About this file
This document is a Justification & Approval for Other Than Full and Open Competition for a simplified acquisition over $10,000. It describes the requirement for the National Park Service, Sequoia and Kings Canyon National Parks, to purchase replacement Yardney valve assemblies, position indicators, gaskets, and tubing for the Ash Mountain Water Treatment Plant. The replacement items are needed due to damage from debris flows following the 2021 KNP Fire. The Yardney brand is required because the existing infrastructure of the plant was designed for these specific valves, which have a custom bonnet assembly and are NSF certified for potable water use. No other valves meeting the same specifications could be found through market research. The government intends to award a single firm fixed price contract for the required supplies.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER $10,000 ($2,000/$2500 for Construction/Services) AND
UP TO $250,000
(See FAR 13.106-1)
Date: ____May 23, 2024_________________ PR Number: _40662533________________________
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
Sequoia and Kings Canyon National Parks has a brand specific requirement for supply and delivery of Yardney valve assemblies, position indicators, gaskets and associated tubing for Ash Mountain Water Treatment Plant. There is a need to purchase the following:
Ten (10) 4” Yardney 133542400 diaphragm valves, grooved ends, factory coated and assembled with custom bonnet assembly, epoxy internal coating (NSF certified for potable water), and primer/enamel external coating Ten (10) Yardney 315000012 pressure indicator assemblies to indicate open or closed position for the above valve (install in the field) Thirty (30) Yardney 108560400 4” Victaulic type gasket for grooved couplings Two (2) Yardney 108560600 6” Victaulic type gasket for grooved couplings One hundred (100) feet of ¼” tubing, black UV resistant
The requirement is for replacement items that were damaged by debris flows from the 2021 KNP Fire followed by heavy runoff.
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
___X__ Other __BRAND NAME______________________________________
Explain:
The requirement consists of a valve assembly that must be compatible with the existing infrastructure of the Ash Mountain Water Treatment Plant. Yardney valve components were utilized by the designer/installer of custom manufactured original Ash Mountain Water Treatment Plant. The parts consist of Bermad grooved diaphragm valves which are typically used in agricultural systems that Yardney disassembles, applies an NSF (potable water approved) interior epoxy coating, an exterior enamel coating for corrosion resistance, and a custom bonnet for installation of position sensors. The lay length of the assembly is critical in matching it to the existing piping which has been designed for “hard piped” Bermad valves to be used with Victaulic grooved couplings. A different valve assembly would require cutting and modification of the existing piping. The Victaulic couplings are designed to reduce the effort and challenges associated with the pipe joining, eliminating the need for complete disassembly of the system through conventional threaded fittings for component replacement and service. The plant operation requires regular and frequent cleaning and services requiring frequent removal of components.
Additionally, the Yardney valve assemblies are a designed component of the system automation.
Pneumatic actuation and timing has been programmed for these specific valves. If not replaced with “in kind” parts, costly contracted services will be required for re-programming of the automation and calibration. No other valves of this type meet the NSF requirements and have the same lay length.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
Only Yardney replacement parts can meet this requirement due to the parts needing to fit into the existing infrastructure of the Ash Mountain Water Treatment Plant. Personnel have thoroughly researched this issue, including conducting extensive internet searches to attempt to find NSF approved diaphragm valves with the same characteristics (NSF approved, same length, grooved ends, bonnet for indicator). None were found. No other manufacturer can meet these requirements and specifications.
4. If this is a determination for sole source, the contracting officer certifies:
a. Multiple sources are available, but only one brand name is being sought.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
