About this file

This document is a Brand Name Justification form for the Bureau of Indian Affairs (BIA) Office of Justice Services, specifically the Missing and Murdered Unit (MMU). The procurement seeks three Sonar Underwater Robotic Vehicles (underwater drones) from an Indian Small Business Economic Enterprise (ISBEE), with each unit including a robotic grabber, software, extra battery, thruster kit assemblies, and a five-year warranty. The solicitation targets Native American businesses in NAICS code 334511, with market research identifying 45 potential vendors and RJE Oceanbiotics already expressing interest.

The justification highlights that the MMU division currently owns an Oceanbiotics drone purchased in 2022, with ten agents and an evidence technician already trained to operate the equipment. The procurement aims to provide compatible drone equipment across regional units to enhance mission effectiveness. The contract will be a new firm-fixed price agreement under solicitation number 140A1625Q0025, with the BIA Central Office seeking to maximize competition by directly soliciting qualified vendors through SAM.gov while maintaining a preference for the specific RV-8 Underwater Robotic Vehicles to support missing and murdered case investigations.

This is a brand name only justification for the RV-8 Underwater Robotic Vehicles.

These systems increase the MMU’s ability to solve missing and murdered cases.

In accordance with FAR requirements, efforts are made to ensure that offers are solicited from as many potential sources as is practicable for this procurement. This will fulfill the synopsis requirement by issuing both the synopsis and solicitation as a single document, in accordance with FAR 12.603.

The MMU division has requirement for three (3) Sonar Underwater Robotic Vehicles (underwater drones) to include robotic grabber, software, extra battery and thruster kit assemblies. Each unit will include an extended five (5) warranty.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination is based on the following:

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

9. Any other facts supporting the use of justification of other than full and open competition, such as:

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

11. A statement of any actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Competitive quotes and commercially published price list.

A search on the Native American Businesses in SAM.gov with the NAICS 334511 it was determined that 45 ISBEEs could potentially fulfill this requirement. It has been determined there is adequate competition available for this effort. See file (A14-Market Research).

MMU division already owns one Oceanbotics drone purchased in 2022. Ten (10) agents and an evidence technician have all been trained and are certified to operate the Oceanbotics unit. The MMU agents are located in different regions across the country and are each certified operators for their respective regions. Providing compatible drone equipment across the regional units assists with effective and efficient deployment of the equipment and ultimately the success of the mission.

This product is commercially available and the research shows two or more ISBEEs could fulfill this requirement. RJE Oceanbiotics has expressed interest in this procurement.

We will work closely with the customer to explore whether alternative models from other manufacturers could be considered, especially if replacing the entire stock of equipment can be accomplished through a single procurement.
