PERFORMANCE WORK STATEMENT (PWS)

Sterling Creek Adult Sea Lamprey Trapping Activities

Part 1

General Information

1. GENERAL: This is a non-personnel services contract to provide adult sea lamprey trapping activities on Sterling Creek, Cayuga County, New York. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform adult sea lamprey trapping activities on Sterling Creek, NY as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.

1.2 Background: Since 1978, the U.S. Fish and Wildlife Service (Service), Marquette Biological Station annually has monitored spawning-phase sea lamprey populations in Lake Ontario tributaries. The work has supplied the Service with a sound information base of the critical population trend through time data required in assessing the effectiveness of the sea lamprey control program in Lake Ontario. Past experience has shown that contracting out of these types of field duties for Great Lakes wide assessment activities is a practical and efficient means of providing the necessary services.

1.3 Objectives:

• Conduct adult sea lamprey trapping in Sterling Creek, NY

• Report data to the Service via the Great Lakes Fishery Commission sea lamprey trappers website

• Communicate with Service representatives to coordinate trapping activities and inform them of potential issues, concerns, and updates

1.4 Scope: The contractor will conduct adult sea lamprey trapping activities during the spawning run in Sterling Creek, NY. Activities include operating sea lamprey traps, recording relevant data, and communicating with Service representatives regarding trapping operations (See Part 5.1 of this document for specific details).

1.5 Period of Performance: The period of performance shall be for one (1) Base Year of 12 months and four

(4) 12-month option years.

Work will be performed for a period of 9 weeks beginning on or about the end of March and end on or about the end of May each year. Specific dates will be confirmed by the Contracting Officer’s Representative, Fishery Biologist at Marquette Biological Station. If water levels are such that work cannot begin at the of March, the work will begin as soon as acceptable water levels are reached and the contract will run for a period of 9 weeks from when traps are set.

1.6 General Information

1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality http://glfc.org/sealamp/catchdb/login.php control program is the means by which he assures himself that his work complies with the requirement of the contract.

1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.3 Recognized Holidays: The contractor is not required to perform services on any federally recognized holidays.

1.6.4 Hours of Operation: The contractor is responsible for conducting business, Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons.

The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.6.5 Place of Performance: The work to be performed under this contract will be performed at Sterling Creek, Cayuga County, New York - 1/8 mile upstream from Sterling Valley Road.

1.6.6 Type of Contract: The government will award a Base plus 4 option year contract. Base year price adjusted in option years based on the Average Annual Consumer Price Index (CPI).

1.6.7 Security Requirements: Not applicable

1.6.7.1 PHYSICAL Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, equipment and materials shall be secured.

1.6.7.2 Key Control. Not applicable

1.6.7.3 Lock Combinations. Not applicable

1.6.8 Special Qualifications: Contractor must:

1. Be at least 18 years of age

2. Conduct all operations in a safe manner, observing all applicable safety regulations

3. Possess an understanding of the fundamentals of fishery science and the concept of stock assessment

4. Be able to recruit another person to help perform the activities required of this contract.

5. Possess the ability, as a two (2) person team, to set and lift portable lamprey traps which, when filled, and occasionally exceed 150 pounds.

6. Be able to identify fish found in Lake Ontario tributary rivers and have skill in keeping fishery statistical records

7. Be able to perform repetitive tasks with a high degree of accuracy

8. Be able to perform duties under adverse weather conditions

9. Be able to summarize data and submit weekly progress reports via phone and computer

1.6.9 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.10 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract:

perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.6.11 Key Personnel: Not applicable

1.6.12 Identification of Contractor Employees: Contractor personnel are not required to obtain and wear badges in the performance of this service.

1.6.13 Contractor Travel: Not applicable

1.6.14 Other Direct Costs: Not applicable

1.6.15 Data Rights: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose.

This right does not abrogate any other Government rights.

1.6.16 Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may effect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

PART 2

DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS:

2.1. DEFINITIONS:

2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.9. QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.1.12. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.

4.2 Secret Facility Clearance: Not Applicable

4.3. Materials : Not Applicable

4.4. Equipment: The Contractor shall provide transportation, personal clothing, boots, and life jackets. All other equipment and supplies will be provided by the Service. The Contractor may need to remove and store traps and equipment at the conclusion of trapping operations until Service personnel are available to retrieve the items. They will provide the use of their personal computer and phone to conduct reporting measures.

