQP ([36 ÷ 40] x 100) = 90%
10.0 ACCEPTANCE
10.1 Work will be accepted or rejected on an individual unit basis.
10.2 Acceptable Quality Level (AQL)—A 90% WQP is the minimum AQL required for unit acceptance.
10.3 Unsatisfactory Work Quality
SOLICITATION NO. 140L4322Q0116
10.4 Based on inspection results, if a unit falls below the AQL of 90%, the COR will immediately notify the Contractor in writing and instruct the Contractor to improve the quality of the work. If the quality of the work is not raised to the minimum AQL of 90% after written notification, the CO may issue a notice of noncompliance. If the work quality is not addressed per the notice of noncompliance, contract termination may ensue.
10.4.1. Reinspection—If a unit falls below the minimum AQL of 90%, rework will be required. When instructed by the COR, the Contractor shall rework the unit for reinspection by the Government.
11.0 PAYMENT
11.1 Payment will be based on the Government’s inspection results. The Contractor’s inspection results are to be used as a guide for the Contractor’s use in complying with contract specifications and not as a basis for payment.
11.1.2 Payment will be made on completed units for the actual number of acres for each unit treated, inspected, and accepted by the Government. If the WQP equals or exceeds the AQL of 90 percent, full payment (100 percent) will be made for the number of acres inspected and accepted by the Government on the completed units.
11.1.3 If a unit fails to meet the AQL of 90% after rework by the Contractor and reinspection by the Government, the Government may seek equitable adjustment in accordance with Clause 52.212-4(a).
12.0 MEASUREMENT
12.1 The method of measurement for the number of acres for each unit is measured on the horizontal plane by a GPS instrument to the nearest whole acre.
12.2 Re-measurement of Units
12.2.1 The Contractor may, at any time during the contract, request re-measurement of any unit if the Contractor feels that the area stated in the contract and on the project maps is incorrect. If re-measurement indicates that a variance of 5% or less exists, the Contractor will pay for the actual cost of the re-measurement.
Under this condition, payment for the unit will be made on the area stated in the contract.
12.2.2 If re-measurement indicates that the actual acreage variance is more than 5% of that stated in the contract, payment for the unit will be based on the re-measured acreage. The cost for re-measurement will be paid for by the Government.

52.246-4 INSPECTION OF SERVICES – FIXED PRICE AUG 1996
E.1 QUALITY CONTROL
E.1.l Tree Planting - Quality of work and conformance with planting specifications will be determined by e surveys as described in E.1.2.
The Contractor is encouraged to observe the inspections and will be notified of the inspection results. When requested by the Contractor, a copy of the inspection results will be provided to the Contractor.
SOLICITATION NO. 140L4322Q0116
E.1.2 Surveys will be performed across planting rows at constant intervals to obtain a representative sample of each planter's planting quality. Plot size used for planting inspection will be determined based on specifications provided for each unit.
Each planted tree found on the survey plot will be examined for (1) site preparation, proper selecting of planting spot and spacing as required by the planting method designated and described in the specifications; (2) planting depth; (3) position of stem; (4) root placement and (5) firmness;
(6) damage to seedling.
E.1.3 For Units with strict spacing requirements, both planting quality and spacing of seedlings will be inspected. Adequacy of spacing, underplanting and overplanting will be determined by the presence or absence of trees on individual plots and/or actual spacing measurements between planted trees.
If quality of planting or spacing are found deficient on these surveys, the Contractor or its authorized representative will be instructed to take immediate action to correct these deficiencies at no additional cost to the Government, which may include replanting of unacceptable areas.
E.1.4 For Units with variable spacing, plots falling on plantable areas without one or more trees (planted or natural) may indicate under-planting as determined by the COR. Over-planting is indicated by plots that fall on plantable area and contain two or more trees (one or more which is planted) within two square foot.
