SECTION 2

STATEMENT OF WORK

SUPPORT FOR TRIBAL ENGAGEMENT IN REVIEW OF VINEYARD NE WIND

PROJECT

2.1 INTRODUCTION

The U.S. Department of the Interior (DOI), Bureau of Ocean Energy Management (BOEM) is currently processing a construction and operations plan (COP) for the Vineyard Northeast project off the coast of Massachusetts with cable routes extending to Massachusetts and Connecticut.

The environmental review consists of the preparation of an environmental impact statement (EIS) under the National Environmental Policy Act (NEPA). Additionally, under the National Historic Preservation Act (NHPA), the project is undergoing a Section 106 review. Federally recognized tribes (Tribes) are already participating in these reviews as they have a unique and important interest due to projects being located in offshore areas previously occupied by the Tribes and offshore the Tribes’ onshore cultural properties. However, many Tribes expressed concern about the limits on personnel and scientific and technical expertise to fully participate in providing comments and input on the project. Therefore, BOEM is issuing this requirement to provide scientific and technical support to the Tribes.

Tribes have expressed an interest in a wide range of scientific and technical topics related to potential impacts of offshore wind development. This requirement will assist Tribes in reviewing the Construction and Operations Plan (COP), preparing comments for on the draft EIS and Section 106 documents. BOEM will not authorize use of contract funds for litigation support. A draft EIS is made available to the public for review to ensure all issues are captured in the EIS and accurately represented with the best available information. The anticipated public comment period for the draft EIS is from May 23, 2025, through July 7, 2025.

2.2 OBJECTIVE

The objective of this requirement is to provide technical expertise and assistance to Tribal nations in the review of the Vineyard Northeast project documents, including the construction and operations plan, supporting technical materials, the draft environmental impact statement, and Section 106 documents.

2.3 SCOPE OF WORK

2.3.1 Task 1: Initial Meetings with Tribes

Within two weeks from introduction by BOEM, the Contractor shall schedule virtual meetings with each Tribe that agrees to participate. Tribes that may be included in the discussions are:

The Delaware Nation Delaware Tribe of Indians Mashantucket (Western) Pequot Tribe Mashpee Wampanoag Tribe

• Cultural resources potentially impacted by the project

• Other concerns or questions about the project

2.3.2 Task 2: Review Construction and Operations Plan and Relevant Appendices

Areas for focus of the review include:

• Other areas identified by Tribes

2.3.3 Task 3: Review Draft Outline of Tribal Values and Concerns Appendix of Environmental Impact Statement

Tribal Values and Concerns is a new appendix that BOEM may add to Environmental Impact Statements for offshore wind energy development projects, including the Vineyard Northeast Project. BOEM is considering adding an appendix to Environmental Impact Statements that could serve as the primary location of Tribal information, where Tribal resources made known to BOEM would be summarized and assessed for potential impacts from a project. BOEM is seeking input from Tribes on the purpose, format, and content of the proposed appendix.

The Contractor shall review a draft outline of the Tribal Values and Concerns Appendix of the Environmental Impact Statement to identify where the concerns raised by the Tribes are or are not addressed. The Contractor shall summarize the nature of the concerns and how these concerns are addressed. The Contractor may be required to attend meetings with BOEM and Tribes to discuss the draft outline and its inclusion in the Environmental Impact Statement.

RFQ 140M0124Q0059 – Tribal Engagement for Vineyard NE Wind Project Page 7 of 39

BOEM anticipates that consultation and review of the outline would occur prior to publication of the Draft Environmental Impact Statement for the Vineyard Northeast.

Within the proposed appendix, relevant history of Tribal consultations, including any concerns expressed by Tribes, would be summarized and considered in the analysis. Tribal resource protection measures (i.e., other NEPA alternatives and avoidance, minimization, mitigation, and monitoring measures) would also be summarized and assessed.

Areas for review include:

• Format and content of outline

• Best practices for addressing Tribal concerns in EIS

• Consultation between BOEM and Tribes on identification of Tribal values and concerns

The Contractor shall discuss with the Tribes key points to include in a comment letter on the outline of the Tribal Values and Concerns appendix and draft EIS to be submitted to BOEM to ensure that their concerns are included in the Final EIS. The Contractor shall discuss the Findings of Effect and Memorandum of Agreement and avoidance, minimization, and potential mitigations that the Tribes may want to pursue. 3.12 CONTRACTOR CONFLICT OF INTEREST

RFQ 140M0124Q0059 – Tribal Engagement for Vineyard NE Wind Project Page 17 of 39

(a) It is the policy of the Department of the Interior to avoid contract awards which could result in or create conflicts of interest, whether actual or apparent. Such a situation could occur in the instance when the Contractor or any subcontractors or teaming arrangement partners have business, financial, real property, mineral rights, or other interests, as well as professional activities that create conflicting roles which could potentially bias a Contractor’s judgment or result in unfair competitive advantage to the Contractor, and thus impede the government’s objective to obtain an impartial, technically sound and objective performance of this contract.

(b) Any quote submitted in response to this request for quotes must identify any actual or potential conflict of interest described in paragraph (a) and include a Conflict of Interest Mitigation Plan if the Contractor believes such persons or entities are indispensable to its quote.

The Government’s approval of any proposed Conflict of Interest Mitigation Plan shall be at the sole discretion of the Contracting Officer.

(c) Absent a written approval of a Conflict of Interest Mitigation Plan from the Contracting Officer, the Contractor, or any of its officers, representatives, employees, subcontractors, or teaming arrangement members, shall not be involved in any situation during the performance of this contract which may result in conflicts as contemplated in paragraph (a) above.

Failure to comply with this provision may be cause for termination for default.

(d) The Contractor shall disclose, upon discovery, any interest which may develop after contract award that may result in a conflict as contemplated in paragraph (a) above. Failure to comply with this provision may be cause for termination of this award for default.

(e) The Contractor shall include this clause, including this paragraph in all subcontracts and consultant agreements; however, subcontractors and consultants shall be directed to send any mitigation plan to the Contractor who shall then inform the Contracting Officer.

(f) The Contractor, its employees, subcontractors and teaming arrangement partners, shall not engage in any communication regarding any aspect of performance of this contract with any person or entity described in paragraph (a) above without express permission from the Contracting Officer. Failure to comply with this provision may be cause for termination of this award for default.
