About this file
This is a Brand Name Only Justification for a contract action with the Bureau of Indian Affairs, Office of Justice Services/Fleet and Firearms division. The requirement is for Hornady ammunition supplies totaling 72,200 rounds to support training and operations at the Federal Indian Police Academy. Specific quantities include .357 SIG (10 cases), 10MM Auto (15 cases), .45 Auto+P (15 cases), .40 S&W (25 cases), 12GA 00 Buck (255 cases), and 12GA Slug (217 cases). The procurement is designated as a new requirement under firm-fixed pricing with Purchase Request Number 44054648 and J&A Control Number JA26-00265.
The justification authorizes other than full and open competition under FAR 13.106-1(b)(1)(i) based on Hornady's unique qualifications and the established, continuous reliance of BIA law enforcement and training programs on this specific brand for uniform ballistic performance, safety, and qualification standards. The contracting officer has determined the anticipated cost will be fair and reasonable based on adequate price competition, available Government discounts, historical purchase data, and comparison against the manufacturer's published commercial catalog if necessary. Market research identified 17 Indian Small Business Economic Enterprises (ISBEEs) capable of supplying Hornady ammunition under NAICS 332992, confirming sufficient competitive sources exist to solicit this as an ISBEE set-aside. The Brand Name Justification will be published with the Combined Synopsis/Solicitation on SAM.gov to ensure public notice.

BIA law enforcement and training programs have consistently relied on Hornady ammunition, ensuring uniform ballistic performance, safety, and qualification standards. This established, continuous use supports standardized training outcomes, and no other brand meets the required familiarity, reliability, or performance consistency needed for academy training.
The Brand Name Justification will be included with the Combined Synopsis/Solicitation published on SAM.gov, ensuring public notice. Market research confirms that ISBEEs are capable of supplying Hornady ammunition; therefore, the requirement will be solicited as an ISBEE set-aside.

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination is based on the following:
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.
9. Any other facts supporting the use of justification of other than full and open competition, such as:
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
11. A statement of any actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