The Contractor or its authorized representative will be instructed to take immediate action to correct deficiencies at no additional cost to the Government, which may include replanting of unacceptable areas. Should planting AQL fall below 70% on a given day, work for that day will be stopped and resume the following day.
E.l.5 Average (mean) percentages for planting densities are determined through analysis for improper planting; underplanting; and overplanting. A variance of no more than 10% of the planting density for a specific area as provided in the Unit Information, regardless of spacing, will be accepted.
E.2 Paper Mulching, Tubing, and Stand Maintenance Items - Quality of work and conformance with specifications will be determined by a series of inspection points across the project area at constant intervals. Data for determination of work quality and as a basis for the project acceptance and payment will be collected from these points and calculated on a per-unit basis. A minimum of 25 inspection points, whichever is greater, will be taken on each unit. Additional points above the minimum required may be inspected at the discretion of the COR. The tree closest to the inspection point will be examined for contract compliance and conformance to specifications. One
(1) tree per inspection point will be examined for compliance with specifications. Untreated trees will be examined to determine if treatment should have been applied. Inspection points will either pass or fail based on compliance with the specifications.
E.2.1 The Contractor is required to perform quality control. The COR may request the Contractor to provide documentation of quality control plot data collected on planted units. Documentation shall include the following: Unit number, plot number, tree data for all trees on plot, and spacing. Plot center shall be marked with flagging and labeled with a waterproof marker. The color of flagging must be approved by the COR. The plot shall be located and shown on the project area map.
Sampling intensity shall be sufficient to a standard error within 10%.
E.3.0 PAYMENT
E.3.1 Payments will be calculated and issued on a per-unit basis.
SOLICITATION NO. 140L4322Q0116
E.3.2 Tree Planting Items – Units with an AQL of 90% or higher will receive full payment. Payments for units with an AQL less than 90% will be made for the amount of acceptable work. Payment for acceptable work is based on acreage shown for each unit on the project maps and the percentage of work determined acceptable.
EXAMPLES
Per Acre Basis
Step 1 -- Forty (40) acres successfully planted with Acceptable Quality Level (AQL) of 80%: 40 x $150 per acre = $6,000 (contract price)
Step 2 -- $6,000 x 80% (AQL) = $4,800(amount to be paid)
E.3.3 Mulching, Tubing, and Stand Maintenance Items - An AQL of 90% or higher will result in full payment. Units that fall below 90% work quality shall require rework at no additional cost to the Government. Should additional supplies be required, the Contractor shall be paid less the cost of additional supplies. In some instances, the COR may deem rework detrimental to seedling survival. In those instances, payment will be made for the amount of acceptable work.
For example: 89% × Bid price per acre – cost of additional supplies = Payment.
Tubing = Tubing installation performed for reforestation services under thousand shall be paid based on unit cost/1000 x number of tubes installed = payment amount.

CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (JULY 2010)
(a) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR42.15.
(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.
(c) We request that you furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.
(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically-generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at http://www.cpars.csd.disa.milJ. The CPARS User Manual, registration for On Line Training for Contractor Representatives, and a practice application may be found at this site.
(e) Within 60 days after the end of a performance period, the Contracting Officer will complete an interim or final past performance evaluation, and the report will be accessible at http://www.cpars.csd.disa.mil/. Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment. Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in the Assessing Official's narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1 - 17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection actions. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating ''No comment" in Block 22, and then signing and dating Block 23 of the form. Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 30 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment." Your response is due within 30 calendar days after receipt of the CPAR.
(f) The following guidelines apply concerning your use of the past performance evaluation:
(1) Protect the evaluation as "source selection information." After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.
http://www.cpars.csd.disa.milj/ http://www.cpars.csd.disa.mil/
SOLICITATION NO. 140L4322Q0116
(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.
(3) Prohibit the use of or reference to evaluation data for advertising, promotional material, preaward surveys, responsibility determinations, production readiness reviews, or other similar purposes.
(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 30- day review period.
(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.