4.5 Insurance: After award, but prior to the commencement of work, the Contractor shall furnish the Contracting Officer with acceptable evidence showing that the following insurance coverage has been obtained. The Contractor shall acquire and maintain, during the term of this contract any extensions thereof, liability insurance in the form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the U.S. Fish and Wildlife Service. The amounts of the insurance shall be not less than as follows:

• Workers Compensation Insurance As required by the laws of the State where work is performed.

• General Liability Insurance For bodily injury liability - $500,000 per occurrence.

• Automobile Liability Insurance Minimum per person - $200,000 Per accident for bodily injury - $500,000 Per accident property damage - $20,000

PART 5

SPECIFIC TASKS

5. Specific Tasks:

5.1. Basic Services. The contractor shall provide services for adult sea lamprey trapping activities on Sterling Creek, NY. Under the initial guidance and instruction of personnel of the Service, 1 sea lamprey trap will be placed below the dam 1/8 mile upstream from Sterling Valley Road on Sterling Creek (1 trap) in Sterling, New York. The Contractor will check and service the trap five days per week with the stipulation that the trap is not un-serviced for two consecutive days.

Traps are set in relation to the water surface level, and minor adjustments in trap placement may be required as water levels fluctuate. The Contractor will keep traps and associated equipment clean of debris buildup and in good working order. The Contractor will inspect traps and equipment during service procedure and make minor field repairs to any damaged parts. In servicing the trap, the Contractor will collect data on date, time, weather and water temperature and conditions, numbers of lampreys captured, numbers and kinds of other fish captured, and any other observations which may be relevant to the operation and on a daily basis submit data online at http://glfc.org/sealamp/catchdb/login.php. On Sterling Creek, a percentage of captured sea lampreys will be marked, transported downstream to the County Road 122 crossing, and released; all sea lampreys will be handled according to standard operating procedures to ensure fish health. All recaptured lampreys are to be weighed, measured, sex determined, and then destroyed and properly disposed of in an approved landfill. All other fish are to be released unharmed. All fish killed as a result of trapping will also be taken to the landfill.

An estimated 1.0 hours of work is required daily at each site. This estimate does not include travel time. If issues arise pertaining to this work, the Contractor will contact the Contracting Officers Technical Representative (Fish Biologist) stationed at the Marquette Biological Station (906) 226-6571.

Work will be performed for a period of 9 weeks beginning on or about March 27, 2022 and ending on or about May 28, 2022 to be confirmed by the Contracting Officer’s Representative, Fishery Biologist at Marquette Biological Station. However, if water levels are such that work cannot begin on March 27 the work will begin as soon as acceptable water levels are reached and the contract will run for a period of 9 weeks from when traps are set.

Prior to the start of this work, the Contractor must supply the Service with his or her complete name and the names of any personnel that may assist with servicing the site during the contract period so their names may be included in the Service collector's permit from the New York Department of Environmental Conservation

The Contractor will be expected to conduct all operations in a safe manner, observing all applicable safety regulations. The Service encourages the Contractor to use seat belts and adopt and enforce on-the-job seat belt policies and programs when operating vehicles.

PART 6

APPLICABLE PUBLICATIONS

6. APPLICABLE PUBLICATIONS (CURRENT EDITIONS)

6.1. The Contractor must abide by all applicable regulations, publications, manuals, and local policies and procedures. The government will provide the Annual Adult Sea Lamprey Assessment Work Plan and associated appendices that provide guidance associated with sea lamprey trapping operation and reporting.

TECHNICAL EXHIBIT 2

INSTRUCTIONS FOR COMPLETING AND SUBMITTING

ADULT ASSESSMENT TRAP CATCH DATA

1. Navigate to the website http://trapping.glfc.org/and login using the following username and password. TRAP CATCHES MUST BE ENTERED DAILY.

Contractors:

Username: last name (in all small letters) Password: fish

U.S. Fish and Wildlife Service:

Username: Employee ID Password: fish

It is very important that you either fill out every section of the Adult Assessment Trap Catch form that applies to your catch or take complete field notes as you will use your notes to enter your information into the database, which is used to generate various informational reports.

