Addendum to FAR 52.212-2 – Evaluation-Commercial Products and Commercial Services
Instructions to Offerors – Commercial items.
Basis of Award. Pursuant to FAR 52.212-1(h), the Government may accept any item or group of quoted items. The Government will evaluate each line item separately and anticipates awarding multiple contracts resulting from this solicitation to the responsible offeror or offerors whose quote conforms to the solicitation and will be most advantageous to the Government, price and other factors considered.
Awards will be made based on evaluation of price and non-price factors. Non-price factors when combined, are significantly more important than price. The Government reserves the right to make award to a higher priced offer that offers less risk based on quote specifications and past performance.
Technical Evaluation
The Government will evaluate each line item’s proposed amount of Government-Furnished seed required, and number of acres proposed to determine if the amounts are acceptable and reasonable to meet the Government’s requirements.
Past Performance Evaluation
A past performance evaluation will be conducted for quoted line items that receive an acceptable technical rating.
An evaluation of past performance will consider successful execution of contracts similar in include scope.
The past performance evaluation may be based on information provided by quoters and other relevant past performance information available.
The Government will assess the relative performance risks associated with an offeror’s record of past performance. Performance risks are those related to the likelihood of successful contract execution. The assessment of performance risk is not intended to be the product of a mechanical or mathematical analysis but rather a judgment by the Government after it considers all available and relevant information.
The Government will consider the recency and relevance of past performance information, source of the information, context of the data, and general trends in the offeror’s performance.
The lack of a relevant performance record will result in a neutral performance risk assessment, which will be used neither positively nor negatively.
Price Evaluation
Quoted prices will be evaluated to determine if a quoted price is fair and reasonable in accordance with FAR 13.106-3. This evaluation will consider quoted unit prices and total line-item price.
If the Contracting Officer determines there is not adequate price competition, then additional data (other than certified cost data) may be required.
Communications with Quoters
As set forth in FAR 52.212-1(g), the Government intends to evaluate quotes and award without communications with quoters. Quotes should contain best pricing.
