PWS 1.0 Background on the Government’s Requirement
The U.S. Bureau of Land Management (BLM), Mother Lode Field Office, requires invasive weed removal/excavation, and other miscellaneous work necessary to restore open-water foraging and wetland habitat for the state and federally listed “threatened” giant garter snake at the Cosumnes River Preserve (Preserve). The Contractor services can begin within 3 business days of award and must be completed no later than October 30, 2022., in order to meet the requirements to protect the giant garter snake.
To restore native habitat and improve ecosystem function, invasive Uruguayan water primrose (Ludwigia hexapetala) will be mechanically removed from the channel of Laguna Creek in the Whaley Unit of Cosumnes River Preserve (CRP). The water primrose, and associated debris/spoils, will be placed in small piles along the bank to allow it to dry evenly and compost in place.
The BLM manages the Whaley Unit through cooperative agreements with the California State Lands Commission and the California Department of Fish and Wildlife. The BLM has consulted with US Fish and Wildlife Service (USFWS) and this project will take place under the guidance of USFWS Consultation 81420-2008-I-1984-R001-1, dated May 5, 2021. All project environmental compliance measures (e.g., biological monitoring, etc.)
associated with this Consultation will be overseen and executed by BLM personnel.
PWS 2.0 General Scope of Work
MECHANICAL REMOVAL OF WATER PRIMROSE
Using appropriate machinery (e.g., long-reach excavator, aquatic harvester, or other), remove approximately 8,376 cubic yards of dense primrose and accumulated biomass (debris) that occludes approximately 3700 liner feet of the Laguna Creek Waterway.
Work must be conducted in a manner that minimizes stream bank disturbance and erosion. As the primrose and biomass are removed from the waterway, it can be stockpiled/stored on-site along Laguna Creek. This must be done in a manner that promotes drying of the debris and minimizes subsequent erosion of the debris back into Laguna Creek.
GENERAL PROVISIONS
1. The Contractor would be required to perform the services on a Preserve (CRP) whose mission includes the protection and maintenance, in perpetuity, of sensitive natural resources such as freshwater wetlands, valley oak (Quercus lobata) riparian forests, vernal pool grassland, federal and state threatened and endangered species, and federal trust migratory species. The Contractor would be required to work in sensitive habitats
PWS Page 3 on the Preserve; habitats that contain sensitive species such as the federal and state-listed threatened giant garter snake and the state-listed threatened greater sandhill crane (associated conservation measures outlined within USFWS Consultation 81420- 2008-I-1984-R001-1). The contractor should be aware that beavers reside in the general area and may construct beaver dams within or downstream of the project. Removal of beaver dams is allowed if it assists in project implementation. The contractor shall be required to adhere to all state, federal, local, and Preserve laws, regulations, policies, and rules regarding protection the of all natural resource values at the Preserve. All contractor operations at this site shall be conducted in a professional manner that protects and preserves the ecological integrity of the site.
2. All work shall be done in compliance with contract terms, specifications, provisions and the most current governing Federal, State, and Local codes and regulations.
3. The BLM will conduct inspections of all items and materials delivered in this contract to ensure they meet the specifications.
4. The Contractor shall provide everything, including but not limited to, all equipment, supplies, materials, transportation, labor, and supervision necessary to complete the project tasks.
Place of Performance:
General:
The project location is at Laguna Creek within the Cosumnes River Preserve’s Whaley Unit (adjacent to Assessor’s Parcel Numbers 148-0010-061 and 148-0010-063), which is north of Twin Cities Road, near Galt, Sacramento County, CA.
Specific:
Within township T5N, R6E; Section 7, of the MDM on the 7.5 minute Galt, CA USGS Quadrangle. West of Highway 99 at Twin Cities Road. Site coordinates: 38°17'29.79"N, 121°22'32.25"W.
Period of Performance:
Work on this project must allow for a pre project survey for giant garter snakes within 24 hours of the hour commencing mechanical removal of primrose and debris. Please allow BLM up to 3 days to coordinate the required snake survey. The work must be completed by October 30, 2022.

PWS 3.0 Overall Objective(s)
The overall objective of this project is to mechanically remove approximately 8,376 cubic yards of highly invasive Uruguayan water primrose (Ludwigia hexapetala) from Laguna Creek, bank-to-bank (~3,700 linear ft. channel length).
PWS 4.0 Specific Tasks
PRIMROSE REMOVAL SPECIFICATIONS
1.0 GENERAL
This project task is to mechanically remove approximately 8,376 cubic yards of highly invasive Uruguayan water primrose (Ludwigia hexapetala) from Laguna Creek, bank-to-bank.
2.0 EXECUTION
Using appropriate machinery (e.g., long-reach excavator, aquatic harvester, or other), remove approximately 8,376 cubic yards of dense primrose and accumulated biomass (debris) that occludes approximately 3700 liner feet of the Laguna Creek Waterway.
Work must be conducted in a manner that minimizes stream bank disturbance and erosion.
As the primrose and biomass are removed from the waterway, it can be stockpiled/stored on-site along Laguna Creek. This must be done in a manner that promotes drying of the debris and minimizes subsequent erosion of the debris back into Laguna Creek.
The BLM will provide a biological monitor for this project to ensure contractor adheres to Biological Opinion requirements which includes the following:
1. Prior to mechanical removal of aquatic vegetation in Laguna Creek heavy equipment operators and workers shall receive Service-approved worker environmental awareness training. This training instructs workers to recognize snakes and their habitat(s). This training will be provided by BLM staff. All contractor employees working on site must attend this ~ 1 hour training.
2. 24-hours prior to mechanical removal of water primrose or other restoration activities in Laguna Creek, the project area shall be surveyed by BLM staff for snakes. The contractor is responsible for communicating schedule at least 3 days ahead of time to allow for the BLM staff coordination of the survey to be conducted. Survey of the project area will be repeated if a lapse in mechanical removal of aquatic vegetation activity of two weeks or greater has occurred.