2. Upon entering the trap catch web entry system, you will enter the following information on screen number one:

a. Office: pre-selected and will always be Marquette.

b. Lake, Mainstream, and Site: pre-coded on your trap catch sheets, use dropdown to select.

c. Date: Month, day and year.

d. Time: Use 24 hour format. Enter time rounded to the nearest 10 minutes. Example

- 2:14 p.m. will be entered as 1410.

e. Air temp and water temp: Use whole number format. Enter temperature to the nearest degree Celsius.

f. Turbidity: Use drop down menu to select the appropriate description.

1-Clear Bottom seen distinctly through 4 or more feet of water.

2-Slightly turbid Bottom indistinct at 1 to 4 feet.

3-Turbid Bottom indistinct at less than 1 foot.

g. Flow (average velocity of river at site): Use drop-down menu to select the appropriate description.

11 – Sluggish, <0.5 ft/sec 12 – Moderate, 0.5 – 1.5 ft/sec 13 – Rapid, 1.5 – 3 ft/sec 14 – Torrential, > 3 ft/sec

h. Dissolved Oxygen (mg/L): Enter DO meter reading (taken at release) to the nearest tenth.

i. Problems: Use drop-down menu to select the appropriate description.

31 – None, trap in same position 32 – High mortality due to strong current, but in proper position 33 – Damaged by vandalism, but in proper position 34 – Funnels clogged by debris 35 – Filled to capacity, cannot accommodate more lamprey 36 – Out of position or submerged due to high water, vandalism, etc.

j. Efficiency: Use drop-down menu to select the appropriate description. Estimate your trap efficiency based on proper trap position and flow through the trap, number of funnels fishing properly, and other problems encountered since last trap check. If you have two traps and one is fishing at 100%, but the other is only 50% your combined efficiency is 75%. Estimate combined efficiency of all traps as best you can.

k. Staff gauge reading: If applicable, enter reading to the nearest hundredth of a foot.

l. Comments: If applicable, enter any comments concerning the conditions, equipment, or trap catch.

m. Contractor Name: Click on the name of the person servicing the site; if more than one person serviced trap, hold down the <CTRL> key while selecting the names.

3. Click Continue and enter the following data on screen 2:

a. First time capture:

• Record the number of live and dead unmarked sea lampreys caught in each trap for each day, the totals will automatically update. Number traps left to right looking upstream.

• Record the number of males and females that are first time captures, the totals will automatically update.

• Record the number scanned for coded wire tags for each trap in Lake Erie, the total will automatically update.

• Record the number of coded wire tags detected during the scanning process for each trap in Lake Erie, the total will automatically update.

• Record the numbers of lampreys released (total, males, and females), and use the drop down menu to select the fin clip 1,1. All lamprey tagged in U.S. waters will have a 1,1 (front dorsal, rear dorsal) clip while those tagged in the St. Mary’s river by DFO will receive a 2,1 clip. These are the only fin clips which will be use in 2021.

b. Recapture:

• Record the number of live and dead recaptured sea lampreys caught in each trap for each day, the totals will automatically update.

4. Click Continue and enter the following data on screen 3:

a. Recaptures by fin clip and sex:

• Select the fin clip code from the drop down box and then enter the number of males and females with that fin clip (Only 1,1 or 2,1 in the St. Mary’s River). The totals will automatically update. The total at the bottom of this table must equal the total number of recaptures on front.

5. Click Continue and enter the following data on screen 4:

a. Recaptures, length/weight:

• Record the lengths (mm) and weights (g) of no more than 25 males and 25 females.

6. Click Continue and enter the following data on screen 5:

a. Other Species Catch:

• Select the species name from the drop down list and then enter the number of alive and dead specimens caught in the trap, the totals will automatically update. There is only space for ten species, if you have more than that, please add to comments. If species of capture is not included in the drop-down list, please record in comments. Release all live fish as quickly as possible. **BE SURE TO

RECORD AND FREEZE ANY ROUND GOBY AND RUFFE CAUGHT**

REFER TO APPENDIX I FOR INSTRUCTIONS.

7. Review all your data and click submit. You must submit your trap catches daily. You can review your submissions at any time simply by logging into the database and going to “My Submissions”, where you can review, edit, and delete your records.

8. File your notes and/or hard copy trap catch sheets for future data verification.

9. Call or email the designated supervisor for your trap site between 8:00 a.m. and 9:00 a.m.

each Monday to report on the previous week's (Sunday through Saturday) the operation of the traps and nets, per the scope of work. If you fail to do so, this information will be documented and may be used in future consideration of sea lamprey contracts.