3) During mechanical removal activities, a BLM staff biological monitor will be on site. This BLM biological monitor has the right to stop work to contractor work to protect a snake. If a snake is encountered, activities shall cease until appropriate corrective measures have been completed or BLM staff has been determined that the snake will not be harmed.
4) Any sighting of the snake will be reported by BLM staff to the US Fish and Wildlife Service
3.0 PROJECT LIMITATIONS
3.1 Project Equipment and Vehicles
All project equipment and vehicles shall be sized appropriately for the project site. All reclamation equipment entering the site shall be clean and free of debris that could harbor noxious weed seed (e.g., Uruguayan water primrose). Before leaving the site, all reclamation equipment shall be cleaned on-site of debris at a location determined by the Contracting Officer.
The Contractor shall take all necessary precautions to preserve the landscape and vegetation as nearly as practical in their present conditions. This includes the required use of only approved access routes into and out of the Whaley Unit.
Any damage to the access routes, roads, or other infrastructure must be repaired by the contractor prior to final payment. Water and air pollution would be monitored and controlled per the guidelines stated in the environmental compliance documents and approved permits. All fueling points, equipment staging areas, and any necessary safety fencing, signage and traffic control shall be utilized as defined in the environmental compliance documents and approved permits, or per BLM staff or other requirements
PWS 5.0 Delivery / Performance Schedule
1. The Contractor shall execute the on-site elements of the approved proposal within the contract performance time under the conservation measures and stipulations contained in the USFWS Consultation81420-2008-I-1984-R001-1, dated May 5, 2021, and enumerated in PWS 4.0 above.
2. Contractor shall execute all aspects of the project within the Performance Time established in PWS 2.0, Period of Performance, noted above.

The Contractor shall furnish all personnel, materials, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the work tasks defined in this Performance Work Statement, except for those items specified as government-furnished.

Government will provide biological monitor to ensure all project environmental compliance measures (e.g., biological monitoring, etc.) as required in the USFWS Consultation. Contractor does not need to provide a biological monitor for this project.

PWS 7.0 Security and Administrative Matters
Regular Work Hours:
The performance period established for this contract is based upon all work being conducted during regular working hours between 7:00am and 5:00pm, Monday through Friday (and Saturdays, as requested), excluding government holidays. If the Contractor desires to carry on work outside regular hours, including Sundays, and government holidays, a request must be submitted to the Contracting Officer in sufficient time to allow satisfactory arrangements to be made for access to the work site.
Communications:
“Time” for communications received after 3:00pm, after 12:00 pm locally on Fridays, or after 12:00 pm locally prior to a holiday will not start until the next business day. All times are local Pacific Standard Time.

The following Federal Legal Holidays are observed:

Fire Danger Season:
If the Contracting Officer Representative (COR) allows the Contractor to continue work during periods of declared fire danger or season, the Contractor shall comply with all applicable state laws relating to fire prevention and with all special conditions of work as directed by the COR.
Safety:
General Safety:
The Contractor is not expected to work when conditions are unsafe to do so. Any damage caused by Contractor activities must be reported to the Contracting Officer’s Representative within 24 hours of incident.
Sanitation:
The Contractor shall provide and maintain sufficient portable sanitary facilities for employees and contract administration staff. Placement location of facilities shall be approved by the Contracting Officer.
Clean Up:
Contractor is responsible for the cleanup of all debris associated with work on this project.
PWS 8.0 Technical Exhibits and Definitions
Standard Definitions:
Physical Condition The Physical appearance of Federal equipment or facilities that considers cracks, chips, dents, abrasions, rust, corrosion, general cleanliness, vibration, operating temperature, and discoloration and other items as identified by the COR.
Physical condition may be determined by visual as well as diagnostic means.
Contracting Officer (CO) The Secretary of the Interior or designated authorized representative who is the only agent capable of signing a federal award or obligating funds.
Contracting Officer’s Representative (COR) The Contracting Officer’s designated representative as indicated in a delegation of authority letter.

Quality Assurance (QA) Surveillance of Contractor performance to determine performance requirements are met.
Performance Requirements Summary (PRS) (see Technical Exhibit below) The PRS identifies the key performance indicators of the Contract that will be evaluated by the Government to assure Contract performance standards are met by the Contractor.
Quality Control Those actions taken by the Contractor to control the production of goods or services so that they meet the requirements of the performance work statement.
